(B1) MR_fanny Posted January 14, 2004 Share Posted January 14, 2004 was on my way to safeway to pick up groceries in springvale. i turn off at the roundabout onto windsor and plan to turn right down buckinham to get there. half way down the street (short street by the way) i see this guy with a brief case about to cross the intersection. i saw him and he saw me but the guy still makes his way onto the road. at this point im thinkin hes one of those idiots that stand and wait on the street instead of the footpath for cars to pass before they cross but this guy kept on walkin. i break hard and stop with him on his toes litterally cm's from the left side of my bonnet/light. we look at each other with confusion. i decide to go again to turn right (thinkin ok must be one of those stupid incidents that u get once in a while) and just as i start to move he decides to walk infront of me again. once again i brake thinkin wtf?? as he continues to cross the street. as he passes i gesture my hand as to say whats goin on mate (no verbal exhange at this point) and the prick decides to turn back to the front of my car and read my reg to report me or somthing.....now that just pissed me right off!! so i yell out the window politely as my lil sis was in the car with me "what do u think ur doin? theres no crossin here u cant just cross the road like that" i then proceed to turn right (givin way to a pedestrian who wanted to cross as you would cause ur turning right?) and as i turn in the prick decides to cross the street again diagonaly infront of me. i stalked next to him re-enforcing my point that he just cant cross streets like that and drove off. attached is a diagram of the incident:) now what id like to know is whos in the wrong here?? windsor ave is classifed as the main street of the two (the line is orange and thicker in the melway than the other streets:D:D) i know u have to give way to pedestrians but my understanding is that u give way to them when your turning and when your on small roads that have to give way at intersections, not main ones. i mean u wouldnt see any sane person cross springy rd like that and expect cars to stop. would he do the same thing if i was in a mac truck instead of my line??..........aaaaaaaaaaarrrrrrghhhh!! anyways would like your opinions on this. cheers. I hate wandering pedestrians. Ususally i'll just plant the foor on the brake and lock-up right infront of them. I tell ya... a smokin/screechin car really puts the wind up the mongrels! And even after that they have the nerve to abuse you for it one day... one day i'll clean one up. Then we'll see what the Court has to say about ther pedestrains illegal behaviour for a change. I always thought pedestrians had right-of-way in any situation, but a quick check of the VicRoads site states: 236. Pedestrians not to cause a traffic hazard or obstruction (1) A pedestrian must not cause a traffic hazard by moving into the path of a driver. Penalty: 1 penalty unit. (2) A pedestrian must not unreasonably obstruct the path of any driver or another pedestrian. Penalty: 1 penalty unit. (3) For subrule (2), a pedestrian does not unreasonably obstruct the path of another pedestrian only by travelling more slowly than other pedestrians. pushead Posted January 14, 2004 Share Posted January 14, 2004 i was going at around 60km/h down high st then this little old lady stood infront of me so i had to brake hard as i was literally going to kill her heading straight on. lucky the skidding of the car ended up on the other lane missing her by cm's. gee's some people just want to play with their life fair enough, but don't play with others. But then, according to the rule book, that only applies when they are crossing the road you are turning into. There's nothing about the road you are currently on. Still, a bit of common sense would let the pedestrian cross if you have already stopped for the idiot. After all, another of the rules states that the pedestrain must not remain on the road for more time than is necessary; and if the 2 of you can't make up your minds who is going first, then you are assisting the pedestrian break that rule. predator Posted January 14, 2004 Share Posted January 14, 2004 The amount of pedestrians killed on Victorias roads last year (which makes up the road toll mind you) was 41 out of 334 road deaths, which is 12%.. in most liklihood either elderly or drunk. The amount of sympathy for somebody who DOESNT LOOK when crossing a road (sober or not) is pretty much zero in my book. **** em i say! While I'm at the lovely TAC site.. i found something else interesting: People killed aged 18-25 in 2003 on the roads: 72 (a 7 year bracket) People aged 40-49: 52 (a 9 year bracket).. not too far off the "deadly" bracket. Drivers over 60 killed: 70 !! Now when you look at the figures.. while there is always the "young drivers are involved in more fatal collisions that any other age" argument - which is true, looking at drivers over 60 is equally bad. Anyway and i always prove to them that their world will be under my wheels if they keep on doing that. Take away the offenders 'right to walk'?? :bs!: If you had hit him, then it would have been your fault. Even if you had witnesses to prove that he was causing an obstruction, if you hit him, and it went to court, you'd be the one paying his hospital bills and court fees. It's day to day life in Springvale...... you're lucky it was only a pedestrian, most of the brainless gits that i encounter around here are sitting behind the wheel of a car that they have no idea how to control.
