  1. Don't try it. The case only applies to certain suspensions and the loophole was closed late last month when it came under the spotlight.
  2. Untrue. It is not a rule or inadmissable. Speed enforcement can be done on a hill if the speeds are excessive.
  3. If stopped for a traffic offence you only have to supply your name and place of abode and produce a licence. If you are involved in an accident, you have to supply your name, place of abode and a version of events. You can be stopped at any time on a road or road related are for a breath test. If you are stopped for a breath test you must submit to the test. Likewise if you are taken to a hospital for a drug test you must supply a sample of blood and urine at the direction of a doctor or nurse. If you are the owner of a vehicle and police place a form of demand on you for the name and address of the driver in relation to an offence you must supply that name and address unless it is unreasonable to do so. Police can close any road. The can direct and driver to move or stop etc. Police can direct you off a road or any area if you are obstructing traffic, intimidating people or in an area known for drug supply. Police have the power to enter into a vehicle to inspect it for defects. Theyhave the power to direct you to a inspection station or EPA. You do not have to be shown a speed measurement instrument. If you wish you can attend a station at a later date an view in car video footage. What else is there?
  4. Your points are reciprocal between the states, although your traffic record in NSW will not show your offences in WA. If you are detected for an offence in NSW on your WA licence you will lose points.

  12. I stand corrected. Seatbelts, brake and steering carry points (3 each) and undue noise under the Protection of the Environment Act carries points as well.
  13. Most of the time they want to to stay in the car because it is the safest place for you and them. Put yourself in their shoes. You get out of the car and get struck by another vehicle and they are then to blame for allowing you to get into harms way. Consider that they do not know you from a bar of soap and all things considered you could be the nicest person in the owrld or an axe murderer. They have to also weigh up the options for their safety. It is nothing to do with them feeling like they have the power. They have reasons for doing the things they do. They would rather be in a position that benefits them if things go belly up and you pull a knife or a gun on them or try to run.

  15. Whe he said radar gun, I assumed he means the "radar gun" that people refer to that they see police holding. As you said.....Lidar gun. (You also did not refer to the radar in the car as a "gun")
  16. HWP cars dont have moving cameras not do they have "radar" guns. They only have in car video. There is absolutely not way they will photograph you as you drive past them. You might get videoed but that is it. THEY STILL HAVE TO SPEAK TO THE DRIVER UNLESS IT IS A CAMERA DETECTED OFFENCE (Speed/redlght/toll/buslane). ("radar" guns are in fact Lidars - lasers) And no. If he can relate the call to his duties then he can call you. Yeap (IF) he was racing you, that is wrong and it is only your perception of the event. His would be different. No. There is no rule that says anything like that nor will there ever be. What government or road safety committee would condone cars accelerating flat out to reach the speed limit.

  18. A HWP car does not have a "moving camera". They are fitted with radar. The stationary speed camera are fitted into station wagons. The HWP cars have radars and do NOT take pictures. They have in car video only. The officer still has to speak to you. he does not have to do it straigh away. he can come and see you later, but he still must speak to sthe owner or driver about it As I said. if he looks up you details in relation to his duties, it does not matter whether he is working or not. Your example is one which is not a legal reason to look up details. And yes. You are right.......indecent acceleration is not an offence...........
  19. They just take the time to find you. They have 6 months to get you for the offence. No...still. Negligent driving, maybe, but ther is no offence in relation to acceleration. YOu can still be detected if they are off duty. It makes no difference at all. He commits no offence by looking up your details if it is related to the matter he is investigating. .Yes. If they have video evidence they can fine you. The ycan also fine you without it. it is not neseccary to have it. POlice dont have "moving speed cameras". They have stationary speed cameras or mobile radar. The camera will take your pic and you get the fine in the mail as the car owner (This is called an owner onus offence). The radar will check you speed and the officer must still stop you or speak to you at some time(operator onus offence)
  20. NO ....and no. No such ticket as "excessive acceleration, and unless you are detected by a camera then the officer must stop you or speak to you about the offence. No..........photgraphic or video evidence is not needed. He merely has to observe the offence and speak to the driver. You first comment were correct about the officer having to identify the driver.

    BallSx. Don't worry. I don't think you are beating up on me. If I enter into a debate I don't mind a good rebuttal. . They can turn Audio on and off, but cannot edit the actual ICV due to its security features. (Wait for the conspiracy theorists to jump in and start staying that the coppers would go to all the trouble to alter the video so the copper can convict them on a pissy ticket.) Padey. I dont know what to say. If you want to have a go with "legal interpretation" then who am I to stand in your way. Go for it and lets us know how you went with it when you try it. You right of entry theory mught hold water if we are talking about entering onto private property, but that is covered both in common law and statute law and yes, you are right, it is not black and white, but a car is a different matter. It is defined under the appropriate legislation and people are authorised to enter into it at any time by legislation Legal interpretation had nothing to do with the Bentley case as he pladed guilty with an excuse and was given a S10 dismissal by the magistrate. How is that legal interpretation when the offence is proven and the magistrate is merely excercising his right under the Crimes (Sentencing Procedures) Act 1999. Now back to not opening the bonnet. I dont think your pieces of papers on the wall make no difference to the fact that Police are authorised officers under the Road Transport (Veh registration ) Act and they can inspect a car.

    Wow, it's like bashing my head against a wall in here tonight. I never said they arent laws. They are , and have been in place since Cronulla. It is in fact and amendment to the Law Enforcement (Police and Responsibities ) Act which was created in 2002. As I said, they are only enacted when a senior officer declares and area as an authorised area under the act and is only in place for a certain period of time.
