Actually coming from an insurance backround its common sense not to over take this person in a single lane as the Merc driver has a duty of care. MX5 driver is in front, her lane she can do whatever she wants in it..

Well said Daleo, by taking into your version and if the road was single lane you are 100% at fault regardless if no indicators are used. The cop may have gone about it the wrong way but I guess you cant ignore stats. Stats show under 25 year old is 20 times more likely to have an accident.

There is no way that the cops could actually prove this, He should have known that. The cop cant guestimate the speed based on standing there looking at you and obviously isn't mastered in kinematics. Take it to court!

Incorrect. The insurance company has to provide a genuine reason to refuse cover. Most of these problems are caused by people not reading their product disclosure statement and then whinging that they aren't covered. Not the insurers problem it's the customers. The only reason police are called are if the car is being towed or someone is injured. Can you see if you have a copy of the other guys version and diagram and can u post it up with his and your brothers? Either way the liability is quite clear on this one. The third party has pulled off the curb to complete a U turn. The other party is still at fault.

From what you have just described providing that the other party was stationary at the side of the road the other party is 100% at fault. When pulling out from the side of the road the driver has a duty of care. Obviously he hasn't paid attention and just pulled out.

So basically, what you are saying is that you were traveling straight along gibson and the other car has turned right onto gibson from gow street across on coming traffic (ie. you)? If this is the case then he is liable for the accident if he is insured the insurance company can't deny liability unless they have declined the claim for the insured due to underwriting guidelines.
