Hey guys, after 3 months of waiting the Insurance debt collectors have finally gotten in touch with me. This time they asked for even more money. They attached images, reports and assessor info. The first price they gave was $3800.00 now they are asking for $5000.00!!!!

Im unsure of what to do as i look at buying a house in the next year or two and dont want a bad cross against my name if i choose not too pay it.

Firstly i was never given any rights to this.

- I never was offered three quotes.

- I was never given the choice of the repairer and which quote to use

- The only time they call me is when they want money.

- I was kept in the dark about eveyrhting until now.

Its total bs guys, i have a kid on the way in a few months and i have these pr i cks trying to take me for everything they can. I have not informed my old folks about it as they would spit chips bigtime if they found out i crashed into a car hahah. and they would prob take my bike off me as punishment. People say go to court etc, well thats all well and good but i may be charged for riding my bike on the road losing my drivers licence, paying fines etc. and then sitll have to pay the debt. Putting me further behind. Can anyone give me any logical advice?

Not advice like "man youve been raunted, ignore their calls", this doesnt help as these pricks will continue to hassle me.

Wait do you have insurance yourself? 3rd party or Comprehensive?

If you don't i'm not entirely sure, uhm... You can call the Insurance company and ask them about their policies (before stating that you've had an accident) I don't know if I heard it right once, but apparently they don't need 3 insurance quotes anymore, just 1 is fine or something.

But all I would do is ring up and try and work around it by getting it cheaper, I was almost rooted like that once (i had insurance, but the chick tried to get 1800 for me putting a little dent in her crappy hyandai door...) But yeah... Not honestly too sure with those kinda things... Sorry dude :S

Hey you dont get to choose the repairer for her car and nor do you get to choose the quote you want to use for her repair bill, this is all her insurances business...And yeah its normal for insurance comopanies to keep you in the dark, you need to make te effot to call up and ask them whats going on.

nah i will have a word to them today. offer them one lump sum payment and see what they can do. they usually reduce the total.

and btw i didnt crash intp the accent in a car. i crashed my mx bike into it. whats funny is the bike only suffered a few scratches and the hyundai received a bent chassis rail, banged up cross member, screwed reo bar, broken front bar etc. they really are shite cars

In short, you crashed your motorbike/dirtbike into a car. Damaged it, and now you have to pay $5k?

If you had insurance, you wouldn't be in this position.

to be insured for riding an mx bike you must be on a licensed track or in a proposed riding area. They will NOT pay out a claim for someone who is riding on the side of the road.

This may help you understand better: People who crash a mates car and their insurance policy doesnt include other drivers then the insurance company wont pay out the claim. Works on the same principles.

Everything you said above was pointless, i asked for advice from people who may have been involved in a similar situation in the past. I do have insurance for my car only!

Just pay, it's been too long & bringing up the new kid thing to get any sympathy won't exactly help. Otherwise having a kid on the way while you're being sued for money will be a great experience.

You were riding a uninsured vehicle and hit an insured one which was i assume, on the road, hence you were riding on the road at some time.

So yeah.. you screwed up big time, and will have to deal with whatevers handed to you.

You porbably already know that tho, so please done thing i'm taking a pot shot at you.

When it comes down to it the insurance company is not obligated to do any favors for you. The owner of the car would get to choose her repairer and that would effect the ammount it cost to fix things (hell she might even have thrown in a few more repairs and covered them under the accident for all you know). The insurance co has an obligation to pay that bill for her and will now do whatever it can to mitigate as much expense as it can.

As you you have no insurance, they'll gun for you, and will hit you for every penny they can.

Again you already know this...

So it comes down to this... bend over and take it, if you choose to lube up or not is your choice...

by that i mean give the insurance company a call... play friendly and tell them you dont have 5k but would like to come to some kind of agreement, make your pitch for a lower lump sum, they might take it. if not ask them about a payment plan. As long as you have a payment arrangement sorted out you'll avoid having yr credit screwed,

Just get an agreement nailed out... any agreement you can accomodate, and stick to it.

You'll end up walking funny for a bit, but you'll avoid getting too many ass stitches.

Wow. Just wow.

As far as I know, the member above your post isn't the one that was doing some illegal, then something stupid that resulted in someone's property being damaged. So calling him a dik (sp) & retarded is a bit far fetched. All he said was deal with it, which is what you need to do, unless you want to lose more money from the situation.

