Not on this side of Australia... our public holiday was last week!

Def get your insurance on to it, you shouldn't have to pay any excess due to having the police report and the little shits being caught!

That's what I am hoping, I really dont want to have to pay excess, or have a higher premium next year:/

I'm with Lumley's Insurance, they are closed today for the public holiday east, so I'll have to wait until tomorrow to talk to them.

So, unfortunately it boils down to I have to pay for the damages. I've spoken with insurance, they said I could file a claim, pay the excess, have the car fixed and try to be reimbursed the excess from the family. But the outcome would be lengthly and probably wouldn't happen. Ive had body shop quotes all around the $2000 mark. Screw that, I don't want to loose my no claim bonus, and my premium go up.

I've talked with Mario from the ding king, he's fixing the dents for $100, and andrew at smart finish is going to touch it up for $80. It probally won't be perfect, but at least it will look better than it does.

I hope karma pays a visit to the little shits who did this.

Before you pay a cent, have a chat to someone at Clayton Utz's Torts division. How is it fair that you earn a wage, pay anywhere from 30%-50% in tax, save what you have left and purchase something that you adore just to have it destroyed by someone who's living off your tax dollars? You are in essence paying the coppers' wages to stand there and do f**k all. You are paying for the father's accommodation. You are paying for mummy's goon habit. You should get something back shouldn't you?

Clayton Utz has one of the best Torts divisions nationwide. I'd have a brief chat with someone there and ask if it's worth pursuing.

Sorry to hear about all that has happened however I wouldn't let it slide so easily. There are avenues that you can search. Pretty sure that my initial paragraph should boil your blood just enough to look at some other options. All the best!!

Thank you for the information, trust me I'm still very upset about it, and pissed that the law will allow them to get away with it. Bring back Capitol punishment!

You make a very good point of our tax money is being used to benefit those people. I wish vandalism to personal property could be claimed back on taxes!

As much as I'd love to peruse legal action, the last thing I want is a bunch of agro "Canadians" turning up at my house to trash it, or hurt my family.

I'm confused; you are insured, and the guilty parties have been identified.

That's it. You only pay your excess if you are at fault, or if the other party cannot be identified; not if your insurer is too lazy to do their farking job.

Your insurer can chase them for the money; if they don't like paying claims, they should get out of insurance and go pick apples or open a KFC.

It's not up to you to chase the guilty party for money, that's the job of, wait for it; THE INSURANCE COMPANY!

That's the service you PAY for when you insure your car; they certainly don't provide it free of charge.

Tell them to get off their collective arses and serve you; THE CUSTOMER!

If they won't help, politely ask them the best way to get in touch with the Insurance Industry Ombudsman; and ask them which individual you should refer the Ombudsman to; when it comes time for them to explain the situation.

I have a funny feeling they might be a bit more forthcoming if you are a bit more determined.

Don't listen to their BS runaround; they hope you'll give up and then they get to keep your premium and do nothing.

I'm with Lumley's insurance. When I spoke with them on Tuesday, I was told I would have to pay the excess and then they would try to get the funds from the family responsible and I would be reimbursed. They said this process is usually very lengthy and most of the time ineffective:( When I questioned her as to why I had to pay the excess considering I had a police report and the kids were arrested. She said that was their procedure:/

Ask them for PDS re:their policy. Dale has a very strong point. They may be trying to strong you along as they know that they won't see a cent from the guilty party. That is however, their problem. Any issues take it to the ombudsman. :)

Couldn't agree with you more!

A long story, but it will give you an idea of what they are like. Read if you dare.

Bear in mind the employees you speak to are following a clear set of rules; that are designed to make you give up and GO AWAY. No is always their first answer in difficult situations.

They do not make these rules, but are forced to apply them. They also use assumed names, but have a code that can be used as a reference. Ask for their code when dealing with them.

Send everything by Email. Read on to see why.

My Missus was involved in a nasty accident a couple of years ago; she was T-boned by an elderly who ran a red light. Massive damage, and she spent time in hospital.

We had 4 witnesses prepared to make statements to our insurer, and the elderly gent was charged at the scene, and initially admitted being at fault. He later made a contradictory statement to his insurer that my Missus had pulled in front of him when he had a GREEN light.

I dealt with our insurer for the entire time the car was being repaired (16 weeks) and they did everything to delay/avoid, and generally give us the run around.

They decided that My Missus was at fault. They refused to contact the witnesses to corroborate my Missus story, and then started telling us that "Traffic signals aren't legally binding" and that we would have to pay our excess.

