hey guys, to cut a long story short i was pulled over last night and accused of doing 107 in a 70 zone which i know i wasn't doing. The police had a hand held radar and were hiding on the opposite side of a large 4lane road. There was another car that sped past mine in the exact spot he has accused me of speeding in. When i was pulled over i had asked to see the radar reading which i know he isn't legally obliged to show me but he said he couldn't because as he was getting into the police car he "accidently bumped" the radar gun and it cleared the reading. How is it that he can book me for speeding without any proof? He says he had the alleged incident on video, does this show speed if it's on video? I will be going down to the police station to see the video anyway. Also should probably tell you that he was hidden over the crest of a hill with no lights on. Is there anything i can do or is he legally allowed to book you with no proof? Thanks guys.

Did you get a written fine on the spot? or did he tell you he is going to send you one?

The only ways you can get out of it, if you honestly weren't speeding are one of these.

1 - Write to the address on the fine and explain your story. This is probably unlikely to get you off but doesnt cost anymore than a postage stamp.

2 - Opt to take it to court on the back of the fine. I'd suggest getting some legal representation for this, as in court the magistrate and DPP can be very pushy and daunting. You then have to prove that you were not speeding.....i.e. show with proof (or by showing doubt in the fact) that the cop had made a mistake

Importantly, write down your version of the story ASAP so you don't forget any details if/when it finally goes to court.

thanks for the advice. I wrote down my version of events as soon as i got home so all the details were spot on. I will be making an appointment to view the "footage" at the police station, if it is shown that there is no hard proof of the incident can they revoke the penalty? I've never been done before and fined on the spot so i'm just confused.

Also, if you've got a good driving record, you *MAY* be able to either get out of it with no recorded fine/conviction.

Please note, I did say *MAY*...

But, yeah, get some legal advice to clear it up.

**UPDATE**

I went to the police station tonight to view their evidence of my breaking the law.

All that the video footage shows is a group of cars driving past the police vehicle on the other side of the road.

There is no proof of speed, nor speeding or breaking any laws.

The cars featured in the footage are all travelling in a group (I do not know these other cars).

So basically, there is no proof of speeding and why the officer singled out my vehicle I'm not sure.

Probably as it's the only one with P plates on it (It's n/a & legal)

WHat do I do now :)

I think all you can do is really just ask the question, how do they determine which car was travelling at what speed? Like in a completely non-smartass way, ask the question and let them know you're unsure how it works.

If there's a laser-lock or something, you're screwed, but if all they have is a bunch of cars driving along and they've gone BAM it's you, then that's just not right.

Is there a speed on the video at all? If the gun they have has lost the reading because of being "bumped", they don't have a shred of evidence to say how fast you were going. As long as you're sticking with the crowd and not accelerating past them, you should be sweet.

There is no evidence of speed what so ever because the radar didnt lock in the "supposed" speed I was doing because he bumped it.

The video shows a group of cars drive past, all travelling at what appears to be similar speed... nobody is accelerating past anybody else.

Yeah, unfortunately he said it's based on what the cop "saw". So his word vs yours, basically.

The only way you're gonna get anywhere with this is in court. If he hasn't locked in the speed....

Only problem is court fees can sometimes cost more than the fine, which is bullshit. They waste your time, then you have to pay to make your name good.

I'd take it to court if time permits.

If you represent yourself, and it goes against you on a copper's word, the court cost isn't that great.

I'd try and get the question subitted as to what speed the HP officer thinks you were doing & where's the proof?

If you take a legal rep (solicitor) and lose, the solicitor's fee costs more than court costs.

You MAY still get off due to a good record in which case the fine MAY be waived BUT you may still incur points.

If you take a legal rep along & win, you lose no points, there's no fine; but there's the solicitor's fee.

So by the cops reasoning, the entire group of cars must have been doing 107, if the whole group are clearly shown in the video going at the same speed.

That just seems strange to me... not very often that a bunch of cars who do not know each other all decide to do 37km/h over the limit :)

Seems a lot more likely that you'd all be doing very close to the actual limit..

Maybe you could mention that in your defense if you fight it?? How fast so you think you were going? Like 80 or something? Maybe he was trying to get you to admit to speeding by accusing you of a higher figure?

i spoke to my lawyer today who i will be speaking to properly at his office. He seems to think they have little chance of winning if i contest it in court. The court fees and solicitors fees don't really bother me, it's more so to prove a point that he should NOT be able to do this.

Just curious - are you on your Red or Green p's?

From what you have said, it looks like you have a good chance winning in court due to the lack of "proof" and the fact that all these things are taken into account

1) "Bumped radar" so no speed (I know that this does genuinely happen though.. and is quite common).

2) Footage - group of cars.. no direct speed/proof you were doing x speed.

AFAIK a HWP officer is trained to "determine speed". And this is permissable in court. So if you drive past a HWP cop who has no radar/lidar evidence etc they have been 'trained' in determining speed.

I guess this factor, and at the end of the day its your word vs the cops are the only downfall... IF you do fight this, definitely use a Solicitor.

I regret never fighting my 1st speeding offence.. still makes me angry to this day lol.

