heres a scarey story for you that im going through right now!

last night i was peacefully driving home from work, exciting because i was going to the J5 concert!

as im driving along an elderly man in white camry parked on the left hand side decided to pull out to U-turn about 5 metres in front of me.

i locked the brakes and smashed into him. my car is stuffed, his is defentantly a write-off.

well now comes the fun part, the cops come along and immediately assumed it was my fault, seeing a lowered skyline, with big exaust, intercooler and rims. i spoke to several officers and with each one, it took me several explanations before they understood it was me who was casually driving alond as someone pulled out infront of me. during questioning me they asked how fast i was going, i explained the last time i checked my speedo was on the main road (which i turned off into the small street where the accident occured) and i was traveling about 60-70km/h (the main road was 70km/h zone) anyway later in the night the officer calls me to give me my accident ID number. he also informs me i will be getting a speeding fine for driving 70km/h in a 50 zone and that there is a whitness that beleives i had no headlights on! (absolute crap!)

anyway today i went to the LAC to get the other drivers info for insurance purposes... as it turns out there is some confusion in the report on the database... they were unsure who hit who and the officer in charge forgot to enter ANY of the other driver's details!

so im really freaking out here, they came to the scene with the mindset some under 25 hoon driving a skyline caused an accident, and so far the only info they have is that i was speeding in a 50km/h zone without any lights on!

thankfully today when explaining what happened to a work colleague, he positivly remembered me leaving work with my headlights on and is prepared to make a statement as a witness.

but this is scaring the crap out of me. everything so far has been twisted or manipulated to put me at fault.

hope this doesnt happen to anyone else!

and when they want to question you after an accident, get them to write the questions down and tell them you will fill the answers when you are at home and over the shock of an accident.

Ben.

More like cops are just lazy and jump to conclusions IN THIS CASE.

I was involved in a three car accident ages ago - not my fault on the initial report.

But the other two drivers had no insurance, so guess who they pinned it on???

I suggest that you seek some legal advice. The way this is going you are going to wear it in the neck. Wait till your insurance finds out you have on the report that you were speeding and that you had no lights on. They will try very hard to drop you like third period french. You need to be on the offencive here and get this sorted asap. The longer this goes on the further this is going to get screwed up.

Make it known on record that you are SURE you had lights on and were doing 50km/h.

This truly is paramount. You need to make sure they are aware of this and that it is your statement on the night as well. Make sure they are aware that you were doing 50 where you were and not 70 that that was your speed on the previous road. I think that you have 24-48hrs to get this right before you are facing taking responsability for this accident.

A crash of this nature is a big shock to your system.

I was rear ended and I got whiplash.

You need to make it known that you were dazed and confused, perhaps in shock and your initial statements may have been coerced by the police.

But afterwards after some medical advise you are sure of the facts and you have workmates who can back you up.

Hmm, definately I think you need to get the details of the officers who attended - some issues to consider:

a. they 'forgot' to get the details of the other driver - is this dereliction of duty? cant be right - complain to your local MP (I am serious) What would happen to you if you forgot to do your job and someone else was disadvantaged? Perhaps financial reparations would be in order? I am not sure if you can take action against individual members of the police force or the department in general but there is no excuse for this one.

b. who said you were doing 70 in a 50? You didnt, and I take it this was from the same guy who didnt bother, or lost the details of the other guy? where is the credibility of a guy who cant do his job properly? I dont think it would stand up in court esp as you must have been suffering from shock and would not have been 100% coherent.

Please, please, just report it to your local MP - they can move mountains and love stirring shit for local voting, law abiding citizens:)

Very bad to hear, hope some luck comes your way.

Officers will take the easy way out of things, they are doing a job like anyone else, you have come across some very lazy and ignorant people.

take this as far as you can, fight it all the way to court if u have to, they will have to back flip, as their judgement and decisions on the night will be questioned, and they will be in the shit.

The officers that attended the accident scene.... how many were wearing the bright yellow vests ? If none, mention this to them and watch their face cringe :(

/edit

Mums reaction after reading your post "Absolute bullshit" haha

you were in a 50kph zone and you said "last time I looked I was doing 60-70kph"..... not very smart!! and yes I do know what you meant. You will need to be very assertive from this point on.......and very careful in what you say if you want this to come out good.

