Hey Guys,

Wasn't sure what section to post this, so FI seemed most relevant!

I was rear-ended last week by a bloke who admitted playing around on his mobile, most of the damage went to the rear left of my 33, the exhaust took a pretty bad hit causing it to be bent like a banana. It was a HKS Hi-power turbo back which the repairer has quoted at $2700 to replace.

Now, somehow I managed to forget this on my policy (seriously), i've added every little piece of stupid shit down to the fuel pump and ecu but somehow I've forgotten the exhaust! Idiot.

So of course my insurer has come back telling me to bugger off with the exhaust claim, however since I'm not at fault doesn't the claim go against the 3rd party? A few years a go I only had 3rd party on my own vehicle, I was in a not-at fault accident and the at-fault insurer replaced all parts with the same or comparable parts.

If I was at fault in this instance, no worries, I'm at fault for the crash and forgetting to list the exhaust. But if I had no insurance at all, and I claimed directly against the 3rd party, like my previous experience they'd probably cover like-for-like parts, it feels like I'm paying more for full comp insurance but losing out.

Do I have a leg to stand on here?

Find a repairer with a lawyer, dont go through your insurance, ive done it this way a few times, last time the guy who hit me was with the same insurance company as i had, my panel beaters lawyer took on the insurance and they paid (and were spewing i didnt go through them so they could get out of a few things and negotiate the claim)

You dont have to go through your insurance if its not your fault and the other guy is covered, you just need a panel beater who has a lawyer to handle things, lawyer costs are washed into the cost of repairs (for us anyway).

Would the insurance company still have to replace the exhaust with a standard one,if so maybe you could pay the extra to the panel beaters to get what you want ?

Or do the insurance companies give you the arse all together if you have mods that are not listed ??

Just having a guess, have not had a prang for a long time, 50 years , had all of mine up to 22 :(

Some policies have a clause if you have mods that were not reported, that they can void your policy.

I had a customer over about 3 months ago who recently bought a late model hilux with a lift kit, he had a kangaroo run into the side of a door, called the insurance and as soon as the assosor saw the lift kit he told him he had zero cover as he did not report the mod.

Owner told his insurance he bought it that way and didnt know it was a mod, besides how does a lift kit effect if a kangaroo runs into it, insurance told him where to go, its in the policy.

Got his balance of his $1200 policy back and had a panel shop fix the door for $900.......life went on.

This is possible, however I'd be paying about 60% of the cost to do so. Considering I wasn't the one who admitted to playing around on their phone, why should I pay anything?

    • just an update to this, poor man pays twice  Tried sanding down the pulleys but it didnt do the trick. Chucked another second hand alternator in the na car which I got for free off my mate and its fixed the squelling. Must have been unlucky with the bearings.    As for my turbo car, I managed to pick up a cwc rb alternator conversion bracket + LS alternator for 250 off marketplace, looked to be in really good nick. Installed it , started the car and its not charging the battery.... ( Im not good with auto elec stuff so im not sure if this was all I needed to do but I verified such by using a multimeter on the battery when the engine was running and I was only getting 12.2v )   I had to modify the earth strap for the new LS alternator , factory earth strap was a 10mm bolt which did not fit the bolt on the LS alternator which was double the size so I cut it off , went to repco bought some ring terminals that fit, crimped it onto the old earth strap and bolted it up to the alternator , started the car and same issue. Ran like shit and was reading 12.2 at the battery.  For a "plug and play" advertised kit thats not very plug and play but alas.  My question is , am I missing something ? Ive been reading that some people recommend upgrading the stock 80 amp alternator fuse to a 140 amp but I dont see how that would stop the alternator charging especially at idle not under load.  Regardless ive pulled it out and am going to get it bench tested by an auto elec tomorrow but it would be handy to know if ive missed something silly or have done something wrong.   
    • My wild guess is that you have popped off an intake pipe....check all of the hoses between the turbo and the throttle for splits or loose clamps.

    • To provide more specific help, more information is needed. What Android screen? What is its wiring diagram? Does the car's wiring have power at any required BAT and ACC wires, and is the loom's earth good?
