Planing to appeal the suspension

Have just seen this.

I had the exact same issue a couple of years ago. Same place, exact same speed.

I paid the fine as advised by solicitor and then went to court to appeal the suspension. I was successful although I had a perfect driving record up to that point.

Advice is to get help from a solicitor familiar with traffic issues.

I have paid the $800 fine and copped the 5 demerit points. But on top of that since it was 30km over I will have my license suspended for 3 months.

Should I challenge this in court or just cop it? By that I mean challenge the suspension not the fine.

Some extra history : I cannot request section 10 as I have 2 previous speeding tickets one 3 years ago the other 2 years ago both very small tickets I think one was 5km and one was 7 km over

As stated elsewhere. S10 is not applicable. You have already paid the fine. Appeals are a different animal and are generally not given for speeds. Only P platers have a right of appeal in relation to demerit points. Everyone else has a tough fight on their hands.

You are quite right that police aren't supposed to use radar on a downhill slope, but you would be surprised how often they do it anyway.

Not true. That used to be the case several years ago. Not any more. Even when it was a guideline there were clear instructions that it could be done in a variety of circumstances.

If you have paid the fine (effectively admitting fault), you may have eliminated any avenue of appeal regarding your license suspension.

That pretty much sums it up. Once you pay it and take the infringement it's almost impossible to contest.

there are 2 things that can be appealed / contested 1 the infringement itself and 2 the license suspension i accepted the infringement as at fault but plan to appeal the suspension.

You can appeal to the Local Court against a suspension if you are suspended in one of these ways:

  • you are a learner or provisional license holder and you get too many demerit points.
  • for speeding in excess of 30 km/hr over the speed limit
  • for speeding in excess of 45 km/hr over the speed limit
  • on the spot by a police officer.

    so fingers crossed the judge will see that the punishment does not fit the crime as i was not just speeding in a residential road at high range speeds but rather didn't slow down fast enough coming of from the freeway where that speed is normal . more so when the off ramp is long, has no residential or pedestrian access and i need the license for work

    Lucky day is the 13th in a week from now so i guess il see what happens
    il have character references as well as a letter from employer stating the need for my license for work

i accepted the mistake and payd the fine and took the demerit points

even tho i think its unfair i have accepted my mistake and the repercussions
im only asking for leniency on the suspension as i need the license for work and considering i wassant doing 100 on a 60km residential road but rather coming off the motorway where the speed is 100 im hoping the judge will understand i wassant honing or acting like a retard but just made the mistake of not slowing down prior to the speed change

You can apply for a work licence, and u will be fine. But if u get caught why your on that 1 point workers licence for anything that u could lose demerits on your in worse off trouble! Mate ride the good old pushy nothing wrong looking like a dickhead why every body drives past staring.u could get fit mate

Not everyone can ride a pushy to work matey, my daily round trip is 150km; some of us do even more.

If I lost my license; I would effectively lose my job.

I cannot get to work on time using public transport; even on the earliest train, I'd still be 40 mins late.

No point driving like a wanker all the time, if we are such enthusiasts wouldn't that mean we don't wanna flog our cars? in case they break loving a car is not thrashing a car it is waxing the paint and polishing the rims:)

Not sure where you live but in Sydney a pushy will get you to work faster than a car, 90% of the time. Car's don't drive past cyclists staring, they get passed while staring.

    • What does it look like with highway driving? And yes, I had a similar thought as Duncan. It looks quite similar in my Stagea and I have made myself accept it as normal. Might have to look into it some day  
    • While I was waiting for the new parts to come in for the charge pipe and radiator I decided to do some turbo modification. The drive pressure (exhaust backpressure) was a lot higher that I thought it should be. For 32lbs of boost drive was 55lbs. The turbine housing is a 1.10AR and my turbo builder has suggested to go to a 1.25AR. To test if a larger AR would do anything to reduce drive pressure AND not spend any money I decided to hog out the divider in my current housing. I removed it from the inlet and the whole way through the housing.  After reassembly and testing it doesn't look like this modification did anything for reducing drive pressure or requiring more fuel (making more power). Oh well, it was worth a shot. We'll get some data at the track if it makes it past the 60ft. I also machined a $7 shift knob off Amazon to fit my Stillway shifter since I didn't like the Stillway shift knob. Next on the list was the radiator replacement and fabrication of a new intercooler tube that had no silicon coupler. No pictures of this - I was short on time each night after work to get this done and didn't stop to take pictures.  Next was to get the clutch disks out and replaced. Previously when installing the dogbox I had ordered a set of the same sintered iron disks I had been running because I switched to the 26-spline input shaft. I thought it was odd that they didn't have any markings or brand name on them like all my old disks had but installed them anyway. At the track I could not get the clutch to lock up using my normal strategies. After two track nights I reached out to the clutch manufacturer and ask their thoughts. They said they had to switch the material out because they were having trouble getting the original material and that this new material would not take to being slipped very well.  So out with the first set of 26-spline disks and in with the correct material 26-spline disks. While I had the trans out I added an inspection/service hole. I've wanted one of these for a while. Now I can have a look at things and change the front cover shimming when needed (clutch wear). I hustled and got the clutch change done in a few hours on a Saturday. Hopped in the car and drove home. On the way home I did a 1-3 pull. When shifting from 2nd to 3rd the core plug in the back of the cylinder head popped out and dumped all the coolant. Thankfully I was only 30 seconds from home and coasted it there. Datalog showed nothing unusual and 2.5psi of coolant pressure. That plug has been in there since 1992 but I guess it worked its way out. Pulled the trans AGAIN and replaced the plug, JB welded it in, and made a brace. Also deleted the head drain I had added in during the bearing issue fiasco.  I am currently changing my boost control plumbing to make it cleaner. After that is done I'll make another attempt at getting past the 60.

    • 140-150 across the board. At this point hoping the grounding harness fixes it. My grounds are all tied to the chassis and none to the battery. For SR and KA that’s never been a problem for me but had a few other guys here and Reddit who told me RB really like a very solid ground setup tied to the battery so going to try that next, I’m stumped if that doesn’t do it. Never had a car have spark and fuel and not fire off before. Only thing I can think is the spark is intermittent/weak because of grounds nothing else really makes sense at this point 
    • I am having close to the same issue. Can you help me with what wire you grounded to get your pump to trigger?
