Piece of advice:

Take it to court and plead not guilty and hire a lawyer -> you've more chances of winning

Happy to explain this more since i've been targeted few times unnecessary and giving you advice from recent experience. If you were definitely not speeding then you should take it to court.

Get real legal advice. Saying that someone on an internet forum said this said that doesnt really mean crap unless there is backing proof.

Each case is different and there is always two sides to the story no matter how much evidence one side has/hasnt got.

Look Im no expert but Im sure you'll most likely get off, Incorrect procedure followed by officers, especially the recorded voice conversation.

The only way I see you get done for it is if they exclude the voice recording due to it not being brought to your attention (this would be a shit)

Oh in regards to the letter of wrong doing.. Its wont happen! You say sorry, you admit wrong doing. This is why police will never say sorry.

It will open a hole for you to sue, and they dont want that.

for example, The stolen generation and the sorry from Australians (this is why the government never intended to say sorry) 100 cases now on the logs for compensation.

Oh and ill also mention, police can set up radar traps in NSW in between signage. So legally they have to set traps between the 4km zones (i forget the exact distance) where a sign which say " speed cameras used in this area" or "police targeting speeding" and so on.

For vic its not the case cops can set up cameras anywhere and even hire people to do that job, sitting in a car all day or hiding cameras to catch behavior.

Hope I help. Sounds like you've been done before and learnt to slow down now if only a few others get the message (particularly younger guys) it will save a few lives.

As Paul said, if you have nothing useful to add, don't say it. If you wish to try and help, do so without calling him an "idiot" or any of your other heartless crap and just state some facts for him. He didn't make this thread so that keyboard warriors could abuse him, he did it to get collective advice. Maybe you should have a read of some of your old posts in these kind of threads and realise that you just end up looking like a real bitch. Then do us all a favour and don't bother commenting in the next one unless it's actually helpful and well meant.

Mate as AboBob said, I think you should pursue it but I'm not sure if the evidence you have provided to defend yourself with will be enough in court I'm afraid.

Now I'll admit that I'm impressed you didn't attack back from my comments and that shows that you're probably not such a bitter person after all, I just don't see why even on the net, you feel it's necessary to post replies like that. Simply helping him out by stating the facts for him like you did but without the negative comments would've been a far easier and more constructive exercise.

Steve I simply said he was an idiot for the tyres, which he admitted.

I stated that they legally don't have to put signs up for mobile raider.

There was advice about the suspension I'm pretty sure they do back date it but I wouldn't know for a fact and then I made a statement saying that I was sick of people having a whinge for when they get caught. I didn't say as to what he was caught for because we don't know if he was really speeding or not. But we do know he had bald tyres - which he admitted to as again.

It's just a matter of each persons interpretations of the statements.

I was stating the facts in a cold hard way. Would everyone rather me butter it up with cupcakes and a sweets.

If he wants some real advice he should really be seeking qualified legal advice. If you were to do a search on it. A lot of places will give you free legal advice.

I've been in a similiar situation recently to you before after a bad run in with a HWP officer. He didn't do anything right when he pulled me over, and I also knew I wasn't guilty of anything.

As already mentioned they bank on you admitting guilt and not standing up to them.

I took it to court, my cousin (a lawyer) represented me for free. We beat the charge easily but I wasn't happy with just that (this guy was a real f***). So we went even further than that and pursued the officer through the Ombudsman. After a 6 month investigation the guy was sacked (I had my own recording which we couldn't use in court, but was sufficient for the ombudsman).

The reason I'm telling you this though is because since then I've copped so much more harassment from them it's not funny, in the end you have to weigh up whether it's worth it. I was absolutely horrified when I was told the list of notes against my name that had been put there by some of his bitter friends.

In my case, I'm not sure it was worth it.

i didnt say i was an idiot for the tyres. like most people i cant just throw $600 at some new rubber when they look slightly worn. there is still reasonable tread on the shoulders, its in the center where they are getting low. i do look at them sometimes, but seemingly glancing at the shoulder is not enough. mind you ive only had them for 15000km, and i am not prone to burnouts.

youre right re: legal advice. but part of the reason i posted this is so hopefully people can learn from it, and not take shit from HWP in future. i often read posts about peoples experiences with police, and i wish i knew all this stuff sooner because it would have saved me a lot of hassle on the last few years.

Matt, your situation makes me angrier than the original poster's case. It's complete BS that you have to sack a HWP officer to get justice, which would be a pain in the arsecrack as it is, and then forever put up with his mates who, i can imagine, pick on you every chance they get.

