Okay guys long story but i'll try make it short.. In April Last year I was involved in a car accident...at the time I believed the other driver was at fault and I lodged a claim..after much tooing and froing between my insurance company (RACV) and his (AAMI)..it was determined that we were both at fault and that we would pay for our own dmages..understanding that it was his word against mine and realising my car really wasnt worth spending a million dollars fighting over I accepted this and went on my merry way...I have since repaired and sold the car with my own cash (doing a dodgey job worked out cheaper than insurance anyways).. Anyways now all of a sudden yesterday over a year after I lodged the claim and over 9 months since the insurance companies made a ruling..I receive a letter saying that the RACV claims officer who handled my case has now been over ruled by management (whatever the f**k that means), and that I am now at fault in the accident and I am to pay my excess of 850 bucks to cover the other guys damages.. Now what the hell is going on here anyone know?? Is it just a case of his insurance company hassling mine and the RACV being to soft and wanting to lose a customer (namely me who has been with them for 5years and now has finance through them with my new car).. or is there a bigger picutre here someone knows about that I dont... Also is this even legal over turnin a ruling 9months down the track? And finally am I even worth fighting it for 850 bucks? Whats your opinion and can anyone who knows who may be in the insurance industry give me a run down of how this works and why the hell we even buy insurance if this shit happens (cause now I feel any ruling can be turned down at any time)... if anyone likes I can provide the details of the accident too if that helps with the overall picture...

ill add this not that it matters in your case a cop tried to get my mate as he came up rather quick (he was speeding) behind an unmarked cop car...as the cop was using his rear view and side mirrors to judge speed his case didnt hold up in court and my mate got off.. i'm alos cgoing to court for a speeding offense soon.. I admittantly was peeding but am certain OI was doing about 25-30km/h less than what the officers got me for...the officers followed me tracking my cars but as I was a fair distance in between us (and it just so happens I have a witness to prove this..and as there were times that officers could not see me as I was on a hilly road...where I was going down over the crest as he approached it my solictior believes I will get off or at least a reduced speed..which in the case as I can admit to speeding Ill happily cop on the chin...

well guys picked her up yesterday after some stuuffina round..but I love it..few lil niggly problems I have to get fixed (but thats the beauty of your brother being a ford mechanic)....she goes hard and handles pretty good..haven't given it a real test yet but without the traction control on she sure likes to spin the wheels..1st 2nd and 3rd on dry road..I was quite impressed.. im comparisson to the r33 I think this has power through the entire range where as I noticed my 33 had a lot of grunt off the line but tended to die at the top end...not sure if ANYONE CAN BACK ME UP WITH THAT COMMENT BUT JUST FROM AN INTIAL OBSERVATION... oops sorry hit caps and couldnt be shagged deleting and re-writing

remember seeing this down at freddy's getting all the interior done.. I remember he was so stressed about making sure it was ready for autosalon..I said to him then when it looked a bit of a mess this car will look mean..and at autosalon it definately did that!!! I love the work put into it and the designs...great stuff..and congrats on the spread in the Herald!

okay jesse ill give ya bell in the arvo..had to put off picking her up for another day cos the shit car yard didnt fix one of the small things I wanted done beofre taking delivery of the car..so shattered...

Well I've ahd to wait another day for her..which was disappointing but as long as everything goes well.. it'll be in ym hands sometime this arvo..then ill take her for a spin up th dandeongs..weather permitting.. if its too damp I don't wanna tempt fate since I don't know the car that well just yet..but i'll update you all as to how she goes.. for now Im gonna keep it stock..but eventually a stage 3 kit from CAPA looks liek the way to go... Okay guys brought her today p;ick her up tomoz.. its a 2004 model xr6 turbo.. black in colour.. 5 speed manual It's lowered, sits on 19" g-max rims and has an aftermarket exhuast. 104xxx km's on the clock and I paik 22k for it.

curious does it do it all the time or only when the washer bottle is full???

I find this whole thing about cars being confiscated very stupid.. I was caught allegedly doing 132km/h in a 70 zone (please note I have written allegedly as this was not my speed and the matter will be taken up in court) anyhow as I was pulled over doing over 60km/h over the posted limited I presumed my cars would be towed..other than a dressing down from the officer all I have received is a court summons in the mail...i have read lately people having their cars confiscated for 40km/h i mean i'd at least like the cps to show some consitency.... anyho for those interested background into my offense was my step mother was in a car accident I was rushing to the accident scene doing approx 100 in a 70 zone..still over the posted limit and something which Im happy to admit was stupid..the police officer was on the other side of the road saw me sppeding did a u turn and followed me ( i didnt notice) he only followed me for less than a kilometer (approx 8-900mt) but thinks this was sufficient time for him to determine my speed as 132km/h.. so been to court once.. i was happy to settle the had charged me with excessive spped and dangerous driving...they were happy to drop the dangerous driving but still wanted me to lose my license for 12months..i iwasn't so impressed with this so told them i'd actually see them in court (court date set for later this year) along with a surprise witness I have that the officer didnt know about (mate of mine happened to be travelling on the same stretch of road and saw me go past), i know hope to prove that I was doing approx 100km/h take my one months and fine on the chin..and prove that the police officer was not doing his job correctly for two reasons...1. for not following me long enough to determine speed.. and 2. Not confiscating my car after alleging that I had been doing such a speed anyhow just my two cents on how bullshit these hoon laws are..and how disgraceful some officers are at doing their jobs....and to think I was half way through the application process to become one before all this happened...

yeah def go court..and honestly I wouldnt bother too much with the p plates mainly go for the ofailing to obeying signals...

ahh but who's to say they didnt do the job and someone stole them off the back of the truck and you never checked..i remember the first thing I got taught back when I was laerning to drive was to do a quick 5second walk around inspection of your vehicle..if and I'm only suggeting if..cause i don't know the circumstances, bit if you did this you may have noticed the plate missing beofre hand.. from experience I can tell you magnetic plates are shit..they get stolen, they slide off in wet whether, and depending on where they are postioned they can slide or fall off..but once again it is your responsibility as a driver to ensure this doesnt occur.. i was lucky a few times back on p plates where some had stolen my magnetic p plates and I was pulled over..i soon learnt my lesson and went out and brought once of those vinyl sticker things... but yeah honestly cop the p plates on the chin..i mean if they can charge you for having your plates up but obscured behind what the call dark tinitng (which was legal darkness...), which is what they did to me you've basically got buckley's chance of fighting the p plates..

again on the red light after talking to a few truckie mates you maybe be able to fight this in court by using the officers experience against him.. i.e does he have a trucking license, has he had any experience driving trucks..if not then how can he tell that you could have safely stopped..if he does not have any experience in the field then maybe just maybe the judge will understand where you are comign from and let you off... you also must remember too that no matter posted speed limits you must always travel at a speed that is applicable to your vehicle therefore the police prosecutor may suggest it was your negligence for not travelling at a slower speed, that would allow you to stop the vehicle incase of an amber light, accident ahead etc etc... just trying to offer some advice so pelase don't take any offense...
