I dont think entrapment laws are fairly easy to get around...

"State is entitled to protect itself against likely criminal activity" and "setting a trap" can be a "social necessity". By way of contrast, an egalitarian rights oriented stance would stress the necessity that "a citizen's precious right to immunity from arbitrary and unlawful intrusion into the daily affairs of private life remain unimpaired". Entrapment represents a "conceptual incoherence" in the criminal justice system in that we "say x ought not to be done, but we invite people to do x". Even so, "if particular crimes are so difficult to detect by reactive enforcement techniques our only choice is crime facilitation." In very few branches of the law have policy considerations played such a dominant part as has occurred in the development of principles on the law of entrapment.

I stand corrected. Seatbelts, brake and steering carry points (3 each) and undue noise under the Protection of the Environment Act carries points as well.

If the car wears plates and the trailer wears plates,as I would have to,to be used on public roads,You can be defected. I coped 13 defects one year on the way to the nats.

I'm sure any half decent lawyer could sort that out in court without breaking a sweat. Of course, you had no intention to drive the car on the street until it was roadworthy, so the ticket is bogus. Ladybytes has a good point about mods as well - just say you put full slicks on, then trailered the car to the track. There's no way the defect would hold up under court scrutiny. Similar for if you intend to only run the car in the summernats grounds, ie not in a public road.

Also, if you were trailering a car in those circumstances, you could pull the CAS plug before you set off, so if you were instructed by the police to move it off the trailer you could respond with "it doesnt start". :P

if its regested they can as kto inspect it . unregested dont see why it matters wat ever the case is there just money digger's defecting them ant proving anything it just makes em money.

I travelled down last night and just got back now, seen a total of 3 hwy patrol and 1 undercover and 600km.

NSW police are pathetic, even in the town where all NSW police are trained where you would think they would be out in droves, their was only 1 hwy patrol on the side using radar.

How was it any rain?

As always it was aaaaabsolutely stinking hot, I found a big radiator fan (like top fuel teams use) in the PWR/Castrol display stand and sat infront of that for an hour thats how hot it was. They need to have a couple of big pavillions of just chairs and tables and fans/water cooling etc.

Security were allowing cars to do more/bigger burnouts than the past couple of years. I didn't see 1 car get kicked out or sidelined like I did every 15mins last year. A red R34 GTT did a killer burnout at the corner and plenty of other cars were cooking rubber all around the cruise route. As usual plenty of local slags showing their chest bumps, seen maybe 2 sets of good tits the rest I wouldnt even piss on.

I still don't understand why their are so few trade stalls, you get the regular big 1's in the pavillions but with an event so big with spectators and entrants from all over Australia it shouldn't be hard to get 50 trade stalls.

Well done to the Army for flying a helicopter back n forth over the event at low altitude all afternoon kicking up all the dust and rubbish over people and cars, love your work.

i obviously picked the absolute worst time to leave one pavillion to go visit someone in another pavillion... it was like i was in the middle of a tornado :(

Yeap if you drive an import and you get pulled up by HWP in NSW they first ask for your tyres to be looked at then walk up to your seats and belts for a rigourous bashing..

I only seen 2 highway patrol on the way down this morning, one was being sneaky and hiding in the bush with a speed camera and the other was near canberra and was sitting on the side of the road with speed camera.

Next year if NSW is interested, the ACT guys received free entry on Sunday for displaying their cars. We may be able to extend the offer.

On the way down thurs, just saw a few with the radars, nothing much.

On the way home saw a marked XR8 belt past us at say 160 plus.

5mins later 2 more hwy

They were dickheads these guys and thank f**k the cops got them. We saw these guys being total f**kwitts.

It was one of thoe times where you go "where are the cops when you need them" then they got done

Didnt see any other modded or streeters pulled over.