We all know it's because they can. They're there to enforce the law. Not play games with their authority. It makes me fume.

Any chance you don't have stock wheels on mate? If your profile is not correct, this would throw out the speedo and the speed you think you are doing is not actually correct. Not much difference between 110-122 if this is the case.

Not saying the cop was correct, but have you thought about this scenario? That you were in fact doing that speed and just didn't know it? I know we always firstly jump to the conclusion that cops suck, but just have a think about it for a sec and rule that out.

Speed matching at 60 is not going to be the same at highway speeds, get it checked, or post up your wheel/tyre sizes and someone smarter than me will be able to tell you if this is the case.

ive got 17's, F 235/45, R 255/40. this is a very good point you make, you might be onto something.

i think 40 and 45 refer to the mm measurement of the sidewall, therefore:

rolling circumference =

F 1.642metres, R 1.611metres.

i have measurements inside my door, which i assume may be stock. 16's, F 205/55, R 225/50. rolling circumference =

F 1.452metres, R 1.436metres

you are definitely onto something. stock at 110kmh...

=

F 124kmh, R 123kmh (with 17's sizes)

Cops look after their own. Unless the cop does something completely out-of-culture (like interfering with children), it won't matter what the cop does. His colleagues will rally around him since they realise it could be them one day, and "take care of things" in any way they can.

If that sounds like something mobsters or gang members do, well, you know.....

The 40 and 45 are percentages of the width of the tread of the tyre, so your front profile is 45% of 235mm, and your rear profile is 40% of 255mm.

THANKS! i checked that site, you are quite right. the new calculations mean that stock wheels travelling at 110kmh, translate to:

F 114kmh

R 113kmh

based on my 17s.

therefore im still right and the copz can munch on my ass! (as long as they dont enjoy it too much)

    • Seat of the pants assessment of the new intake: The car is way less "doughy" when hitting the loud pedal, especially off idle when stopped or in traffic, I did use a cheapo lazer thermal thingo to measure the temp around where the pod filter got its air, it was between 55 - 60°C, in saying this the car was shut off and not moving, so the OEM intake pipe was not supplying any fresh air to where the pod was when the car was at least moving A weird bonus was induction noise on the throttle in the cabin increased a bit,  I was worried that I was actually going to lose some of that induction noise I love so much, outside though, when I got the daughter to do a WOT drive by pass for me, the induction noise has increased alot when on the throttle, not quite ITB doort, but well up there I'm extremely happy with the results and have been exploring the country roads in the region  As for house mods: 1.New front fence is up and is awesome, it really upgraded how the joint looks from the street, and the added security is nice 2. Electricians have replace some interior lights, and with more lighting in the garage, a few new motion detecting lights out the front above the garage, front room, and at the front door, which I have already found heaps helpful coming and going, also now has fancy pants CCTV all round the house The only hold point for power though is the solar and batteries due to supply issues, although this will happen over the next few weeks 3. I have done a heap of landscaping out the front and I'm almost ready to do a new small retaining wall with some nice blocks to replace the brick and cemented in rocks around the raised garden beds cemented in river stone "was the fashion at the time" the house was built. I currently have a pallet of retaining wall blocks and 2 bulka bags of 20mm blue metal to replace the wood chip that is in the raised garden beds around the house 4. I now have 3 big raised garden beds for out the back to grow some vegetables, about 70cm high, 200cm long and 100cm wide 5. My 2 compost bins are already pretty full with brown, green and kitchen waste from the landscaping I'vedone so far, but they will probably take a few months to break down, so anything else that gets chopped, trimmed, and kitchen waste will just start filling the base of the raised garden beds to about 30cm before I start throwing 40cm of good compost, and stuff, for the vegetables to grow in, I'll need a few ton of compost and soil, but the local supplier can sent me bulka bags of the stuff Basically the logs, wood chips and a few strategically placed rocks for drainage, will give the beds some good organic materials down low to break down over time, and they will hold moisture during the warmer months to save the water in my big arse water tank if we don't get alot of rain So, all in all, the car and house mods are going well, and I'm really enjoying being retired, I sleep in too 0700 and slowly plod around inside until I feel like actually doing anything, and only work in the yard for as long as want, which has actually been alot over the last few weeks,  although when you look at it, it seems that not a huge amount of work has been done,  until I look at the before I started the work pics Happy days and good times indeed
