As mlr said its just common sense and is most likely at officers discretion. Eating fries isn't likely to create repercussions I guess but I know I cant hold a burger with one hand bro, just sayin.

My advice is frank, grow up. They're doing their job. And god knows how u eat a burger of all things and still drive competently. Say she dropped the burger, lost concentration for only a second and hit a pole. Or a pedestrian or another car full of people. There's a.reason they pull people up on this shit and its not all oh I'm a nasty cop...
