Hey guys.

On Sunday 15/07/2007 20:25 @ Hope Island Rd, Oxenford (Oxenford overpass) from the set of lights to go down the on-ramp onto M1 Southbound (to Helensvale) I accelerated a bit heavily (R33 4DR Auto GTST) when the lights went green, which resulted in some wheelspin, creating noise (and according to the cop, smoke). This was not intentional.

When I was about 100m past the on-ramp on the highway (not speeding), I noticed flashing lights up the top of the on-ramp. I thought to myself 'damn, that will be another 2 points and $240 bucks'... I pulled over and weighted about a minute for him to pull over behind me (he was behind traffic).

I got out my licence while waiting for the officer to come upto my window because I knew I was clearly in the wrong. When the officer got to my window he proceeded to verbally abuse me for being a dickhead (I do not blame him for this as I understand what they have to put up with). Within this abuse he stated that I 'left the intersection in a cloulf of smoke' and I will lose my licence for 6 months!, he then also said "your car is a F***ING piece of S**T and I couldn't be F***ED towing it". Kind of ticked me off a bit but I was glad he didnt tow it obviously.

He then went back to the vehicle and after a few minutes a female officer (Constable Emily) approached the vehicle and issued me with a Notice To Appear in Magistrates Court Southport on the 07/08/2007 for "OFFENCE: MAKE NOISE AND SMOKE"

Making noise AND smoke is obviously part of the HOON LAWs...

All I had was a bit of wheelspin. next day I checked the bitumen where the 'offence' happened, there is ONE treadmark, about 10cm's wide, and different pattern to my tires. CLEARLY not from my R33.

I am not saying I shouldn't be charged, I am saying that I should have been charged with 'UNNECCESSARY NOISE' (2 Points, $240 dollars).

I emphesise that 'I DID NOT EXCEED THE SPEED LIMIT' and I complied fully with the officers and I pulled over and waited for the police to pass traffic to pull over behind me...

I do not agree that 'excessive wheelspin resulting in noise' has the same outcome as 'sitting there for 5 minutes doing a burnout, filling the street with smoke'.

If I plead guilty, I have 2 possible outcomes that I have thought of:

1. I state I didnt mean to do it and i am sorry for my actions = $200-$500 fine, maybe some points lost...

- or -

2. I state I didnt mean to do it and i am sorry for my actions = YOU DRIVE A SKYLINE, YOU ARE A HOON - GOODBYE LICENCE, GOODBYE > $500

I am set on the most likely outcome being number 2...

I do not agree that I should lose my licence for this.

Does anyone know any good & cheap solicitors on the Gold Coast? (I am aware it is usually Good VS Cheap)

PS: Look what car is the "POSTER CAR" for the new police import laws. Silver 4 door r33 gtst (same as mine)

I am really sorry to hear that mate. Theres really nothing i can offer to help, but i thought i would mention that the car on the tow truck is my old R33 that i sold 4 weeks ago... i can't believe the new owner lost it....

What's your traffic history look like? Depending on a few things, the likelihood of you losing your license for this is low. A judge will take all things into consideration, but don't be stupid and ignorance is no defence in law. You cannot claim you thought flooring it at the lights wouldn't spin the wheels etc etc, you didn't mean to etc...a judge will see straight through that.

Best thing to do is accept it and show remorse. Apoligise, say it was a spare of the moment thing and looking back you realise how stupid and foolish it was. Mention you require your car for driving to work etc and you strongly value your license. They take into consideration the fact you are pleading guilty and that you cooperated with authorities. Mention all of these things.

Being summosed isn't as bad as what many think, just because your going to court doesn't necessarily mean you're screwed. It just means, in most traffic offences, the punishment is discretionary (for the judge to decide based on facts).

Prepare well and you'll be fine. Any lawyer that practices in traffic related matters will be able to help you, although it's probably not necessary for something such as this. I can give you some details if you wish.

