Actually there are no holes at all.

Think about it.

If you know how far "X" is, and how long it took to travel "Y"...

Doesn't take a genius to workout how far, as an estimate, you were going.

And as stated - recognised estimators of speed. Clearly indicating there is no requirement for it to be exact, and that "error" allowance is a fair point.

So like i said, you might be able to work down 10-20km/h, however don't even think for a second you'll get 40km/h rubbed out.

I'm sorry but there are so many holes in the "estimate" weather or not they are highly trained or that they can legally do (what ever that means) any half decent lawer would pull it to bits. What a joke, for starters how did the officer take into account speedo over read and compensate for it as well as Visual angels that may or may not have made the car/object appear to be traverling at a different speed then it really is. Think about the plane in the sky!!

To those that "won" did you not or why did you not sue for defermation of character and dis credit the officer and hopefully put a stop such stupid claims in the future?

and estimate is nothing more then a rough guess, psuedo science if you will and it can be and most often is wrong

They have to prove beyond reasonable doubt with clear and convincing evidence. I dont think an estimate is either of them tbh whats it called burdon of prof??? (correct me if im wrong)

saying that though they are there after all to "protect" us and to fairly and equally distribute the law

on another note you could argue that an estimate is not fairly or equally distributing the law.

When we fine someone for speeding when we follow them we are not fining them on estimation. We just travel at same speed as offender and check his speed by our digital display. There is no estimation at all with this. If I sit behind you and stay a constant distance behind (so we are traveling at same speed) and I am driving at 100 then the speed you must be doing is also 100.

We can issue fine on estimation but I would NEVER do it. I don't think it's fair to estimate (guess) someone's speed and fine them for that and I don't know of anyone that would do that.

Can and will stand up in court unfortunately.

As Graeme points out in the post above, he may have had a digital speed checking device in his car, he is under no obligation to show you.

Even if he didn't he can still estimate.

It's interesting to see people talk about Hoon laws in one place, discretionary powers being abused, etc.

We also talk about defects, what is and isn't detectable, and how these overzealous police negatively affect us.

But we accept that the police are trained "estimators of speed" and must accept the estimation they come up with.

Whats to say that a police officer won't simply come up to you and say you were doing 45+ when you were 10 under? It may be the far end of the spectrum, but whats STOPPING them from doing this to us? I could see this getting pulled to bits by a lawyer.

It's going to come to a day where you will have to record your daily activities, driving habits, how you wipe your ass - Because that will be the only way to protect yourself from stupid discretionary laws.

For arguments sake, if an angry judge passing down big penalties, jail times etc, you can appeal it, and since his 'misconduct' is logged and can be used as evidence, you see appeals often go through without a hitch.

But this is different, you could have been going 95 in a 100 zone, have a cop tell you that you were doing 130+, that you are a dickhead, a danger to society, yelling spitting, abuse. You take it to court KNOWING you weren't speeding, but the judge passes the 130+ as good judgement.

So you end up with fines, abuse, possibly car being taken, all because you were acting within the law. I mean comon, f**k me.

Having witnessed someone speeding, and estimated it within confines of the rules and reasonability - How can it not be so?

You seem to not want to accept that which is cleraly before you - It is possible, does happen, and is NOT the same as someone "may" committ - its been observed.

I'm not saying it dose not happen I'm sure certain "powers" are open to abuse

what I'm saying is "they" also have to prove beyound resonable doubt with clear and convincing evidance simple as that

but most people chose not to challenge it as it's almost geared so you lay down if you were, over a barrel.

hay I might "estimate" my tax next year basied on this though what do you think?

good so he has quantefiable evidence then that is discoverable.

    • Can I suggest you try EBC directly again and link them to as many competitor catalogues as you can to show their listing is incorrect, eg https://dba.com.au/product/front-4000-series-hd-brake-rotor-dba42304/ If you have access to an R33 GTST VIN and your VIN, you could also use a Nissan Parts lookup like Amayama to show them the part number is different between 33 GTST and 34 GTT which may get their attention
    • So i got reply from EBC and they just this site where you can clearly see those 296mm fronts on R34 GTT. I send them photos and "quotes" that 296mm are not for 34 GTT and they are too small.     • From there, it is really just test and assemble. Plug the adapter cables from the unit into the back of the screen, then the other side to the car harness. Don't forget all the other plugs too! Run the cables behind the unit and screw it back into place (4 screws) and you should now have 3 cables to run from the top screen to the android unit. I ran them along the DS of the other AV units in the gap between their backets and the console, and used some corrugated tubing on the sharp edges of the bracket so the wires were safe. Plug the centre console and lower screen in temporarily and turn the car to ACC, the AV should fire up as normal. Hold the back button for 3 sec and Android should appear on the top screen. You need to set the input to Aux for audio (more on that later). I put the unit under the AC duct in the centre console, with the wifi antenna on top of the AC duct near the shifter, the bluetooth antenna on the AC duct under the centre console The GPS unit on top of the DS to AC duct; they all seem to work OK there are are out of the way. Neat cable routing is a pain. For the drive recorder I mounted it near the rear view mirror and run the cable in the headlining, across the a pillar and then down the inside of the a pillar seal to the DS lower dash. From there it goes across and to one USB input for the unit. The second USB input is attached to the ECUtec OBD dongle and the 3rd goes to the USB bulkhead connected I added in the centre console. This is how the centre console looks "tidied" up Note I didn't install the provided speaker, didn't use the 2.5mm IPod in line or the piggyback loom for the Ipod or change any DIP switches; they seem to only be required if you need to use the Ipod input rather than the AUX input. That's it, install done, I'll follow up with a separate post on how the unit works, but in summary it retains all factory functions and inputs (so I still use my phone to the car for calls), reverse still works like factory etc.
    • Place the new daughterboard in the case and mount it using the 3 small black rivets provided, and reconnect the 3 factory ribbon cables to the new board Then, use the 3 piggyback cables from the daughterboard into the factory board on top (there are stand offs in the case to keep them apart. and remember to reconnect the antenna and rear cover fan wires. 1 screw to hold the motherboard in place. Before closing the case, make a hole in the sticker covering a hole in the case and run the cable for the android unit into the plug there. The video forgot this step, so did I, so will you probably. Then redo the 4 screws on back, 2 each top and bottom, 3 each side and put the 2 brackets back on.....all ready to go and not that tricky really.
