Hi All,

Quick question,

My bro got caught doing 15 kph and over in a 50 zone..

The cop wrote a ticket out (correctly).

Then in the post the ticket requesting payment had the following mistakes:

- mispelt surname

&

- incorrect rego (plates)

Does this mean that he would have a case against them in not paying??

Do the crime, pay the fine.

I hate it when people who know they did something wrong try and weasel their way out of punishment.

Your brother was speeding (like most other people do sometimes) and he fully knew what the penalties were when he did it. He got caught? Bummer... It happens.

dont need to pay out on the guy its a legit question.. iv also heard a rumor that if they make a mistake on a fine you dont have to pay it but im sure its bs

Just because they make a mistake on the ticket (or payment request) it doesn't mean anything. You still have to pay it.

Failure to pay it will result in another notice and finally suspension of licence and/or warrant for your arrest until payment is made.

Well it actually goes to court first, and a conviction is automatically placed on your name if you don't show, and THEN they send the sherrif around to collect the money, or authorised to remove it from your pay or similar.

There is no rule about them making mistakes. They just have to re issue the ticket, however it wasnt the ticket, but the reminder that had the mistake.

Maybe it is different in NSW.. but last time i looked at the back of one in VIC, non payment in 28 days automatically means it is your intention to take it to the PERIN court.

In NSW, you have 30 days from the issue date of the ticket to mail back the attached form to ask for it to be heard in a court of law.

If you don't do anything, they'll send you a reminder letter... As far as I know, after a certain number of reminders, they just issue a warrant for your arrest and/or suspend your licence...

Fark, why be so harsh to someone that went 65 in a 50 zone, which was a 60 zone only a few years ago anyway? It's not like he went sideways into a bus shelter at 110.

Because he's trying to weasel out of the fine, and we get this same question once a week...

The bottom line is the system is set up so that a 60 ticket in a 50 zone is not contestible and esp. not for the price of the fine itself. Minor mistakes will not affect the validity of the ticket if big mistakes are ignored.

I'll gladly admit that when I go thru your average 50 zone, I won't be doing 50 and from the way I see Skylines being driven, I'm not alone.

For all you know, it was 29km/h over and he was doing just under 80km/h in a 50 zone.

Come on guys... The speed isn't the issue here, as stated, we all speed now and again, and we ALL run the risk of being caught. It's the fact that he's trying to get out of paying the fine for something he did wrong. Cop it sweet and move on I say.

There was another thread where someone was giving advice on how to get off tickets and said he'd even gotten off some where he was guilty, just because the cops couldn't corroborate their stories. I forget the details though, maybe you could search if interested.

Only the guy in question can know if he thought he was doing something wrong. If he feels it was just revenue raising in action I reckon he should contest it. Without the full details such as a written off bus shelter we can't really pass judgement. I'm not going to say that it's not our place to pass judgement because we will do so regardless :D

If I got done for 66 in a 50 zone I would contest it. But that's not likely to happen because I tend to do 55 in 50 zones, where that will only land me a ticket in Victoria.

Yes its true that mistakes make no difference to the fact that a person is guilty of speeding but it can help the fine fall through the cracks.

About 6 years or so ago I was fined for exceeding the speed limit by a good deal, about 30+ i think it was a bit over 100 in a 70 zone. I had just bought my new car at the time (hail the Daewoo) so was a bit new to it.

The officer was quite calm and I asked him what happens now and he informed me the fine would be $500 and 1 or 3 months license suspension. :ohnoes:

I was about to beg or plead for a lighter sentence but I noticed that he had incorrectly written my license plate number on the ticket. I thought maybe I could get off in court on a technicality.

So anyway I did what we all do and waited for the second notice to arrive in the mail.

It never came.

Nor did the license suspension mail.

Nor did the points (4 i think) arrive on my license.

I was lucky :D And i never sped again! True story.

    • My idle is set at 950rpm though - Moving the timing around 20 degrees is not really what I'd call a calm idle. That said... neither is chop, by definition. The LS ECU likes to adjust timing to hold idle as opposed to air. It'd work, but generally speaking there'd be a discrepancy in the base idle and the IACV would want to move the timing around anyway to maintain said idle. I think I'm just going to keep the timing steady anyway. Preserve my engine mounts.  My aircon is now officially regassed. As the guy was reversing I noticed my reverse lights do not operate, along with my reverse cam. This is a bit distressing, because 100% of guides talk about which wire to connect to backup cams as "the goes with the [other color] wire". Often when doing conversions. Unfortunately the R34 colour wires aren't documented Unfortunately I had a T56 Magnum gearbox with it's reverse switch, which also isn't documented. Unfortunately there's definitely not documentation for people with both of these in the one car. Unfortunately I forgot. After many hours of this, I have a reverse cam and reverse lights again. The wire going through the trans tunnel to the reverse switch had broken. Upon inspection, it looks like this one wire had about 7 spade terminals and extensions in it.. for reasons I cannot possibly comprehend. I also spent the 750 hours required to clean up the wiring behind my head unit which now looks like this: This is a monumental improvement relative to what used to be there WRT triple gauges, head unit, traction control, wideband controller, and whatever the f**k OEM stuff still exists there in various states of connectivity/needed. Next step is to check in at the Exhaust shop to see/confirm how much clearance I have, to decide what mid mufflers or 'resonators' (which are just straight through, narrower mufflers) I can add and hopefully cut out a lot of exhaust leaks, pinhole, v-band or otherwise. But first step will be to 'take a look' before the next step.
    • Fark the AFM card and Nistune, Haltech Nexus S3, DBW, cruise control, flex fuel, dis dat.  
    • It's most likely the bolt/bush where the cover bolts back wore and allowed cover to move forward.
    • Still haven't put the injectors and R35 AFM in so we can tune the bloody thing for the HG highflow it got mid last year! I think I can forecast the upgrade path to a bigger twin scroll, external gate, Haltech, flex setup, Samsonas, dis dat, etc will be .... a while away!
    • Should have taken that opportunity to slot in a twin scroll turbo setup. Maybe next time.
