heyall.

I got done speeding (128kmh) in NSW by a pursuit car with radar. I didnt see the readout and the conversation was recorded.

The officer also defected my car for 3 days in which I had to repair the defect and have it approved by the RTA.

My speedo was removed for repair at the time and I was driving the car to a mechanic to have the speedo re-installed. I had it repaired, installed and approved with full documentation.

About 6 weeks later I was done for speeding in Vic doing 123kmh when overtaking some moron who decided to speed up in the process ( I couldnt back off as there was an oncoming vehicle and I HAD to overtake to survive!!)

I have never been done previously for any driving offences. I have held my license for approximately 8 years.

I would like to know if it is worth me pursuing these in court and if so, what would be the best way to do this for the best possible outcome.

The first one where you were driving around with no speedo is your problem coz you should have been driving slower than other cars since you didnt know what speed you were doing.

The second one depending on the circumstances and road / speed limit you were on you may have a chance in court. This one needs more information

I don't think this story will get you far in court...unfortunately.

I've always wondered if "self defence" is a reasonable cause for speeding?

Although if you can't prove it you're probably ****ed. If they can produce the picture where you are along side the other car though, that might work. You could prove that if the other car is keeping pace then he is speeding too.

where did he say he drove without a speedo you moron?

dude, just bend over and take it. You are in the wrong on both occasions, if the other guy sped up, you should have slowed and pulled back in behind him.

No court will take that excuse

I couldnt have pulled behind the car as there was no room - I had to accelerate to get past.

But princess highway is a 80km/h zone.

Doesnt seem that you have any proof about having to accelerate to avoid a collision?

princes hwy has many zones - I was in a 100kmh zone at the time.

I dont have any proof of overtaking to avoid a collision??? How can you prove such a thing??

Sorry to hear bout it - but prepare to get reemed. Dont bother going to court because you will only get reemed harder and be up for more costs. First case with the speedo that will be your fault 100% so you cant challenge it. The second one you cant prove anything and dont think the cop wont make up a story about it if he knows its going to court - what cop wants to be proven wrong? The police prosecutor is a total fagget as well.

In the overtaking case you can claim self defence and it is then up to police to prove it wasn't. After the case with the motorcycle they will be a little more timid as the magistrate was pretty pissed that they pursued it. Talk to a lawyer but you should be able to defend yourself. As for the other one, you may have some difficulty and it would cost an engineer from MU automotive area.

    • I'm normally copping my own abuse from neglecting my daily drivers. "Those suspension bushes will last a bit more", "Don't worry about the oil leak, just keep topping it up". The project cars I'm always doing things slowly on them as I'm wanting them to be done better, and neater, and nicer. Luckily I don't have to deal with 18 year old Matt's "Learning to wire" stuff in the project cars. And there's only one piece of wiring I'm displeased about in the Landcruiser, and it's about to be cut out... However, the box loads of parts that have been going through this place lately for the Landcruiser... Brake pads Brake Rotors Full handbrake overhaul Wheel Bearings Seals Swivel hubs Steering Boxes Half the suspension joints Shocks Air bags (Ones to go in the rear springs for towing) Water pump Timing kit Lower timing case Harmonic Balancer Radiator Lots of other little seals and shits Gas struts for the bonnet New power window switches And god knows what else I've forgotten... Ha ha ha I have my fingers crossed the pinion seals don't start leaking on the diffs, that the transfer case doesn't leak, and the gearbox input shaft doesn't leak, nor the rear main seal. As they're about the only seals I haven't replaced in the driveline! I'm seriously eyeing off buying new caliper rebuild kits front and rear brake calipers... I'll probably recheck all the valve clearances soon too, and hopefully, it should be all good and sweet to haul some long distance trips again!
    • Every time I pull my 3x gauges out of the console and see the crack-addict way that I did the wiring, and I just can't bring myself to tear it all apart and "make it nice", because it is currently working. In fact, the last time I was in there I probably made it worse.
    • The best part is when you own the car long enough that you look back and find your OWN ham fisted amateur shit!
    • The annoying part about neglect, is when you start to replace one thing, and find ten more broken things. Ham fisted monkey repairs you normally only find out about when trying to do something unrelated! Ha ha   Neglect you can kind of anticipate the huge costs to fix it all. Ham fistedness is normally a shock the first time your work on a new old car, as everything "looked" good before.
