Thats fine Pete. You'll notice the wiki refers to the guidelines of criminal law, which existed before Mike Rann was ever in government. It is a general guideline for all Magistrates. The home invasion law is a subset of these which seeks define a very narrow qualifying category (as you rightly pointed out), however that does not change the fact that such things are weighed up by a magistrate and they almost unerringly favor the defendant (when the defendant is the home owner, defender, ie not the assailant - defendant being a relative term from case to case) -D

Illegal searches are the bane of any law enforcement agency, because it means tonnes of paperwork, depositions, court dates and hearings, and this costs them a LOT. I only quote that fact to reinforce the fact that the home is protected by an entire subset of laws. -D

a) being on someone elses property is a caveat in itself b) a flathead screwdriver, conveniently placed in a cars garage, makes a very good shiv. and theres no way in hell you can prove 'murder' when someone unknown to you comes to your own house, with intent to steal. manslaughter, sure. murder no. c) reasonable force depends on one thing - the amount of fear you have for your own life - which nobody can argue otherwise. I suggest you both look at the wording of the law on this matter. Its pretty biased towards the home owner. Remember, this came about after a man killed a kid who broke into his place and faced a manslaughter conviction. The public outrage alone is what forced rann to implement those home invasion laws. d) if eugene mcgee can get off with a good lawyer, after running a bloke down, and then lying to the crown, then anyone who kills a man on his own land in defence of his own property, will most certainly get off. on this case, public opinion will be on the side of the defendant. e) a good lawyer is worth more than words alone. i could point to many other cases than mcgee. I find it very ironic that some of the very people who say that justice is never served, or that the system is completely biased towards repeat offenders, are now saying that a custodial sentence is inevitable in these circumstances. It is not. Defence of ones property is the same as defence of ones own person, and this isnt my opinion, it just happens to be written down in black and white. You guys better make your mind up whether or not the justice system works or not. If you think it works, quit bitching when someone gets off. The circumstances of each and every case are complex and that is why we have informed magistrates and judges to keep society working, and with the exception of a few fringe cases, the judicial system works perfectly. And that, my friends, is why lawyers exist.

Aye I know this, but if someones in my yard and they DONT run then the law be damned. Like you said a few weeks ago, nobody goes to jail in this state. Public opinion on this sort of matter is enough to sway any jury. -D

Selling some random crap - All Items are used/2nd/3rd hand 4x Tein Super Streets to suit R32 GTR/GTS-T, S13 - Purchased off weezy, top notch condition, $500, regency friendly as they are aus spec and legal ride height. Very bumpy but teins are renowned for being stiffly sprung (sorry, i dont know the spring ratios) Reason for sale? Switching to softer sprung bilsteins. 4x Worn toyo t1r's.... make me an offer, theres about 5% tread left, its uneven however. Fits stock gtr rim (16" rim, 225 tyre) 1x Hicas Computer, R32 series - good for all R32's if you need to make ur car regency friendly, $50 neg 6x stock gtr injectors, a couple are leaking and I dont know which ones, $50neg (stockers are 444cc low impedance) 2x Type M Airpods (Wet style, not sure what brand, possibly apexi?) $100 for the pair 1x Marshall JMP1 Preamp - Valve preamp for guitars and other passive/mic'ed instruments. $1100. Reason for sale - upgraded to Fender. 1x Set of Red LED's for R32's (from 666Dan on these forums). Full conversion for dash, centre gauge cluster and aircon - used by me for about a month before I changed my mind and got blue ones.... $20 -D

Heard via a third party that theres a couple of shit eating scumbags around my area who are fixing to steal my car (and other gtrs most likely). Turns out they've followed me a few times to see where the car goes, but their loose lips means that the wrong person found out and let me know. I won't go into specific details about who or how I found this out, but Adelaide is a small place and I know a lot of folks.... be extra secure with your cars, especially around places you frequently park (home, work, etc)... To the aforementioned drug infested thieves (in the slight case they check the forums out).... you even touch my car, and I will kill you. Don't take it as a threat, because I don't make threats. I simply state the facts. If you're prepared to get shivved, by all means, come on over. It'll be a short battle, and even if I don't get to you, someone else will. -D

nah its anytime you change the manufacturers specification they dont like it thats why aftermarket ecu's and boost controllers are also illegal, nothing to do with emissions - they simply want you to leave the car the way the manufacturer intended it as they dont trust aftermarket mods from a safety point of view - which of course we know is nonsense but thats the govt for ya really... -D

had a bit of a squirt at 1am... saw a very very nice r33 (dark blue or purple I couldnt make out) travelling alongside me on hampstead road... it turned off onto grand junction road and I kept going along bridge road.... thing sounded tough, esp when he gave it a bit -D

I doubt hed give a refund, but as a gesture of good will it would be acceptable for the tuner to finally fit a nistune board (if it hasnt already been done at bw) Otherwise then I suppose a refund of $240 for a board that was never installed would be appropriate -D

Absolutely! Where did you go for this? PM me all the details pls I went direct to pete at PLMS, he installed it and sold me a licence as well as did a quick tune, all for $500 - still needs a proper dynotune but that'll come later. If all they did was burn a chip, I'd be majorly pissed.... esp for that amount of money -D

only gaugeworks thats where i got my vdo's. they rule. i got mechanical gauges and they have the std t10 (or is it t5) globe so i was able to chuck one of dan666's blue led's into them both -D

spotted a nice holden for a change, a senator with what looked like 21" chromies and the plate 'sen8tor' or something like that looks pretty nice and had a mean stance, when the dude passed me his passenger hung out the window and yelled out 'doh maaaaaaaaah' which is probably the most response ive ever had about my plates, so im pretty happy about that heheh -D