Why didn't you get the other drivers details?? This is standard procedure in any accident.....did he get yours??... You NEED professional help here ASOP.

this has happened to me last year only my car wasn't writen off & other party turned off a round about from inside lane & hit my rear drivers side (i was outside lane, 2 lane round about).

other party was telling me it wasn't his fault & wouldn't give me his details so cops called. cops took his details for me & left with him also telling them i assulted him (took all my strength not to).

due to both cars drivable told by cops to do self report which i new anyway. get call from insurance telling me there's a problem due to other driver saying not his fault. due to no witness insurance was holding up repairs until at fault driver could be proved but other party wouldn't admit fault & insurance wouldn't make a call so wanted me to pay excess.

well i bought stat deck wrote out exacty what happened & where it happened in detail, drawing of road, copy RTA exit round about rule etc. also asking the question how could be at fault when my car was hit in rear driver side quarter & he was moving accross my lane to exit round about & if what he did wasn't his fault could i have there report in writing because i would like to run it by RTA.

well due to detail i went to they ruled against other driver within a week.

my hint put everything in writing & don't change story 1 bit from original writen on claim form. in your case it will go a long way if you go to cop station & talk to officer about what's happening expressing your concern how someone doing something wrong causing you hardship is turning into a case against yourself with bulshit witness account. don't go there dressed badly or with sun glasses on, infact if you have a grand mother take her with you & tell them your taking her shopping because you need them to know your a upstanding person.

yeah thanks for all the info guys.

zroyz as u mentioned i have already made a comprehensive list of events that night and the following morning. tomorrow i am speaking to my next door neighbour about the whole issue. she is a lawyer.

the only mistake i made was not being 100% sure about my speed. i think this will serious disadvantage me. i dont even know why i said it. i was in shock as i was questioned immediately after the accident. i have attempted twice to contact the officer and the police station to add these issues to the statement, but as the officer of the night is the only one with a report in his notepad, they wont allow me to add anything! so i have put together all the details i can and will be giving the letter to the station tomorow after my neighbour checks what i have written and given me additional advice.

i have to admit that the police have acted very unprofessionally here. the fact they dont have a detailed report on the stations database is of great concern.

ill keep you posted.

    • So stock ECU does not like anything above 10 psi?  That Nistune one is just for "try" if it will be any different, I know it need to be tune for that. I know but YOU may know about these problem but i/we dont. They few little Skylines here let alone people who know anything about tham so that is why iam asking here
    • So now we have a radiator with no attachments whatsoever. It lifts up with a particularly tight spot between the drivers side air box mount and the lower radiator outlet, but if you've got this far you will sort that too. This is the lower mounts with the rad out so you can see where the rubber bushes go, it is a straight shot upwards Done! Assembly is the reverse of disassembly, with blood less likely to be shed.
    • Right, onto the second last trick. The Air Con condenser is mounted to the front of the radiator and stays in the car when the radiator is removed. There are 2x 10mm headed self tappers holding the top of the condenser to the radiator, remove those The bottom of the condenser is attached to the radiator with clips. You need to lift the condenser out of those clips and clear (up, then forward). f**ked if  could work out how to do that last bit with the front bumper on. I hope you can, and you share the trick.  Bumper removal probably deserves its own thread one day once I've recovered the will to live, but basically you need to remove the wheels, front inner guard liners (clips and 10mm headed bolts), the self tapper between the guard and the bumper at the rearmost point of the bumper (same as an R32 that bit), any remaining clips at the top/front of the grill, an absolute bastard design with a plate that holds the top of the bumper above the headlight each side (only 1 bolt which is tricky to get to, but the plate catches 2 places on the bumper and must be removed....carefully!) and push clips between the bumper and guard under the headlight. If you've done all that you will be faced with wiring for the fog lights on both sides and in ADM Q50 RS at least, 4 nasty tight plugs on the driver's side for the ADAS stuff. So, the clips at the bottom look like this on drivers side (looking from the front) And on the passenger side (also from the front), you can see this one is already out Clearance on both of these are super tight; the condenser needs to move up but the upper rad support mount prevents that, and the radiator can't move down far because it is (rubber) mounted. Once you achieve the impossible and drop the condenser off those mounts so it does not stop the rad moving, you are good to go
    • OK, next the shroud needs to come off and there are a couple of tricks. Firstly, there is a loom from near the passenger side headlight to the fans, coolant temp sensor etc and there is no plug to undo.  In my case I was OK to leave the shroud on top of the engine so I just undid the passenger side fan plug and about 10 of the clips which gave enough free wire to put it aside. The fan plugs were super tight, the trick I used was a small falt screwdriver to push down on the release tab, then a larger flat screwdriver to lever the plug out of the fan unit....be careful with how much force you apply! If you need to remove the shroud altogether for some reason you will have to deal with all the plugs (tight) and clips (brittle)....good luck. I removed all of the clips and replaced them with cable ties that I will just cut next time. Also, in the Red Sport / 400R at least, the intake heat exchanger reservoir hose is bolted to the shroud in 2 places with 10mm headed bolts; so remove them (the hose stays in the car; no need to undo it at the t fittings down at the radiator lower mount. Once you've dealt with the HX hose and the wiring loom, there are 3x 10mm headed self tappers holding the top of the shroud to the radiator; remove those.   The shroud then lifts out of the bottom mounts where it sits on the radiator, up and onto the engine out of the way. Simples
    • Ok, disregard my “rate them” comment, sorry for my unrealistic input
