Hey guys.. i just thought u guys should noe wat happened to me 2 yesterday..

I was driving somewhere in auburn in my old crappy VL with my mates in the back seat.. so basically it was a full car

Ok heres the gay bit.. the car swirved to the right a little.. i think it crossed the line or something.. i didnt really notice.. but a cop was behind me and he pulled me ova.. BTW im a RED P plater...

He said i was driving recklessly * negligent driving * .. although i wasnt of course.. coz the steering wheel slipped out of my hands.. and it swirved the car a little..

The officer then started bringin up all this other shit.. he wanted to defect my old piece of shit stock holden VL.. i had 3 big ppl in the back which made the car low... and then my brake lights which wereworking but the cover was cracked and he said that was defect as well.. Then he started giving me a lecture about endangering my life and the lives of my friends..

i told the officer wat happened in regards to the swirving..

Then he said to me " well it obviously didnt happen if u werent speeding.." i mean how could i speed wen there were cars in front of me .. like a whole line of cars.. speed limit was 60 and im pretty sure that there is no way possible for me to speed wen there are zillions of cars in front of me..Also the officer didnt tell me how fast i was going.. he said something along the lines of " trying to impress ur mates "...personally he cant judge like that.. but ne way.. theres still more..

then he looks at my license and sees that i wasnt wearing my specs.. he said " thats another 2 points "

So thats like my whole license gone in one go.. i dun get how this is possible..

I guess i just met my match of a so called " PRICK COP"

He took down my details but didnt give me any sort of ticket or ne thing..

I was advised to write a formal letter tot hem coz he was being kinda unreasonable.. the officer even said " i am not willing to debate over this matter "

Didnt even give me a chance to explain.. then he asked me " give me a reason of why i shouldnt give u a ticket.?" i mean how am i supposed to answer that...!

THat had to be one of the worstest days of my life.. my whole freakn license gone in less then 5 min..

I talked to 2 cops who came into my work and they explained to me the rea deal so yea.. i see some hope in me appealing.. i dun wanna cop the massive fine and lose my license..

If any one has any advice then i'd be deeply appreciated..

I think the guy kinda had a bad impression coz im big and im an asian with blonde hair

Heheh, im glad i was paying attention in the complaints against police lecture during my criminal law class :D

Dude, you should write directly to the police ombudsman.

If you see the (not exhaustive) list of things you could complain for there is 'bias and mistreatment by police'.

In your letter, remain calm and state things clearly. It's also advised that you include statements from and witnesses of the event (your friends). The issue of whether they are lying or not to protect your interests does obviously exist, but as far as i know, the onus is on them to prove that they are lying, if they cannot prove they are lying (which is highly likely) it will be regarded as an honest recount of events particularly under oath.

i.e. What your friends say will be regarded as the truth. Their statements will only be questioned, if and only if the officer can adduce evidence to show otherwise.

This should sort everything out. Once your complaint has been lodge, it will be chased up, they have a statutory obligation to do so, and if they find the officer has misbehaved in any way, they are also by law required to discipline that officer.

Just write in and wait... =)

Hmmm....

having read your post again... i really dont see much room to make complaints except for the speeding thing...but seeing as he didnt issue you a ticket for it...i suppose it doesnt count. as for specs... thats your fault. broken cover... i dunno whether that is defectable or not, but if it isnt and he did then you should look into it.

Sorry to say this, but there is little chance of your appeal being successful.

Firstly, the policeman is always right.

When the facts of a case are contested by the alleged offender,

and the police officer, the magistrate will ALWAYS accept the

cop's version of events, whether you like it or not.

If the cop says you were negligent, you were negligent.

Regarding the glasses.....well you should have been wearing them.

No case there.

LoL, the 'Asian' thing. You def. DO NOT want to bring that up,

that will only lead to more trouble....

Sorry to say m8, the prospects don't look good.

