  1. Actually the reason No cars are crushed in NSW is because there is no legislation to "crush" cars. Cars can be forfieted after the second offence and sold (*or if the value of the car is too low, just given away as scrap,) The RTA can apply for the car to use for crash testing or educational puposes. Being an owner, joint owner or not even the owner bears little relevence in a forfieture. If you arent the owner, they merely have to notify you within 14 days that they took the car. You have to apply through the courts to get it back. By joint registering a vehicle you risk losing a car quicker. If any registered owner is served a suspension notice and is detected 2 times in 5 years the car can be taken.
  2. Don't rely on that theory because it just is wrong. There is nothing to stop unmarked police vehicles using premium plates etc. It is done regularly.

  4. There would no doubt be two sides to this story. The RTA has no power to impose points for an offence that has been dismissed (Eg: Police do not reach Pima Facie evidence so they lose). The difference would be that the matter would have been dealt with under Section 10 of the Justices Act, where the matter is proven and dismissed. This is where you are found guilty but the magistrate will not impose a fine. In this case you will still lose the points as you have been convicted. Most people hear the magistrate say somethign like "I find the matter proven and dismissed. No fine will be imposed" or words to that effect and take it that they won. Not so.
  5. This came around due to the courts returning points to people even though fines were imposed. There was a complaint put forward and the power to affect points was revoked from the magistrates. This has been the case now for several years.

  10. The offences of less than 15KM/H are nearly entirely issued by the Speed cameras. Police tend to worry about al lthe others. Now they will be getting you for 10k over the limit rather than close to 20 over.
  11. Or......maybe....just maybe.............you were speeding and jumped the brakes and glanced at the speedo during deceleration when you saw the car but it was too late.........(just maybe................)
  12. I'll say it again. A "Speed gun" will not display 101.5 as a speed. It only displays two things. Speed which is only in increments on single kilometres (98, 99, 100 etc) and range which displays in increments on 1/10th of metres (105.5, 105.6 etc) So you may be looking at the wrong part of the display. The only way the "speed gun" will detect a speed is from a stationary position. So he woudl have detected you as you went past him and then he caught up to you. You speed will only be displayed on the footage if you car detected by radar, whoever it will show you hauling arse past the camera. As for it's range. If he can see you he can shoot you.
  13. You can not apply for, or renew a licence whilst your on a suspension. So that answers one and two. Three. No. You have only met the requirement of the police suspension. If you had served that then your licence would be eligible for renewal. The courts have issued a new date for it to be completed in May 09. You should contact the RTA and inquire as to whether the suspension has been lifted due to the appeal. If this is the case then they may allow you to renew it and allow you to drive for the time up until the appeal is heard.

  15. You only get a copy if you go to court, but you can view it at the station at any time. As for waiting for you, they are police, not mothers or babysitters and you are a grown man. Once again. his "little gun" wont show 105.5 as a speed.
  16. Rather than waste your time and money with a solicitor, just call the police station where the officer is attached and ask if you can go in to view the ICV footage. You will either be getting a Future Service Court Attendance Notice or a Field Court Attendance Notice. Very little choice as you were suspended. As for them leaving you there, You told them you could recharge your phone. They aren't psychic and ca'nt return once they are gone. They have a duty of care to ensure you can get out of there. You advised the you could. Their duty of care is over. (For what it's worth there is no such speed as 105.5.....................) You sound like a wonderful recruit for the police.

  18. Even when they are signposted the RTA will generally have a lead in period where the camera is operational but infringement notices are not issued. This may run for up to 6 weeks and is part of the policy regarding public awareness when installing traffic enforcement cameras.
  19. You are right. There is no option to tick on the defect notice to indicate an emissions test is required. It can be hand written in the "defect report" box and then tick the emissions box. If the test is not passed and the defect cleared then the AIS or AUVIS station may have a few things to explain to the RTA if they are audited. The other option is to just forward the vehicle details to the DECC and they will send a notification to the registered owner.
  20. If the defect is marked that the car needs to complete an IM240 then the car will need to be tested before it is cleared

  22. If the matter is proven and you are dealt with by way of a S10 dismissal. If this is the case you can appeal to the RTA to get your points back. If no prima facie is reached and the matter is dismissed then you retain your points
  23. Hehe. Seen it tried in a few courts. Funnily often referred to as ignorance. Good to watch but ends like every other train smash, Horrifying but you just cant help but look.
