If I am reading correctly the supplier already has our money therefore payment has been made. Can you confirm this Andrew? If this is the case, when was the remaining balance transferred to the supplier?

Mate if it comes to the crunch I"m willing to fork over the extra cash, I"d rather have the thing in my car than squabble over coin.

I think you"ll find that cause the amount wasnt paid in full old John Wayne does have a rotten leg to stand on. Unless he has sent you an invoice at any stage I dont think emails mean shite!

I lost on the exchange cause the oz dollar was strong ...whatever way its up to you guys but me, like I said I"d rather have a bullet proof tailshaft plus its still cheap as chips..

if that's the case, whatever the $AU was doing at the time the balance appeared into his account is the rate at which the transaction is made.

Only other alternative is to either hope for a full refund (doubt it if they're already made) or haggle on the extra $$........he may be reasonable and meet you part of the way (even if he does sound like a hard ass)......goodluck guys.

Actually, an email constitutes and "offer", and payment constitutes "acceptance, with a "consideration" of a future payment as stated (I assume) in the email offer from the supplier.

This is a legally binding contract.

I'm not paying one extra cent. I'll either have the shaft or my money refunded.

Andrew, I suggest calling the ACCC for advice, and then lodge a complaint with the Department of Fair Trading.

hey Willo. we had to go through the aussie (StS) distributor, who is causing all this drama.

the supplier (Acpt Usa) does not have the balance yet..

but yes i agree, i'd rather pay this now and work out what to do with it later if anything is to become of this.. at the end of the day it still is and was a good deal!

I'm waiting on the Balance owing to Sts... and a reply from Acpt also..

Sorry, I've been referring to StS as the supplier and ACPT as the manufacturer. If StS have taken funds for the full amount then payment has been made.

As Merli stated, a written quote even via email constitutes a contract. If full payment has been made to StS as the supplier for this group buy, the terms of the contract are binding.

To quote the Fair Trading Act 1989:

Section 46 (1)

A person shall not, in trade or commerce, advertise goods or services for supply at a specified price if there are reasonable grounds, of which the person is aware, or ought reasonably to be aware, for believing that the person will not be able to offer for supply those goods or services at that price for a period that is, and in quantities that are, reasonable having regard to the nature of the market in which the person carries on business and the nature of the advertisement.

If StS knew they could not supply for the quoted price if there were changes in currency exchange rates the offer should not have been made. Having dealt with ACPT before it is reasonable to expect that StS should have been aware that prices from ACPT are subject to shifting exchange rates. As such the price should have been quoted in USD or the quote given as an estimate subject to the exchange rate at the time of payment.

i'm getting frustrated with this all. I just want the shaft, I'll pay the dollar difference on my item. Andrew can you send me the banking details please and the contact as to who I have to pay etc.

Ok guys so going through the emails, Nathan "willo" has found a problem. and it looks like we will have to pay more.

Paul is doing his best to get the price down as good as he can, he is working on a better way to post the items off as he thinks Acpt have been paying too much for postage.

it should only be an extra 100 dollars.. or there abouts! which i am sure all of you can afford...

i'm sorry this couldn't have been bought to our attention earlier.. but its rather hard when juggling two email address on 3 different computers.

I have just started going through the emails, and the first one that I opened contained this:

That is correct $1,400.00 in Australian dollars delivered, not US Dollars. I can arrange for these to be delivered individually to each buyer.

We need 5 to get that price, but 7 is even better. If we had 10, I could ask for a bit more to be shaved off.

Re payment, if it would be suitable to you and your members, payment could be made over either 2 or 3 months, with the shafts being made during that time, and shipped when the final payment was made. I have found this to be acceptable to other clubs I work with. This may help you get more involved or solidify the ones already interested. Sometimes $1.400.00 is a lot to find at one time with all the other mods guys want to do, so the payment plan can be a good option. For example a deposit up front of $400.00 would seal the deal, and another payment the following month of $400.00 with a final payment in the 3rd Month of $600.00.

That is a very clear written offer of supply of product at $1400 total, to be paid in installments of $400, $400 and $600.

Phwor... good job Merli - that seems pretty damn clear to me! SURELY he can't argue when he's written something as explicit as that!

Silly boy he is for saying something like that really - he only has himself to blame..

I'm not even getting a shaft, but if he'd written that to me I'd be quoting it back to him and expecting $1400 and nothing more..

If he hadn't written that?.... I'd probably just be annoyed but pay the extra $100 bucks...

There was also a bit of communication thru my work email, but unfortunatly during this time my webhost changed servers and i lost all of my emails,

i believe there is one in there where he replied to both emails of mine and it clearly states that fluculating exchange rates will cause the price to change.. you will find that email about halfway thru the lot, i think the first one with an attachment. it is also not written in the main body you need to scroll down to the first reply to view it.

which is why i also kept missing it while searching thru them..

but dont worry guys, Paul is working on it as best as he can to keep the extra cost down :D

If its 100-150 more i'm sure all of you can afford this.

i copped the intrest :)

and it was only on 10480 as the first 6000 was sent right away.

and it was around 40-50 bucks. which i get taxed on.

This was also in one of the emails (I hope you don't mind me posting it, Andrew):

The only proviso is if the AUD drops dramatically against the USD before payments are received. I have shaved these prices very close, and if the AUD drops too much I am out of business on this one. I cannot see it happening and all the economists tell me it won't but I need to cover my behind........LOL

The final amount was transferred to StS on Sep 1st (I believe) when the dollar had dropped to 84. The best we can hope for is to have our funds at the 1st Sept rate meaning we are $1153 ($96 each) short instead of $1572 ($131 each).

    • Very good news...I contacted Racebox about it last night. My car is a 2016 so remains to be seen if it is compatible, requires a TCU swap, or is impossible.
    • What ECU are you running? This is probably the biggest question. If it's a PowerFC, I'd probably change the ECU and get something newer that will handle the injectors in a nicer way.