Then when we told them the other driver had been charged at the scene they tried "The Police version is not what we take into account when attributing blame".

WTF???

So traffic lights don't have to be obeyed, and the Police don't have any say... Right.

Every time I rang to clarify, or chase up the case; the last person I had dealt with was "On Leave" or any number of different bullshit excuses. I would then have to spend half an hour explaining the ENTIRE case to a new person, at which time they would then request the documents again; which would go missing; again...

Every time I faxed documents (the only way they would accept documents) they "weren't there" or "hadn't come through".

They refused to pay for the Police report because it "Might not contain the information we desire" even though it clearly stated that the other driver was at fault and had been charged with negligent driving at the scene.

Then they made the mistake of sending me an Email.

I then scanned EVERY document, plus witness statements that I had collected on their behalf, and every name of every person I had dealt with in the elapsed time (which was now 10 weeks; still with no result) into a file.

I then rang for what seemed like the four millionth time and got more run around when I had to deal with YET ANOTHER new person. When they started their spiel, I asked for their personal Email address and sent the ENTIRE file to them. If I was transferred; I would do the same.

Now I had a proven way to establish that they had all the relevant documents in their possession. They transferred me and it started again; sent file again.

This went on, once a day, every business day for another 4 weeks. (We are now at 14 weeks and they still can't decide who is at fault).

I was finally handballed to a "supervisor" by a guy who couldn't rattle me even after swearing at me, in an attempt to engage me in an argument; so that he could terminate a 2 hour phonecall.

I told this guy that I would ring on the hour, every hour if the issue wasn't resolved at the end of one week.

He then rang and abused/threatened my Missus (who was standing next to me in the kitchen) on our home phone; which has an inbuilt answering machine until she was in tears. I decided to record the conversation, and then played it back to him after I'd taken the phone from my missus.

He SHIT himself.

I told him that I was going to hand over the recording to the Ombudsman.

The next day the issue was resolved, (no excess, and no more arguing) and we received a formal apology from the Regional operations manager of the insurer.

The crux of our situation ended up being that the at fault driver was insured by THE SAME insurer as my Missus; so they were trying to take two bites at the cherry, as they had to pay for BOTH cars.

I haven't named the insurer, but if you'd like to know who it is; feel free to PM.

Do not give up.

This is true; but try to avoid it if possibe, and ensure they agree IN WRITING.

The catch will come when you have the car repaired; you normally have to pay the excess to the repairer, so they have you over a barrel, and they get to hide from you.

Daleo, what an absolute nightmare you and your wife went through! I hope your poor wife didn't suffer any permanent injuries caused by the wreck. Good on you for fighting back and taking assertive actions.

Thanks to everyone for the advise on what to do with my insurance company. I did read over the policy regulations, and it does state "in some circumstances we will waive the excess fee, if the persons responsible are identified" I called the insurance on Friday to quote this, and again explained the situation. I was told in the event of an accident with another car, (not my fault) the excess waiver would be applied. But not for my vandalism case. It's a battle I won't win. And a headache I don't want.

On a bright note, Saturday I took my car to Mario from the ding king, he removed all 3 dents caused by the rocks, and was able to buff out the scratches, all for $100. All I'm left with is the area of chipped paint to get to get touched up. But it already looks 100 times better!