Just a question... It doesn't really bother me, but because I have to go to court for this, can they do demerit points on my licence? I've never been sure of this cos they aren't Police or Transport Department..

Yes, there will likely be a set demerit point loss for this offence. The court's job is to decide if and what further punishment you require, i.e. the fine level or possible license suspension. If that's the offence you listed above is the only you've ever had, you should be ok. Just take what I said into consideration, prepare what you're going to say and make sure you emphasise your remorse for your actions.

Also:

I'm not expressly familiar with traffic law however I did believe that this fine was only to be handed out under the premis that the officer suspected the excess noise and smoke was in conjunction with a race or time trial or otherwise misuse under the "hoon legislation". Did the officer indicate or question you relating to this? It's likely that he will use the wheelspin etc as his basis for handing out the fine but as he didn't fine you for this it's arguable.

I wouldn't suggest trying to exploit this argument without further legal advice from someone based in this area of law. It would also in your case be wiser to just take the guilty plea and plead to the court and hope for the best.

Everyone should carry voice recorders and use them when being pulled over by police. Even though you have committed a traffic offense and you accept it fair enough.

But you dont have to put up with that type of abuse from police, it would be nice to play it in court thats all.

That's a good idea, however I have heard of circumstances where it has backfired

It isn't as far as I am aware as long as you let the officer know that the recording is taking place...

May be wrong though...

It is LEGAL to record a conversation between you and another party without there consent, however it is ILEGAL for you to record a conversation between two other people who are unaware, you being the third party.

Police allegedly record all conversations on 99% of all traffic stops. They just allegedly delete the ones they dont want anyone to hear.

On the other hand police are probably sick and tired of hoons and attending fatal accidents involving young drivers that were speeding, they are just tring to get there message across.

True, however you will find that certain cars are targeted for no reason. Yes, people drive like knobs, yes it happens in "targeted/black listed" hoon cars however not everyone is like that. In theory cars don't attract attention it’s meant to be the driver, however that’s a total lie as now just owning one style of car is the attention in its self.

I guess it's kinda like me saying all black people steal, which is not true. The Police can’t single out every Skyline/Supra/insert import here driver. I had this conversation with the Police prosecutor before I went into Court yesterday in fact.

In regards to young people in accidents the Media and Police forget to mention the other people involved half the time. Yes we always here the stats on people under 25 but the fact of the matter is there is a higher % of people in Australia over 25 who have and are involved in more accidents then the under 25's.

Unfortunately the hoon band wagon media story still sells and will continue too, thus we will always be raped.

I'm at 36 when Queensland Transport updates the system, or when ever the court informs them. Hurry up and lose more, I feel like such a loner :D