If I was the guy who's car you crashed into & I was 5 grand out of pocket over it, I'd be pissed off as well. Also, sure it might be a hyundai accent & you're very funny for saying that damaging it is more of a favour, but it's someone elses car & you haven't got a clue what most peoples circumstances are & that might be the best they can do in the situation. The insurance company will fix the car if it's less than what the car is insured at, which is why they are chasing you for the money.

Now if you understand all that & actually want to listen rather than abuse people, read this:

My mum has a Mistubishi Lancer station wagon (92 I think). She was taking her boyfriend to work one morning & was behind a 4wd. Residential area with roundabouts, doing 50 etc. It was bulk collection time & this person must have seen something that interested them, and all of a sudden this 4wd stopped in the middle of the road. My mum was wondering wtf was going on, when all of a sudden it reversed into my mums car, even with how quickly she was on the horn.

Anyway, the spare tire on the back was what caused all the damage. Dented the bonnet, radiator & god knows what else. That car was insured for what I think was $5000. The damaged was around $4800. Insurance wouldn't pay out the policy for an old car with 300k+ km's on it, and it got fixed. So yes, the damage done by this 4wd could be similar to what happened to the accent, a combined 160kg odd will cause damage if it hits something at 50kph.

cheers mate, thats exactly what i wanted to hear, a straight forward answer explaining my options (which are very limited)

I told the lady on the phone yesterday, i said straight out.

" ive done the right thing by giving my details, choosing to do the right thing and pay this debt" I told her i could have given a fake name as i never took off my helmet and would have never heard another thing about it all and gotten away with everything. but im too honest to do that and im heaps superstituous when it comes to carma.

But yeah i will have another word to them today and see what discount they can do me if i pay a few large lump sump payments instead of weekly direct debits. She was very nice and understood my situation which is good.

When it comes down to it i realise i did the wrong thing. heck its a small town and the need to use utes/trailers to take your mx bikes out to some bush was not necesarry. however i wont be letting my tyres touch a paved road ever again. The authorities in kalgoorlie dont seem to care too much for people who ride their bikes on the roads as long as its safe however i wont be risking this again.

A 10-minute moto ride cost me $5000.00!!!!! Its just not worth the risk anymore and last weekend was the first time i rode my bike since the accident. I am happy i didnt end up with a broken leg or even worse, dead. Cheers for eveyones input its jsut hard coming to terms being honest has cost me $5000 bucks.

sorry to the guys that were trying to offer advice. i acted like a dick myself. I was mis-informed about what my options were by some people in the past saying i had the right to request 3 x quotes, choose the quote etc etc etc.....

Turned out as said above that info was incorrect. It's just a bit terrifying knowing im in debt.

I thought people were trying to take a stab at me or something.

well she said i cant choose the amount to be deducted each week its calculated on my earnings so yeah i played it hell poor. she was like oo your not left with much etc ahaha. but i would rather get rid of it and move on than have to see the debits coming out of my account for the next year or two.

it is a lesson learnt thats for sure. I took riding in public areas for granted. I can now see some sense as to why its not permitted. It's just not safe for anyone. Im lucky i hit a parked car on someones lawn than a car travelling at 50kph down a road. I considered myself lucky when i walked away from it and a police report was not written as it would have definately resulted in a loss of drivers license and some fines to boot.

But yeh, its unlucky. But thats how it is. So yeh, good luck. With the salary it should be ok. Cos its a % and I don't think they can take 100% of it :D

gave them a call today came to a better/easier agreement. Instead of paying installments every week of 'x' amount of dollars i asked about making two larger payments to pay off the debt and she was more than happy to help me out. She was actually very very accomodating to my situation....

She has given me 6 weeks to pay off the debt however if it is paid before the 6 weeks she will reduce the total down to $4000.00 so all i have to do is make two payments of 2000. Piece of cake.

Once again sorry to all. I may have worded things poorly in my previous posts. Im not in a bad mood anymore haha.