To bear the brunt of some people on SAU in the words of henry rollins "the only good cop is a dead cop". I've had the usual speeding fines even a debatable red light fine. But I got done for undue noise in my line, got hasseled by a guy and a bitchy lady cop about it. Guy ended up being ok about it but still "HAD" to book me for something. I wrote a letter to the officer in charge brought up a heap of stuff about how the coppers weren't wearing reflective vests like you have to be working on a roadway, how I could see them from where they reckon I did a burnout, how the cop felt my tires and they weren't hot. 3 years later and I haven't been to court or anything.

not true ali ,

depends oin the evidence you can produse at court and what evidence the police have .

i have been to court several times , once for neg driving ( got off ) twice for not wearing a seatbelt ( got off both times ) and once for speeding , the cop got me on a radar , he was traveling the opposite direction and i got off then as well .

i wasn't there so i don't know stevens situation so i can't coment on what would happen in court but whatever he does he needs a good lawyer .

DIDN'T REALLY NOTICE????

I know that I don't want to have someone on the road if they "don't really notice" what's going on around them when they're driving.

No point in calling the cop a prick, sounds like he did the right thing.

two thumbs down for that.... firstly

it is actually a defect for a cracked light, not wearing your specs.. well its a condition of your liscence, just like wearing p plates, only way to not wear them is wear contacts..

actually i got pulled over, and cop didnt say anything about them(i was wearing contacts at the time).. :S...

also, if your car 'suddenly' swerves to one side, if its not a very bad wheel alignment... then its defectable.. you yourself admit it is uncontrollable... so get it fixed :S

I admitted that not wearing specs whilst i was driving,.. but for swirving.. man the steering wheel slipped out of my hand for like 1 sec.. but i aint losing points for speeding or negligent driving.... the cop was a prick coz he didnt let me speak.. everytime i tried to he would barge in and say " im not willing to debate about this issue "

IT is supposedly my first offence so im gonna try appeal for it

    • Hi guys, long time no post as per usual! It's been a busy year so far, the biggest thing being a new job.  After 28 years in the automotive industry I decided it was time for a change.  I was losing faith in the industry and where it's heading.  Now in a completely different industry (electrical) working for a company that manufacture water pump contollers.  Not as sexy as cars but it's an interesting,  challenging industry. I now don't work Saturdays which is a bonus!  It's still 50-55 hours a week but having Saturdays ack after 28 years of working them is awesome!   No news on the GT-R but i did decide to add some more JDM goodness into my life....           1990 300 ZX.  She's not perfect but for a 35 year old car she ain't bad!  Just going to tidy it up a bit and enjoy it.  It's currently auto but will start stockpiling everything for a manual swap. It WILL distract me even further from the GT-R but im hoping not for too long! It somewhat proves a 6'8" freak can fit in a 300 ZX.  Sort of...  I drove it home from the previous owners house in Melbourne via Black Spur and Merton Gap (2 awesome bits of Victorian twisty road) and it was amazing!  Handles so well!!!   I don't think it would be worthy of a full build page but I'll post up some of the upgrades here if anyone is interested?  Cheers guys!
    • End game is to: - Remove all the slop from old worn parts - Adjust setup so that the wheels actually fit and the car is drivable (currently it is not because of the extreme rubbing on the guards).   Progress over the last couple of days, removed the rear hubs! Next steps: - Buy bushings - Replace bushings/bearings on hub - Reinstall
    • Cracked deck  And other cam snap stuff   
    • A few random issues have popped up since my last update. My WMI pressure sensor failed within about 10 minutes of it seeing liquid. It was a 20$ China special, so I'm not surprised. My name brand replacement should arrive today.  My power steering assist also decided to crap out last weekend. The usual, works for about 60 seconds after starting the car then I lose it. I dusted off my old copy of NDS and connected to the HICAS ECU. Code 4 for assist solenoid.... I tested the solenoid and it's fine.  I knew the day where my HICAS ecu would crap out would come, and I welcome it. It was the last HICAS part on the car that is now in the bin. I've ordered an SSR and I will control the power steering solenoid with my Haltech ecu. It will be nice to have proper speed referenced assist again after all these years.