    • So, I started this repair and got as far as "fixing" the holes with some fibreglass. God all those years working on boats came back quickly. I decided I'd reach out to some rust guys just to see what they would say about it. I came across a guy about 40 mins away and went to see him. He said the windscreen needs to come out, that there might be some more bits around the windscreen and he'd quote them at the time. But his quote was $300 to remove and replace windscreen and $3k for the damage he can see. He said he could respray the roof for $1200 and the bonnet for another $800 (somebody has previously rattle canned it, its horrendous). This is $5300 + any small additional bits. It's a lot, I get that and the name of one of my fave youtube channels 'Not Economically Viable' comes to mind.  I'm not being financially rational, but I've taken him up on the quote. He's opening a new shop in November with more room, so we're waiting for that. I'll leave the currently missing headliner out until then. I'm looking forward to it being fixed and having the paint looking nice again (lots of clear coat issues on the roof too). / flame suit on.
    • Oh and some up-and-comings; New rear drivers wheel bearing. I'll do that this weekend while the diff is out. The car is already up and the d/c axles and missing exhaust will help with space. This is the last bearing for me to do and I've been dragging my feet on it. I also have some new EBC blue stuff pads for the car and some new brake fluid. I haven't ever flushed the fluid in this car and looking forward to it. I have 600 degree fluid to put in. Not exactly "race fluid" but better than the typical stuff I have been using.
    • A proper clutch/plate type mechanical diff with quite a lot of pre-load and high locking % is better for drifting. Much more consistent in its behaviour. A helical can be annoyingly vague and inconsistent in how it responds under the sorts of abuse found in drifting.
    • Some updates here. I pulled the entire interior out, minus some trim to respray the seats with Colourlock dye. It turned out really nice though I accidentally let the dog in the car after and she scratched up the front seat.  This is what it looked like before, the colour was just washing out everywhere but thankfully the leather was in good nic. Then after the respray   And after the bloody dog jumped in The headliner is out waiting to be retrimmed, but it will stay out now until Nov - see why below. I replaced the stereo/headunit with a period-styled Android headunit. I have no after pics, but I'll get some. This is because of the missing pixels. I tried to fix this twice with replacement ribbon cables but couldn't. Also the bluetooth interface I'd bought for this was crap. Then there's the rusty roof. Pics and info in this other thread. I have decided to get this repaired professionally, but I'll update that thread. This is why the headliner will stay out for now. I'll be getting the roof and bonnet resprayed at the same time the rust is fixed. I also had an interesting issue with my drivers door lock.  For a small period I was having issues getting any 12v power to the car - I mean *any*. It would have no dash lights, nothing. It happened while I was at the shops and I couldn't get in the car. So, we had 2 problems. The most pressing here is that I was locked out. I have only a single physical key hole on the car, the drivers door and no amount of turning would unlock the car. Surely it doesn't need power for this? The second issue is why am I losing all power periodically, The battery isn't dead, its almost like the battery isn't even there. Two issues that were surprisingly easy to fix. You fellow BMW over-engineering lovers will appreciate this. The lock in the door has 5 states; mechanical lock, electric lock, neutral, electric unlock, mechanical unlock achieved at -90 degrees, -45 degrees, 0 degrees, 45 degrees and 90 degrees. Although, the unlock is towards the front of the car, so opposite for LHD countries. Sticking the key in and turning 45 left or right is what is used 99% of the time. It activates the central locking etc. 90 degrees is for dead battery access and, obvs, only un/locks the one door. But because the mechanical lock is never used and is 27 years old, it seizes up. I was totally unable to turn the key far enough to get to the mechanical unlock (At the time of locking myself out, I didn't even know this was a thing). I eventually did it with some vicegrips and teflon spray.  I made a quick vid for other E39 peeps.   The battery issue is totally new to me also - It wasn't making sufficient contact between the post and the terminal. The terminal was bolted on tight, but the car wouldn't have power. After checking the battery with my multimeter I accidentally contacted the terminal and the battery post and the car got power. The battery was only a few years old and in good condition. I cleaned the post and the terminal with a wire brush, bolted it back on tight and never had the issue again. I'm still surprised that despite having solid contact it didn't work. Also, the car was getting Warragamba sized pools of water in the back when it rained. My initial concern was another rust problem. But when I went out on Weds while it was raining and while I had no headliner in I could see a steady stream of water coming through the roof mounted aerial. As this aerial is for the (now removed) car phone I pulled it out and whacked a blanking grommet in the hole. It seems fine now. I'm thinking I might get the hole permanently filled when the rust is fixed. Moving forward and things in progress; The tailgate needs some attention. I have taken all the trim off to clean it all and address some small rust spots. I have partially done all of this but I'll finish it up hopefully this weekend. As all the trim are now entirely devoid of trim clips I have bought a heap of strong velcro and I'm hoping it does a good enough job as any of this trim in good condition is super expensive and usually in Europe as we dont have many of the wagons here. Suspension and brakes!!! This is exciting. In the front; New control arms New sway bar links New lower Eibach springs (the only modification I'm planning on this car) M Sport shocks (these came with the car and will replace the longer shocks in the car) New top mounts Used 540i calipers (stock brakes suck!) New 540i disks and pads (22x296 mm for 528 and 30x334 mm for 540i) New front wheel bearings (thank all that is holy for bolt on bearings!) Annnnd in the back; New control arms New sway bar links Adjustable air suspension arms (fool the car into what the current height is so the self levelling suspension can match the new front ride height) New ball joints I'll also be doing a brake fluid flush while I'm in there. I'm planning on switching the car over to the 16's that came with it so I can clean up and respray the M Sport 17's. They've lost a lot of colour over the years and have some gutter rash. None of this will start until the E90 is back.
