Farking Pedestrians

Caught up with some riding buddies on the weekend. Heard the bad news that a mate of mine was riding on Main North Road when a drunk and drugged up 17yo bimbo ran out in front of his bike! He cleaned her up at 80kph and both were lucky to survive the hit.

This was way too close to home regarding another incident a year and a half ago when a female motorcyclist on South Road, O'Halloran Hill hit a pedestrian runnning across the road. Both girls (rider and pedestrian) were then subsequently run over by traffic following. That female rider was a close riding buddy of mine (not the first riding mate I've lost and surely won't be the last). I've had near misses myself, when a f**king bimbo yakking on her mobile walked right out in front of me in town. If I didn't brake I would have hit her for sure. She squealed and all, and I gave her a hard kick up the arse! :unsure:

Anyways, my mate is shaken up but okay with some bad bruises and bumps. He's okay, but the bike (2005 R1) is farked. Cops told him he had nothing to worry about, the drunk 17yo was at fault. Stupid thing is his insurer won't cover the accident. Legally, she's under 18 (despite drinking and being drunk and on drugs) so they can't go after her for repairs. He's now f**ked with a $8K bill. He can't even claim for personal injury because she's a minor. Can't sue her. f**king teens, pisses me off to hear this.

Thats why I stick my foot out when a pedestrian thinks they can walk in front of me! I'll do it too. If the hit is inevitable, I'm going to do what I can to protect my property and myself. So all you Paris Hilton wannabes out there plug your brain back in and f**king use it!

Sounds quite strange they won't cover the bike as what happens when your car is stolen by 16yr olds... Its still covered.

Get rammed by some young 16yr old in a commodore up north and the car is still covered.

What insurance company is he with?

I drove past only minutes after the accident on South road out the front of the BP. Not a very nice site at all. I'm still bewildered today how the driver didn't see the the rider sprawled out on the road. :unsure:

unfortunately, most of them fail to learn that their brain is actually unplugged until they hit at least 20. always sucks when people in the right get stuck with this shit. but as a minor, arent the parents liable?

The parent are financially responsible for their children until they are 18 so he needs to chase them for the money. This would be better than chasing the girl anyway because she would claim that she can only pay $5 a week but the parent will have a hard time proving that they can't afford more.

Me and my mates where at a party waiting for the others to turn up at the time. Then all our phones rang at once with the bad news. Worst thing we ever did was ride out there and see the scene. I'll never lose that image ... ever. :P Rotten.com doesn't even prepare you for this. It was massively horrific.

The traffic following never saw the two girls because that section of South Road has a undulated 'dip', and at that time of night they didn't see her and the traffic ran over her. We were indeed stupid riding out there. Better off sucking more beer and dealing with the loss that night!?! :unsure:

I lived two streets from Wendy and rode with her and that section of road all the time. Was hard for a while. Thats why some of you guys might hear me mention I'm going home for some bourbon. Its just something we did after each ride. Ride back to her place with a few of the guys and drink booze and watch reruns of bike races! Its something I still do ... reminds me how precious life is, and how we need to take care out there. We did a memorial for her November last year and one of the guys almost hit another fool running across the road. Given the nature of the near miss, we gave the pedestrian a massive mouthful.

Well, it was with great relief to hear my mate was just stirred and shaken after the crash. Damn, out of the 15 or so guys (and girls) I ride with, 5 of us have had incidents so far this year. If its not stupid pedestrians, is those useless, homocidal taxi drivers!

yeah sorry to hear Reuben

i almost had a peddy walk in front of me tonight 5pm peak hour traffic on greenhill rd and some suit starts walking into my lane off the median strip to get to the other side

i mean cmon haven't these guys played frogger the truck always wins :unsure:

It irritates me when I drive/ride thru the city and pedestrians just walk in front of you with that "don't you dare hit me" look on their face. You put yourself in front of my car I'll threaten to run you down ... you know the risks, don't push your luck. Usually the BOV in the car, or loud rev on the bike, will scare the f**kers enough. I hate attitude. Don't give me attitude when you know you're the one being stupid. Simple. :unsure:

Thats terrible news....I remember the O'Halloran Hill incident very well, a mate of mine knew one of the people in the crash as well.

Your mates R1 has to be covered if he has comprehensive unless he had alcohol or other substances in his blood or disqualified from driving or riding a defected bike.

As far as chasing the 17 year old's parents (and you're asuming that she still lives with parents) you wouldn't waste your time....you'd have to sue her direct for personal injury.

There are many times that insurance companies payout for property and don't recoup their costs because the guilty party are on the dole.

Yeah too true, lol....a real problem with snails in right hand lanes that don't go left when I'm in the car but move quicker than if I was an ambulance when I'm on the bike. :P

im almost 100% sure that yeah ur legal gardian (parents in this case) are responsable.. who knows what kinda insurance it comes under.. but im sure if he got a lawyer to hassle them theyd help out atleast a bit :S pretty hardcore to nail a chick at 80... loose ya bike n cain ya self.!

just thinking.. can he say he bailed the bike to avoid hard core reprocusions of the situation... surly if hes bailed the bike it would only be his excess at most hed have to pay? she wouldnt remember and just say the bike followd threw and hit her :unsure: idk :P ill just shut up

Like I said earlier, you're asuming she even lives with parents.

Even if she does live with parents, what if a 17 year old commits a serious felony, do you lock up her parents?!

Parents can successfully argue they have no control over their teenager.

That would be Jason then. Yeah, Jason was quite messed up after that. We don't see him much anymore and he's def a changed man ... quieter and wants to be alone all the time. :( Watching the death of your GF in your rear view mirror and having no control on preventing it can do that to a guy.

There's some loop hole there somewhere that is giving him grief, and its all to do with the girl being 17yo and not in a vehicle at the time. Mick has got himself good enough legal counsel/advice, so we'll see what happens. He's not letting it go, thats for sure.

Which is one reason that the insurance companies excuse is a load of BS. If his bike hit a stobie pole, and he had comprehensive, would the insurance companies refuse to pay out based upon the fact the stobie pole was under 18 yrs old? Stupid analogy perhaps, but unless theres a specific clause in the paperwork, they have to provide the cash. Even if they don't recoup it themselves. I'd be lawyering up. Perhaps you could even sue them extra for wasting your time (Call it 'emotional distress')

Sorry to hear this RubyRS4.....that shit is seriously messed up man.....I dont ever slow down when someone is crossing the road and the pedestrian crossing lights just like 10 meters from them.....normally the bov or revs jumping makes them get out of the way......use the damn pedestrian crossing....thats what they are there for and specially in town there are like tonnes of them every 100 meters or so......
