Hit a pedestrian Friday night on Toorak Rd

Recommended Posts

Friday night at around 10ish pm I turned left off chapel street onto Toorak Rd.. few blocks down (out the front of lotus) a lady that was walking across the road stepped out in front of my car at the last minute.. I broke to try not to hit her but it was raining and she only gave me about a meter to try stop b4 hitting her..

So as the topic says I ended up hitting her as my front bar and driver’s headlight took out her legs she came flying up my bonnet and into my windscreen smashing it instantly and sending small pieces of glass into our faces and blocking my vision making it even scarier.. as I came to a stop I saw her out my driver’s window falling from the top of the windscreen off to the drivers side and taking out my side mirror .. my 2 passengers and myself got out straight away and called the ambo’s (who got there really quick). With some help the lady was taken to the side of the road and seated while we waited for the ambo. She was taken to hospital so I have no idea still how she is.. cops arrived and statements were made.. there was a couple of witnesses to the accident and they said I wasnt doing anything wrong (which I wasn’t)

So my car was towed to a storage place until the sat morning when it was towed to my panel beater and I still know nothing..

So this all happened Friday night and I still know nothing but that chick must be hurt in some way after all she did get hit at just under 50k’s an hour her shoulder busted my windscreen and she dropped from roof height..

Damage to the car didn’t look good either.. busted my front bar in half, cracked the drivers headlight, my bonnet didn’t open easy so im guessing that’s warped, smashed windscreen, busted driver’s mirror. Ill go down to the panel beaters tomorrow and get some pix and info on damage and post an update.

Any1 ever been in or heard of the same sort of thing? I would like any info

Just becuase you hit her doesn't make it your fault.

Happenned to an old school friend ages ago and he made her pay for repairs.  SOunds slack but why should you have to pay for her mistake.

yeah that's what my panel beater said.. as long as she doesnt make up any stories i should be allright.. it looked like she was on the phone when she stepped out.. she was prob worried about getting her hair wet too.. anyways im off to the panel beaters now to get some pix and info.. hope she's allright

Hey there.

I'm not sure of the legalities of it all, but just be very very careful.

Don't say anything and don't do anything, and if I were you, I'd go and get PROPER LEGAL ADVICE. Not any of us saying things about things that might have happened before, get advice from a lawyer.

Like the childrens court is always biased towards the mother, road laws are biased towards the pedestrian. And a young driver in a Skyline is like a red rag to a bull if you get the wrong judge or copper.

I wish you the best of luck with it, but make sure you get some proper legal advice ASAP.

BASS OUT

Yeah as Bass Junky said just be careful of what you say and stuff.

Cause last time my my hit this guy running across the road and it was totally his fault. He was apologying and stuff and said he will pay for the damage. He also substaine an injury to his wrist and the car bonnet was scratch and dented.

Later on he denied everything and wanted us to pay for his injury and saying it was our fault. But lucky my mum had witness from the local shops so things got sorted out.

But good luck to your car and I hope the lady was not too badly hurt. It would be good to find out what happened to her. Cant' you check with the police that took your statement down?

Cheers

iv tried a couple of times to find out how she is now.. saturday morning after not sleeping the best i rang in the morning and spoke to the cop in charge and he said he was busy and he'd call me back.. i left it a couple of hours and called back only to find out he had gone home and no1 else could help me.

i just got back then from going to the police station and was told he's working atm but hes not at the station and they took my number and said they will call me back when he gets back in

also went to the panel beater and took a couple of pix of the car

also any1 know of a place to buy new or close to new head lights for a good price?

im guessing this is going to be the most expensive part of fixing as im going to need 2 so they look the same and not 1 faded and 1 new

The same thing happened to me a few years back on a Friday raining night outside Q Bar which is pretty damn close to where you were. FREAKY!!

Anyways, I was heading outbound down the hill on Toorak Rd doing bout 50 coming up to the lights and a few guys stepped out infront of a parked taxi and saw me coming so they stepped back. Before I knew it, a chick had tried to bolt across the road and ran straight into the side of my car and hit the A piller crashed into my windscreen which spiderwebbed nicely. The momentum of the car carried her all the way into the middle of the the Toorak Rd and Chapel Street intersection where she rolled off and I braked hard swerving to the right and stopping 2 ft from the traffic lights and barrier infront of the NAB.

She was taken off in an ambulance to the Alfred with a concussion and a few broken ribs and collar bone.

After witnesses were questioned, statements and breathaliser tests taken I was allowed to leave without a hassle.

I called the Alfred on the Sunday and they said that she had been moved from ICU to a recovery room and she would be fine.

About 2 weeks later, I received a phone call from the RTA saying that this woman was going to sue me for damages as she thought it was my fault. Feeling kind of confused about the whole thing as to how it is my fault that a pedestrian had run into my car was beyond me but the RTA said that they wanted to represent me and also advised that I counter-sue as the woman had tested .19 BAC and also had traces of prohibited substances in her body when she got to the hosiptal.

Needless to say that the case didn't make it to court as I think she realised that she was gonna come out of this one second best and would have to pay for the court costs as well as repairing my car.