    • Update 3: Hi all It's been a while. Quite a lot of things happened in the meantime, among other things the car is (almost) back together and ready to be started again. Things that I fixed or changed: Full turbo removal, fitting back the OEM turbo oil hardlines. Had to do quite a bit of research and parts shopping to get every last piece that I need and make it work with the GT2860 turbos, but it does work and is not hard to do. Proves that the previous owner(s) just did not want to. While I was there I set the preload for the wastegates to 0,9bar to hopefully make it easier for the tuner to hit the 370hp I need for the legal inspections that will follow later on. Boost can always go up if necessary. Fitted a AN10 line from the catch can to the intake hose to make the catchcan and hopefully the cam covers a slight vacuum to have less restrictive oil returns from the head and not have mud build up as harshly in the lines and catch can. Removed the entire front interior just shy of the dashboard itself to clean up some of the absolutely horrendous wiring, (hopefully) fix the bumpy tacho and put in LED bulbs while I was there. Also put in bulbs where there was none before, like the airbag one. I also used that chance to remove the LED rpm gauge on the steering column, which was also wired in absolute horror show fashion. Moved the 4in1 Prosport gauge from sitting in front of the OEM oil pressure gauge to the center console vents, I used a 3D printed vent piece to hold that gauge there. The HKB steering wheel boss was likely on incorrectly as I sometimes noticed the indicator reset being uneven for left vs. right. In the meantime also installed an airbag delete resistor, as one should. Installed Cube Speed premium short shifter. Feels pretty nice, hope it'll work great too when I actually get to drive. Also put on a fancy Dragon Ball shift knob, cause why not. My buddy was kind enough to weld the rust hole in the back, it was basically rusted through in the lowermost corner of the passenger side trunk area where the wheel arch, trunk panel and rear quarter all meet. Obviously there is still a lot of crustiness in various areas but as long as it's not rusted out I'll just treat and isolate the corrosion and pretend it's not there. Also had to put down a new ground wire for the rear subframe as the original one was BARELY there. Probably a bit controversial depending on who you ask about this... but I ended up just covering the crack in the side of the engine block, the one above the oil feed, with JB Weld. I used a generous amount and roughed up the whole area with a Dremel before, so I hope this will hold the coolant where it should be for the foreseeable future. Did a cam cover gasket job as the half moons were a bit leaky, and there too one could see the people who worked on this car before me were absolute tools. The same half moons were probably used like 3 times without even cleaning the old RTV off. Dremeled out the inside of the flange where the turbine housing mates onto the exhaust manifolds so the diameter matches, as the OEM exhaust manifolds are even narrower than the turbine housings as we all know. Even if this doesn't do much, I had them out anyways, so can't harm. Ideally one would port-match both the turbo and the manifold to the gasket size but I really didn't feel up to disassembling the turbine housings. Wrapped turbo outlet dumps in heat wrap band. Will do the frontpipe again as well as now the oil leak which promted me to tear apart half the engine in the first place is hopefully fixed. Fitted an ATI super damper to get rid of the worn old harmonic balancer. Surely one of the easiest and most worth to do mods. But torquing that ARP bolt to spec was a bitch without being able to lock the flywheel. Did some minor adjustments in the ECU tables to change some things I didn't like, like the launch control that was ALWAYS active. Treated rusty spots and surface corrosion on places I could get to and on many spots under the car, not pretty or ideal but good enough for now. Removed the N1 rear spats and the carbon surrounding for the tailpipe to put them back on with new adhesive as the old one was lifting in many spots, not pretty. Took out the passenger rear lamp housing... what do you know. Amateur work screwed me again here as they were glued in hard and removing it took a lot of force, so I broke one of the housing bolts off. And when removing the adhesive from the chassis the paint came right off too. Thankfully all the damaged area won't be visible later, but whoever did the very limited bodywork on this car needs to have their limbs chopped off piece by piece.   Quite a list if I do say so myself, but a lot of time was spent just discovering new shit that is wrong with the car and finding a solution or parts to fix it. My last problem that I now have the headache of dealing with is that the exhaust studs on the turbo outlets are M10x1.25 threaded, but the previous owner already put on regular M10 nuts so the threads are... weird. I only found this out the hard way. So now I will just try if I can in any way fit the front pipe regardless, if not I'll have to redo the studs with the turbos installed. Lesson learned for the future: Redo ALL studs you put your hands on, especially if they are old and the previous owners were inept maniacs. Thanks for reading if you did, will update when the engine runs again. Hope nothing breaks or leaks and I can do a test drive.

    • Yea - I mean I've seen my fuel pump which is decades old and uh, while I'm not saying this with real knowledge... but I sure get the ick at using anything in the fuel system that produced the state of that pump. Many years ago I went through multiple pumps (and strainers) before I dropped the tank to clean it out with extreme violence. I'm talking the car would do maybe 50km before coming to a halt, which resulted in me cleaning out the filter with some brake cleaner and going on my way. None of my stuff ever looked like what came out of your fuel tank. I don't think I'd be happy with it unless every single component was replaced (or at least checked/cleaned/confirmed to be clean here).
    • I'm not going to recommend an EBC pad. I don't like them. Just about anything else would suit me better. I've been using Intima pads for a while now.
