sky-017 Posted April 22, 2007 Share Posted April 22, 2007 i lost my license approx 4.5 months ago . speeding over 45 k . 143 in a 60 zone . i have close to a month and a half till i get my license back . i was just talking to some one who said the following to me . i had 4 points at the time a friend lost his license 18 months ago for speeding 45 and over . lost it for 6 months , he also said when he got i back , after a month he recieved a letter in the mail saying he will be susspended for a further 3 months . because of the points he had at the time.he had 5 points at the time i also called the RTA up when i lost my license to ask some Q and A's , about 4 months ago . and asked my point situation . they told me when i get my license back i will be on no points for the rest of my green P's . and if i got caught doing anything wrong , i will be of straight away for 3 months . and this will keep proceeding until i get my points back when i get the black license.. is this true = or am i faced with another 3 months? i know this was a year and a half ago , but could this happen to me - can some one shed some light on me with this ? i will be calling the RTA tomorrow , but im anxious to know if anyone has a responce . thanks Link to comment https://www.sau.com.au/forums/topic/165611-can-some-one-with-some-good-knowledge-answer-me-this/ Share on other sites More sharing options...

T04GTR Posted April 22, 2007 Share Posted April 22, 2007 well a similar situation happend to me. i broke a good behavior bond by neg driving. almost 2 years later they finaly got there paperwork corect and didnt double up ofences. but in the time inbetween my suspension they had lost the record of me being on a good behavior. so they wanted me to loose it for 4 months. but they had duplicated the neg driving. so if it wasnt doubled it would be only 3 months. i percisted and they eventually got it rite. so i had to sit out 6 months. but apon getting it back i recieved another letter saying il loose it f 4 months. idiots. but aparntly the points dont acumulate once you have gone past 0. they get taken from your new one. so wel have to see dude. they are idiots and you might get lucky. but i wouldnt hold my breath. besides tits there fault or a technicality taking points away that yuo never had. and the ofence caries a instant loss or licence not points related. so i think you will have an issue. my advise is to go in a nd demant in writing your exact situation. Then receive some other letter saying it's gone again for another 3 months? Why the hell dont they just take it for 9 months then because Red P platers only hold 4 points.. Unless... They do give me my license back before issuing the next suspension and in that time I get my green P's thus, putting my license up to 7 points. So the 5 points that would be carried over minus the 7 from gfeen p's leaves me with 2 points.. Once you reach 0 points does it remain that way if you are on the same license again? E.g If you lost all points on your red P's, (4) then got your license back, would you be at 0 points or 4? Is the only way to get points back: A) Upgrade your license B) wait for the 36 months of demerit points applying to a license to lapse If so.. Then I guess yes, when you and I get our licenses back, We'll be doing another 3 months. Because I'll be on -2 even after getting the +4 points from green p's and you'll be on -1 ... That's f**king stupid.. Especially with all kinds of increased police presence in all areas of Australia and the awareness of what performance vehicles like Skylines can do. Wake up to yourselves and hopefully this long without a licence and the following 3 months ban that you will get will teach you all some respect for the road and the rules that keep us all safe. rukus Posted April 23, 2007 Share Posted April 23, 2007 this is what happened to me. i lost 4pts in 2004 (double demerits) for neg driving. in 2006 (in the space of JUST over a month), i lost 3pts for speeding, then another 3pts for speeding, then 8pts (double demerit) for doing 30 over, then 3pts for speeding. at the 8pt fine, i'm well over the 12 demerit points (18pts). a month after my 8pt fine, i had paid for 2 fines first - 4pts(this was paid ages ago), 3pts, 8pts - total of 15 demerit points then I paid the remaining 2 a couple days later. I then recieved the letter from the RTA saying i had a total of 15 demerit points (even tho by this time ALL fines were paid for). This means they only counted the fines that i paid for first which pushed me over 12 demerits points not the ones that came after. so after 6 months, i got my license back, and i have 6 demerit points. To the person that asked about getting busted 45 over with 1pt remaining on ur license - from my experience, u won't get the extra points added on to ur license when u get it back if it's just one fine.
