  1. As Fatz said, the signs are a courtesy and not a legal requirement. They are not a gazetted traffic sign in the road rules 2008 (However the speed limit symbol on the sign is). There is no excemption from a speeding offence in the Road Transport (Safety and Traffic Management) Act 1999 if signs arent present. The only sign legally required to enforce a speed limit apart from the default 50km/h limit (Which requires no signage at all) Is a speed restriction or derestriction sign.
  2. Maybe we should kiss and make up. I thought this was a NSW thread and thats why I said it. Exactly. Police cars are leased and not bought. No fleet manager would want the risk of cars that do not have warranty I see threads over and over on these forums about people being caught by unmarked car. There is a lot of talk of "Sneaky, "corrupt", "entrapment" and the like. Imagine if they were caught in this manner. Yes Decim8 you're wrong. Can you imagine what would happen to a confiscated vehicle if it was used for a few months and then returned to the owner. The owner would not want it back.   3. Dont worry. It has been suggested. Until some clown decided it would be smart for drive through the fake police car cutout as a joke. It was then considered too dangerous in case they tried it on a real car by accident.

Every defect can bedealt with individually This is directly quoted from the RTA Wheels up to 26mm wider than the largest optional wheel recommended by the vehicle manufacturer for the vehicle can be fitted without the need to notify the RTA. The outside diameter of the wheel and tyre combination must be no more than 15mm over the largest diameter wheel and tyre combination specified for the vehicle and not more than 15mm below the smallest diameter wheel and tyre combination specified for the vehicle.

  6. I will be the first to say I am not always right. I have never seen nor heard of any of these car being used for traffic or any kind of enforcement duties. All I ask for is a pic of these supposed NSW Skylines, supras, evos etc. There are a lot of these "sightings" but not much pics. A bit Loch Nessish.
  7. Sorry but that is a Victorian TMU car. If it makes you feel better, I am a smart arse to everyone. There is only the one EVO X that is being fitted out now. There are no others and never been any evo's in NSW. Apart from the 3 HWP WRX's that ceased service in 2001, there has only ever been a blue one attached to Wetherill Park. There have never been supras, skylines, silvias or anything. never ever ever.........full stop
  8. Two points to make. If you think it will stop the defect, it wont. You will merely be directed to an inspection station. You commit an offence by obstructing the officer. The lawyer risks being removed from practice if it became common knowledge that he knowingly assisted in the commission of an offence. Not a real smart lawyer.

The use of an "agent provoceteur" in NSW can only be used in sentencing guidelines and does not affect the prosecution unbless the prosecution is gained through an illegal act (it mainly relates to drug convictions and is irrelevent to traffic matters and they are generally strict liabilty offences). Wearing P plates in nsw is not illegal for a full licence holder

  11. No, that is one of the better scenarios. Worst case scenario is that the penalty that can be issued by a court is subtantially higher than that issued by police on the roadside. Annoy the magistrate with a trivial court appearance and it can turn sour. Roll the dice.

  15. I call shenanigans. There is no excemtion for people moving to NSW to retain their interstate licence. The only excemptions are people who are not permanent residents of Australia, Military personnel etc. You are here for more than 3 months and you need a NSW licence as well as NSW registration. See ROAD TRANSPORT (DRIVER LICENSING) REGULATION 2008 - REG 99 FMIC advice is also rubbish. You can have a FMIC if it complies to standards such as an IM240 emissions test and the structural integrity of the vehicle is not altered (eg engineeers report) Pod or any exposedd filters are also subject to emission testing. You would apply for an excemption in NSW and be excempted as you owned the car interstate before the commencement of their HP vehicle scheme.
  16. Lets see how all this would pan out. As for the securing of the bonnet so they can't look. This would earn you a red label and a tow truck ride home for a dangerous defect. So far as refusing to let them look they have the power under to act to enter into any vehicle to inspect it for defects. You would get locked up for hindering a police officer then the defect would not seem so bad.
  17. That may be the case in a civil court. Contributory negligence plays little part in a criminal court and the driver who backed into the parked car would be found at fault.

  19. RTA will make the relevent inquiries, see you owned it previously, sniff out your scam and reject the application. If they dont notice that then they will only issue the excemption for woking hours if it is a work related need that you are making the application for.
  20. In NSW there are two differing types of traffic infringement. One is called owner onus and the other is called driver onus. Owner onus offences are camera related/parking offences where police do not have to identify a driver as the infringement notice is sent directly to theowner and the responsibility lies on them to identify the driver. Every other offence is a driver onus offence. Polie must establish several proofs of the offence and one is "driver. They must identify a driver either by speaking to them directly at the time, or after the offence. They may also identify a driver by causing th owner to identify the driver. Stop sign offences are a driver onus offence and rely on the police being able to prove who the driver is. If they have not spoken to you or the owner then you may want to take this further.
  21. I would suggest it will have not other consequences apart from this matter being dismissed. The devices are accurate when used in accordance with the guidelines. This sounds like it was not done right in some respects.
  22. From what I see, traffic enforcementtn has never changed, in fact it is more lenient than it used to be. Why would there be a difference in "hoon" and "enthusiast". Does it make a difference if you are caught with an illegal mod, speeding or anything for that matter. I think not. Everyone gets stopped. Some more than others. The reasons for that are wide and varied.
  23. I dont recall that. To clarify, there are "owner onus offences" and "driver onus offences" Owner onus offences are those detected by camera and they dont have to stop you. It is up to the owner to prove who was driving. Driver onus offences are all the others. You can commit an offence, which may be witnessed by police or a member of the public. You dont have to be stopped at the scene to be issued a ticket. Police can, within a period of 6 months, determine who was the driver, speak to them and take action.
