hey every1

im posting this on behalf of a close mate , which recently has been ripped of by a possible forum member .

the story is as follow

On the 12/5/09 Barthnolomew Gaszewksi sold me a Mazda 323 ss Familia Turbo. We purchased this car off his ebay account power_fit , which he specializes in used tyres , and drift tyres etc etc . When we went to look at the car inspect it ect.

He told us there where no defects on the car and he even signed a letter saying if defects found on the car that he would return the money.

One week passed by and we went to put the car into our name, as we got to the RTA they told us that the car has various defects on it and rego as been cancelled till the defects are cleared and sorted. We now tried to call him and notify him of what the RTA had told us.

He believes he did not get any of the FIVE letters EPA and the RTA sent to him and saying he does not know about any defects .

after trying countless times to contact him , we finally get threw to him , because i really wanted to keep the car , so i wanted 2 sort out all the problems with the car .he told me he had no idea about the defects this and that he then promised me , he would pay 4 this and pay 4 that , and that he had friends that could fix it for 200bux etc etc , heard all the stories and excuses under the sun , but no results , then it gets better , he turned off his phone and did not aswer any of my phone calls or reply 2 any of my msgs

The RTA told me that the defects happend in his name on November 08 and the rego go cancelled in march 09

I did a bit of research into it and alot of stuffed turned up on him.

Like he did'nt change his adress with the RTA , he did recieve all the defect notices , which he ignored them , hence sellin the car cheap ect.

I continued to messege him stating that i would like full refund back on the car, He messeges me back saying, that the address where he we picked up the car from

was his mates place where he stores all his stuff and that he is Brisbane for 4weeks on a work trip but when i bought the car he told me he does not have a job.

Me and one of my friends decided to go to the adress where i picked the car up from, we found out that he lives there, he does't work, he lives with with his perents

and that he is still in SYD, he was just trying get his way out of it and think the problem would just go away , its now clear that he obviously new there where defects on the car when he sold it .

I have been to Fair Trading, Police, Legal aid none of them can help me out because it is a cival matter.

That night i went to his house we got pulled over by under marked high way patrol Police office and he told us that the car is full defected and he told us the correct address

of Barthnolomew Gaszewksi . The Police office also gave me other solutions i could do to get my money back.

Ive have just come back from the court to fill out a Trade Rights aplication and deliver it to his house and he has 28days to show up other wise he gets arested and held in

custodyuntil court date. which they told me

so in the meantime now , im stuck with a completed defected car , with cancelled rego , and a prick of a seller runnin away from me .

any 1 no this guy? apparently he used 2 own and drift a white s14 , lives in the collaroy area . and sells tyres and bike stuff on ebay under seller name power_fit .

please be aware of this dishonest prick

he may be a dishonest prick but ur an idiot for not checking the car out in a suffecient matter,

i know what u r going thru as i have also been f**ked over by someone by buying an r32 gtr that was uncomplied and had actually been written off.

u cant trust no one in this world mate triple check everything.

even if they do lock him up u still probs wont get ur money back u know that right might as well start getting it all fixed up

my friend did , his only 16 and its his 1'st car , so thats y i want to see what other ideas ppl have , and ill take it from there .

You need to purchase a certificate of registered security interest for the car - not just check it. When you get this certificate for the car you can then use that against your RTA and it should guarantee you immunity from financing, write offs, defects or any other negative status already attached to the vehicle - provided you purchase the car within 24 hours of obtaining the certificate. That's how it is in Victoria anyway.

If it's anything like SA (and I presumed this would be the case Australia wide) a car cannot transfer ownership until the defect is cleared.

Regardless, the only way to deal with it now is through the Small Claims Tribunal in your state. After that, your mate is pretty much screwed, although he will have learnt his first lesson - if something sounds too good to be true, it usually is...

It does if you check with the VIN/Chassis #

You should never check with the rego... To be honest, its no-ones problem but your own.

Responsibility of the BUYER is to check BEFORE purchase and (best of my knowledge) the RTA or whatever body will give you a print out/notification that there are ZERO issues for future reference.

At least they do here in Vic when you run a check against the VIN!!!!

For Victorian members, when purchasing a car you can do an online check via the Vicroads website based on their registration alone. However, you need to purchase a certificate if you want the information to be guaranteed.

Should have REVS (Register of Encumbered Vehicles) checked it bud. If he has signed a document stating he will give your money back I would seek legal advice and have a solicitor write a letter of demand for your money back, may not be enforceable if he denies signing it, but a legal letter will soon let you see if he is a proper shonk or not. If he tells you to piss off then he has probably done it before and knows just as much about the law and how to get away with this type of rip off than your solicitor. Also, not a good idea to say on a public forum that a police officer has given you this guys current address, they can get in serious trouble for doing you a favour like that. Good luck with it.

Yeah could a moderator please clean up the part about the address / police officer? I once had a hit and run done on me, officer couldn't give me their address because of privacy act (despite having the information on screen) and consequently they got away with it. Wouldn't like to see these kind of favours discouraged in anyway...

Did this guy also take advantage of a kid by selling him a car he can only drive for a year, and then he'd have to sell it or stick it in storage for 3?

that sucks man, the youngens are just so eager to get thier baby and be in it driving that they forget people are out to ripp you off,

there are still descent people out there who will be honest hard to come by though. :(

    • My guesstimate, with no real numbers to back it up, is it won't effect it greatly at all.its not a huge change in position, and I can't see the air flow changing from in turbulence that much based on distance, and what's in front of it. Johnny and Brad may have some more numbers to share from experience though.
    • Which solenoid? Why was it changed? Again, why was this done? ...well, these wear..but ultimately, why was it changed? Did you reset the idle voltage level after fitment? I'm just a tad confused ~ the flash code doesn't allude to these items being faulty, so in my mind the only reason to change these things, would be some drive-ability issue....and if that's the case, what was the problem? Those questions aside, check if the dropping resistor is OK ...should be 11~14 ohms (TCU doesn't throw a flash code for this) ~ also, these TCU designs have full time power (to keep fault code RAM alive), and I think that'll throw a logic code (as opposed to the 10 hardware codes), if that power is missing (or the ram has gone bad in the TCU, which you can check..but that's another story here perhaps).
    • Question for people who "know stuff" I am looking at doing the new intake like the one in the picture (the pictured is designed for the OEM TB and intake plenum), this design has the filter behind the front bar, but, the filter sits where the OEM duct heads into the front bar, and the standard aperture when the OEM ducting is removed allows the filter to pulled back out of the front bar into the engine bay for servicing, a simple blanking plate is used to seal the aperture behind the filter This will require a 45° silicone hose from the TB, like the alloy pipe that is currently there, to another 45° silicone hose to get a straight run to the aperture in the front bar Question: how will it effect the tune if I move the MAF about 100-150mm forward, the red is around where my MAF is currently, and the green would be where it would end up Like this This is the hole the filter goes through  Ends up like this LOL..Cheers    
    • Despite the level up question, actually I do know what that is....it is a pressure sender wire.  So check out around the oil filter for an oil pressure sender, or maybe fuel pressure near the filter or on the engine. Possibly but less likely coolant pressure sensor because they tend to be combined temp/pressure senders if you have one. Could also be brake pressure (in a brake line somewhere pre ABS) but maybe I'm the only one that has that on a skyline.