I remember one year, Chic Henry's sister in law (He is the main man for summernats...) was pulled over and the cop said "oh, this doesnt look like a modified car - off you go"

Of course Chic found out and made a few calls.

hey everyone, i was working at the street machine stand selling some stuff.. ne of u guys show up to the stand?

i left on thursday, on the way i saw 1 stop for defects and another stop for drugs, that thursday night i saw 4 different rbt's on the 1 corner lol, no getting away for neone :s as for the way back there was 1 under cover with the radar bout 10minutes out of the scene, i also saw those guys pulled over but sisnt look like much to me, just 3 cops cars on those guys... didnt get pulled over once thank god... all in all it was stinking hot, have sore as feet, saw 1 car smash into the concrete barrier after doing a burnout, and loved the 21st birthday party they had on saturday night... i was soo fkn drunk i barely remember nething after that, woke up in the morning still drunk :lol:

p.s. just to rub it in a little i had 6 free 3 day passes :yes:

I went down saturday morning with some friends, saw a black commode fly past us followed by a couple of P platers.. we were doing 120 so they must have been doing at least 150. Not even 20 seconds later my friend backs off because he just went past a cop sitting in a breakdown bay, cop eventually turns his lights on and comes onto the road, hangs back a bit.... then absolutely nailed it past us. Few clicks down the road and he's pulled over one P plater, then a bit further on we saw another cop had pulled over the second P plater, then we saw a 3rd cop who was booking someone in a commodore (another P plater, not the first one we saw flying.. probably got him for poor taste as his car had altezzas).

it was brilliant. you've gotta have rocks in your head to speed on the way to the nats. They all got done for being complete fwits.

Sounds like grounds for entrapment to me.

Australia has no entrapment laws, as has already been posted. I get annoyed every time someone uses that word because it shows total ignorance for our laws. We are not America.

After making a comment like that I don't think you deserved to see any. The nats is probably the only place where you can see a free bit of tit, and it's also the only place where a girl can get an ego boost because pretty much anything will be cheered. Hell, a guy cruised past in a motorised wheelchair and the crowd went nuts. I love it, it's just great entertainment even though I've seen some very ordinary sets at times. You take the good with the bad (and this year the best set belonged to a woman who must have been in her 40's... respect!).

If the car on the trailer is registered then they can defect it because you have the intent on driving it on the road (otherwise it wouldn't be registered would it).

When they ask you to take it off the trailer and you do, then it can be argued you have intent to drive it because now it's on the road. If it's on the trailer it could be broken - plenty of registered cars have been put on tow trucks because something happened that made it temporarily unroadworthy. Should you call the RTA and cancel your rego then get it towed and fixed then re-instate the rego? That would be a joke.

If you're really worried about it just take your number plates off when it's being towed, and say it's unregistered.