I got rid of the car a couple months later as it was a really bad memory I didn't want anything to do with anymore. Even though it was entirely her fault, the fact that you have hurt another person in that way is quite disturbing.

SKYL9, I hope it all works out for you.

Leewah good to hear things worked out for you and i think that would have to be the first time iv ever heard anything good about the RTA. i thought of ringing the hospital but i dont know where they took her or even her name.. i know nothing atm

Generally speaking, if the accident occured in Sth Yarra, the pedestrian would have been taken to the Alfred as it is the closest.

If you got their name, you can just ring the hospital, explain the circumstances and get a condition report.

    • Assuming the current ECU is stock, it might be worth getting hold of a nissan data scan cable. It could be as simple as voltage at the ECU
    • You need to test for spark when it matters - ie cranking. Kill the fuel supply, pull a plug and earth it, set up a camera and go crank. The spark needs to be consistent, every other turn of the engine. Not some sputtering of occasional spark. The reason I say this is because spinning the CAS in the air is not the same as spinning it installed, and if there is a bearing problem in it, the disk might work differently in the air than in the engine. You won't want to try to set the timing unless you know the spark is happening right.  Also, reconsider running the R35 coils against the stock ECU. They like a different amount of dwell cf the originals. It's not massive, you can actually run them, but it is better if you can adjust the dwell (which you can with Nistune in the stocker, or with an aftermarket ECU). Besides any of that - when you had the multimeter out, have you got power where it needs to be, earth where it needs to be (and when, in the case of igniter triggers), etc?
    • Apologies for the long post, but needed somewhere to lay out the entire timeline of events and actions taken:   I've got an 89 GTR with a R34 RB in it. It's been running great all year, driven probably 500KM in the last month. It's not my daily driver, just a weekend fun car.    Build info: R34 RB26 - HKS 2.7 stroker kit, HKS adjustable cam gears, HKS turbo upgrades, Trust intercooler, R34 factory DENSO 440cc injectors, JUN chipped/tuned R32 ECU. All of this work was performed in Japan back in 2019.    Thursday 10/2/25 - It's a nice day and decided I'll drive it to work, I start it up in the garage and I notice it took a few extra cranks and sounded a bit funny. I figure maybe it was just because it was a pretty chilly morning. I pull it out into the driveway to warm up a bit before leaving. As I leave the driveway, it feels very off and sounds like a misfire. I pull it back in the garage to deal with after work and take the daily to work. I was able to diagnose it as a cylinder 5 misfire with the old spark plug test (unplugging each plug until a sound change with the engine running). I take off the whole ignition system, ignitor, plugs, spark. *Important note, it is still on the R32 ignition system with the separate ignitor system. I test each system with a multi-meter and nothing presents as a smoking gun. I put it all back together and it starts up no issue. I go ahead and order the PRP R35 ignition conversion kit. It should arrive today (10/13/25)   Friday 10/3/25 - Another nice day, car starts up great and drives great all day. Very pleased that everything seems to be OK   Sunday 10/5/25 - Decided I'll take it to play some golf, load up and drive to the course about 25 minutes away. Drives wonderful the whole way there, I pull in the parking lot and the engine completely comes to a stop. I do not recall if it sputtered at all, but just remember all of the sudden the engine was off. I roll it into a parking spot, try to crank it back on and nothing.  It'll crank and crank and not even try to start. End up getting it towed back to my house and push it up into the garage.    Items I have checked: Fuel in the tank Fuel Pump relay Fuel pump fuse  Spark Plugs & gap Coil packs Ignitor    I know the cylinders are getting fuel as the plugs smell like fuel after a start attempt. I tried spraying starter fluid into the manifold and cranking and not even a sputter.    I decided to do the live CAS test (removing the the CAS, ignition on and spinning the CAS stalk to see if the injectors pulse and spark is active). All of the injectors were pulsing and I have spark at the plug. The half-moon end of the CAS did seem very loose, I'm not sure how much play is supposed to be there, but it was more than I expected. There was no in/out play of the shaft, just the tip end that is pinned on had quite a bit of play.    CAS Play video   When I put the CAS back in, I stupidly did not re-time the engine. I know I need to do that tonight, however, I do not think it will start given it seemingly was not the issue. My plan is to do the PRP R35 coil kit and retime the engine at the same time.    I plan on ordering the Haltech Nexus Plug-in ECU once they are available again, but ideally would like to get this sorted before firing the parts cannon at it and potentially adding more variables.    Anything glaring that I am missing here, I'm a bit at a loss?
    • Get it on a dyno. Get something logging Consult. Run it up and find out what is causing it.
    • Looking for a plenum for rb25 de+t neo  Not looking to push much power maybe 300kw at the wheels, is there much difference in flow for Freddy “Greddy style” compared to original Greddy or options like Proflow or Otaku garage?    I won’t be porting the de Neo head for now as I think it’ll be fine 280-300rwkw but appreciate the help and any experiences anyone has between them and any advice. Thanks  Looking at this plenum for now below