    • Back again. I returned to Japan in Jul/Aug to spend time with the car on my birthday and remind myself what all the sacrifice and compromise is for. It happened to line up with the monthly morning meet in Okutama, which I have been wanting to go to for a long time. It's a unique event at a unique spot with really rare, interesting, and quirky cars. It's where all the oldheads and OGs gather. The nighttime scene at DKF certainly has its place and should be experienced if you're into cars, but there's too much bad attention and negativity around it now. IMO the better time is Sunday morning at DKF or Okutama; it's more chill and relaxed. I'm glad I was finally able to go, but not sure it's worth the drive from all the way from Nagoya immediately the day before, unless I was already staying in Tokyo for the days right before the meet, because you have to wake up quite early to make it in time. Funnily enough though I didn't drive the car all that much this trip because it was just too damn hot. While there were zero issues and running temps were nominal and the A/C was strong, RBs already run crazy hot as it is. Sure, it took it all like a champ but something about driving these cars in the ridiculous heat/humidity bothers me and makes me feel like I'm asking too much of it. I'm just me being weird and treating the car like a living thing with feelings; I'm mechanically sympathetic to a fault. Instead I was mainly driving something else around - a KX4(silver) 2001 X-Trail GT, that I acquired in May. There's a few different flavors to choose from with Xs, but visually it's the Nissan version of the Honda CR-V. Mechanically it's a whole different story as this, being the top-trim GT, has an SR20VET mated to a four speed auto and full-time AWD! It was a very affordable buy in exceptional condition inside and out, with very low mileage...only 48k kms. Most likely it was owned by an older person who kept it garaged and well-maintained, so I'm really happy with how it all worked out. It literally needs zero attention at the moment, albeit except for some minor visual touch-ups. I wanted something quirky, interesting, and practical and for sure it handily delivers on all three of those aspects. I was immediately able to utilize the cargo and passenger capacity to it's full extent. It's a lot of fun to drive and is quite punchy through 1st and 2nd. It's very unassuming -in the twisty bits it's a lot more composed than one would think at a glance- and it'll be even better once I get better tires on it(yes, it's an SUV but still a little boat-y for my liking). So...now I have two golden-era Nissans in silver. One sports car and one that does everything else; the perfect two-car solution I think👍 The rest of the trip...I was able to turn my stressed brain off and enjoy it, although I didn't quite get to do as much as I thought. I did some interesting things, met some interesting people, and happened into some interesting situations however, that's all for another post though only if people really want to know. Project-wise, I went back to Mine's again to discuss more plans and am hoping to wrap that up real soon; keep watching this space if that interests you. Additionally, while working in the tormenting sweatbox that is the warehouse, I was able to organize most of the myriad of parts that my friend is storing for me along with the cars, and the 34 has a nice little spot carved out for it: And since it can get so damn hot in there, that made it all the more easy to remove all the damn gauges that have mostly been an eyesore all this time. Huzzah. I was standing there looking at the car and said 'f**k it'. The heat basically makes the adhesive backing on the gauge mounts more pliable to work with, so it was far less stressful getting this done. I didn't fully clean it up or chase the wiring though; that will happen once I have the car in closer possession. Another major reason to remove all that stuff is to give people less reasons to get in my car and steal s**t while it's being exported/imported when/if the time comes, which leads us to my next point... ...and that is even though it's time in Japan is technically almost up since it's a November car and the X would be coming in March, I'm still not entirely sure where my life and career is headed; I don't really know what the future looks like and where I'm going to end up. I feel there's a great deal of uncertainty with me and as a result of that, it feels like I'm at a crossroads moreso now than any point in my life thus far and there are some choices I need to make. Yes, I've had some years to consider things and prepare myself, however too much has happened in that time to maintain confidence and everything feels so up in the air; tenuous one might say. Simply put, there's just too much nonsense going on right now from multiple vectors. Admittedly, I'm struggling to stay in the game and keep my eyes on the prize. So much so in fact, that very recently I came the closest I ever have before to calling it quits outright; selling everything and moving on and not looking back. The astute among you will pick up on key subtext within this paragraph. In the meantime I've still managed to slowly acquire some final bits for the car, but it feels nice knowing there's not much left to get and I'm almost across that finish line; I have almost everything I'll ever want for my interpretation and expression on what it is I think an R34 should be. 'til later.

    • Also playing with fire if they start to flow more air down low than what the stock twins can. It's not even up top you need to worry, it can be at 3000rpm and part throttle and it's getting way more flow than it should.
    • Any G40/1000 or G40/1250 results out there?  
    • You still want a proper tune on the stock ECU though. Stock tune + stock ECU with GT-SS/-9s is probably playing with fire if you're running more than stock airflow/power.