    • So, I started this repair and got as far as "fixing" the holes with some fibreglass. God all those years working on boats came back quickly. I decided I'd reach out to some rust guys just to see what they would say about it. I came across a guy about 40 mins away and went to see him. He said the windscreen needs to come out, that there might be some more bits around the windscreen and he'd quote them at the time. But his quote was $300 to remove and replace windscreen and $3k for the damage he can see. He said he could respray the roof for $1200 and the bonnet for another $800 (somebody has previously rattle canned it, its horrendous). This is $5300 + any small additional bits. It's a lot, I get that and the name of one of my fave youtube channels 'Not Economically Viable' comes to mind.  I'm not being financially rational, but I've taken him up on the quote. He's opening a new shop in November with more room, so we're waiting for that. I'll leave the currently missing headliner out until then. I'm looking forward to it being fixed and having the paint looking nice again (lots of clear coat issues on the roof too). / flame suit on.
    • Oh and some up-and-comings; New rear drivers wheel bearing. I'll do that this weekend while the diff is out. The car is already up and the d/c axles and missing exhaust will help with space. This is the last bearing for me to do and I've been dragging my feet on it. I also have some new EBC blue stuff pads for the car and some new brake fluid. I haven't ever flushed the fluid in this car and looking forward to it. I have 600 degree fluid to put in. Not exactly "race fluid" but better than the typical stuff I have been using.
    • A proper clutch/plate type mechanical diff with quite a lot of pre-load and high locking % is better for drifting. Much more consistent in its behaviour. A helical can be annoyingly vague and inconsistent in how it responds under the sorts of abuse found in drifting.
    • Some updates here. I pulled the entire interior out, minus some trim to respray the seats with Colourlock dye. It turned out really nice though I accidentally let the dog in the car after and she scratched up the front seat.  This is what it looked like before, the colour was just washing out everywhere but thankfully the leather was in good nic. Then after the respray   And after the bloody dog jumped in The headliner is out waiting to be retrimmed, but it will stay out now until Nov - see why below. I replaced the stereo/headunit with a period-styled Android headunit. I have no after pics, but I'll get some. This is because of the missing pixels. I tried to fix this twice with replacement ribbon cables but couldn't. Also the bluetooth interface I'd bought for this was crap. Then there's the rusty roof. Pics and info in this other thread. I have decided to get this repaired professionally, but I'll update that thread. This is why the headliner will stay out for now. I'll be getting the roof and bonnet resprayed at the same time the rust is fixed. I also had an interesting issue with my drivers door lock.  For a small period I was having issues getting any 12v power to the car - I mean *any*. It would have no dash lights, nothing. It happened while I was at the shops and I couldn't get in the car. So, we had 2 problems. The most pressing here is that I was locked out. I have only a single physical key hole on the car, the drivers door and no amount of turning would unlock the car. Surely it doesn't need power for this? The second issue is why am I losing all power periodically, The battery isn't dead, its almost like the battery isn't even there. Two issues that were surprisingly easy to fix. You fellow BMW over-engineering lovers will appreciate this. The lock in the door has 5 states; mechanical lock, electric lock, neutral, electric unlock, mechanical unlock achieved at -90 degrees, -45 degrees, 0 degrees, 45 degrees and 90 degrees. Although, the unlock is towards the front of the car, so opposite for LHD countries. Sticking the key in and turning 45 left or right is what is used 99% of the time. It activates the central locking etc. 90 degrees is for dead battery access and, obvs, only un/locks the one door. But because the mechanical lock is never used and is 27 years old, it seizes up. I was totally unable to turn the key far enough to get to the mechanical unlock (At the time of locking myself out, I didn't even know this was a thing). I eventually did it with some vicegrips and teflon spray.  I made a quick vid for other E39 peeps.   The battery issue is totally new to me also - It wasn't making sufficient contact between the post and the terminal. The terminal was bolted on tight, but the car wouldn't have power. After checking the battery with my multimeter I accidentally contacted the terminal and the battery post and the car got power. The battery was only a few years old and in good condition. I cleaned the post and the terminal with a wire brush, bolted it back on tight and never had the issue again. I'm still surprised that despite having solid contact it didn't work. Also, the car was getting Warragamba sized pools of water in the back when it rained. My initial concern was another rust problem. But when I went out on Weds while it was raining and while I had no headliner in I could see a steady stream of water coming through the roof mounted aerial. As this aerial is for the (now removed) car phone I pulled it out and whacked a blanking grommet in the hole. It seems fine now. I'm thinking I might get the hole permanently filled when the rust is fixed. Moving forward and things in progress; The tailgate needs some attention. I have taken all the trim off to clean it all and address some small rust spots. I have partially done all of this but I'll finish it up hopefully this weekend. As all the trim are now entirely devoid of trim clips I have bought a heap of strong velcro and I'm hoping it does a good enough job as any of this trim in good condition is super expensive and usually in Europe as we dont have many of the wagons here. Suspension and brakes!!! This is exciting. In the front; New control arms New sway bar links New lower Eibach springs (the only modification I'm planning on this car) M Sport shocks (these came with the car and will replace the longer shocks in the car) New top mounts Used 540i calipers (stock brakes suck!) New 540i disks and pads (22x296 mm for 528 and 30x334 mm for 540i) New front wheel bearings (thank all that is holy for bolt on bearings!) Annnnd in the back; New control arms New sway bar links Adjustable air suspension arms (fool the car into what the current height is so the self levelling suspension can match the new front ride height) New ball joints I'll also be doing a brake fluid flush while I'm in there. I'm planning on switching the car over to the 16's that came with it so I can clean up and respray the M Sport 17's. They've lost a lot of colour over the years and have some gutter rash. None of this will start until the E90 is back.