    • From there, it is really just test and assemble. Plug the adapter cables from the unit into the back of the screen, then the other side to the car harness. Don't forget all the other plugs too! Run the cables behind the unit and screw it back into place (4 screws) and you should now have 3 cables to run from the top screen to the android unit. I ran them along the DS of the other AV units in the gap between their backets and the console, and used some corrugated tubing on the sharp edges of the bracket so the wires were safe. Plug the centre console and lower screen in temporarily and turn the car to ACC, the AV should fire up as normal. Hold the back button for 3 sec and Android should appear on the top screen. You need to set the input to Aux for audio (more on that later). I put the unit under the AC duct in the centre console, with the wifi antenna on top of the AC duct near the shifter, the bluetooth antenna on the AC duct under the centre console The GPS unit on top of the DS to AC duct; they all seem to work OK there are are out of the way. Neat cable routing is a pain. For the drive recorder I mounted it near the rear view mirror and run the cable in the headlining, across the a pillar and then down the inside of the a pillar seal to the DS lower dash. From there it goes across and to one USB input for the unit. The second USB input is attached to the ECUtec OBD dongle and the 3rd goes to the USB bulkhead connected I added in the centre console. This is how the centre console looks "tidied" up Note I didn't install the provided speaker, didn't use the 2.5mm IPod in line or the piggyback loom for the Ipod or change any DIP switches; they seem to only be required if you need to use the Ipod input rather than the AUX input. That's it, install done, I'll follow up with a separate post on how the unit works, but in summary it retains all factory functions and inputs (so I still use my phone to the car for calls), reverse still works like factory etc.
    • Place the new daughterboard in the case and mount it using the 3 small black rivets provided, and reconnect the 3 factory ribbon cables to the new board Then, use the 3 piggyback cables from the daughterboard into the factory board on top (there are stand offs in the case to keep them apart. and remember to reconnect the antenna and rear cover fan wires. 1 screw to hold the motherboard in place. Before closing the case, make a hole in the sticker covering a hole in the case and run the cable for the android unit into the plug there. The video forgot this step, so did I, so will you probably. Then redo the 4 screws on back, 2 each top and bottom, 3 each side and put the 2 brackets back on.....all ready to go and not that tricky really.      
    • Onto the android unit. You need to remove the top screen because there is a daughterboard to put inside the case. Each side vent pops out from clips; start at the bottom and carefully remove upwards (use a trim remover tool to avoid breaking anything). Then the lower screen and controls come out, 4 screws, a couple of clips (including 3 flimsy ones at the top) and 3 plugs on the rear. Then the upper screen, 4 screws and a bunch of plugs and she is out. From there, remove the mounting brackets (2 screws each), 4 screws on the rear, 2 screws top and bottom and 3 screws holding in the small plates on each side. When you remove the back cover (tight fit), watch out for the power cable for the fan, I removed it so I could put the back aside. The mainboard is held in by 1 screw in the middle, 1 aerial at the top and 3 ribbon cables. If you've ever done any laptop stuff the ribbon cables are OK to work with, just pop up the retainer and they slide out. If you are not familiar just grab a 12 year old from an iphone factory, they will know how it works The case should now look like this:
    • Switching the console was tricky. First there were 6 screws to remove, and also the little adapter loom and its screws had to come out. Also don't forget to remove the 2 screws holding the central locking receiver. Then there are 4 clips on either side....these were very tight in this case and needed careful persuading with a long flat screw driver....some force required but not enough to break them...this was probably the fiddliest part of the whole job. In my case I needed both the wiring loom and the central locking receiver module to swap across to the new one. That was it for the console, so "assembly is the reverse of disassembly"
    • But first....while I was there, I also swapped across the centre console box for the other style where the AV inputs don't intrude into the (very limited !) space.  Part# was 96926-4GA0A, 284H3-4GA0B, 284H3-4GA0A. (I've already swapped the top 12v socket for a USB bulkhead in this pic, it fit the hole without modification:) Comparison of the 2: Basically to do the console you need to remove the DS and PS side console trim (they slide up and back, held in by clips only) Then remove the back half of the console top trim with the cupholders, pops up, all clips again but be careful at the front as it is pretty flimsy. Then slide the shifter boot down, remove the spring clip, loose it forever somewhere in the car the pull the shift knob off. Remove the tiny plastic piece on DS near "P" and use something thin and long (most screwdrivers won't fit) to push down the interlock and put the shifter down in D for space. There is one screw at the front, then the shifter surround and ashtray lift up. There are 3 or 4 plugs underneath and it is off. Next is the rear cover of the centre console; you need to open the console lid, pop off the trim covering the lid hinge and undo the 2rd screw from the driver's side (the rest all need to come out later so you can do them all now and remove the lid) Then the rear cover unclips (6 clips), start at the top with a trim tool pulling backwards. Once it is off there are 2 screws facing rearwards to remove (need a short phillips for these) and you are done with the rear of the console. There are 4 plugs at the A/V box to unclip Then there are 2 screws at the front of the console, and 2 clips (pull up and back) and the console will come out.
