Hey guys, jst would like some advice and opinions on what to do.

Basically a lawnmower (the type you hire and they come do the job) scratched two of my cars while walking his equipment through: 3 on the drivers side where the fuel filler cap is and one hit on my front bar.

the beema took the same three scratches on the same side as the gtr, where the fuel cap is.

anyways called him and he's denying ever going through the garage, even though there is grass all over the garage and he asked me to leave the door open for him to walk through.

Called police and made insurance report; he of coarse being pissed off decided to come back to my place and write/scratch F-U--CK on the pasenger side in red pen just over the wheel arch

Next day came back and threw pins all over my driveway in hopes to puncture tyres (luckily we noticed)

anyways im gonna get both cars fixed and them take him to court to try n reclaim damages, long shot i know but hopefully justice will be on my side.

Just wish for some advice if anyone has been through this before, anything like this etc; opinions will be valuable and appreciated.

gonna take this chance, as it will be as the panel beaters to pay some extra cash n have some nismo side skirts and rear pods installed - was gonna do it anyways so i guess a good excuse.

Even the red pen act can be interpreted as 'Malicious Damage' but I don't know if you've got the proof to make it a Crown case instead of Civil; or do you? I wonder if he'll submit to a police interview. He may be savvy enough to decline an interview that would force the police to charge him.

Did you take some photos and time that each event occurred?

No experience, just if i went through, i'd try to provide as much evidence as I can.

I can give you the details of a law firm who deal with car damage and accidents. They're very good to deal with.

You might want to set up a camera to catch him if he comes back.

hmmm not sure about that one, the pins in the driveway could be "malicious" too. Police aint much help, havent even been out to inspect for a police report.

My house was robbed about 4 years ago, police didnt show for 2 hours and even though the people were caught (had witnesses) they were never charged and we never recieved any notice of the outcome.

You need a 9mm bro :(

i wanna do this the right way rather than the wrong way. Im sure many people will feel empathy with me n jst want me to go down to the blokes place and "get" him but i wont until he poses a real threat to my family or me, right now he's just being a pathetic/pitty vandal.

i think you have a good chance because you went straight to the cops. i cant remember if you said you did this or not but take the pics to the police as well and tell them everything. if you get a good cop they will point you in the right direction to get this all sorted. most of the time when the police are involved or go around to see him or something like that it usually scares people. and if none of this works there is always option 2 :( . i know a couple guys that can help persuade him as well lol.

its good to see you are going at it the right way it should definately help in court. i do not know how you are keeping your cool though but its good to see these days. i really wish you the best and it gets sorted, its just hard to predict how the court hearing will go because the justice system sucks these days.

thanks man, If he had been a man and admitted it then i would have even offered to pay half of his insurance excess but he has completely gone over the top with the vandalism

sorry to hear Johnny.. as mentioned previously take heaps of photos and document EVERYTHING you possibly can - invoices, phone conversations etc

thanks man, check this; the police told my mother to call him and offer him one more chance to simple admit to the damage, he didnt pick up so she left a nice message pleading him to please admit and fix our cars

he called the police after that message and said we were harassing him....what a loser ey

again, i appreciate all the kind words as they mean alot when your pride and joy is damaged; my car never really gets driven and i expected it to be safe in the garage :-(

I hope nothing like this ever happens to anyone on here, we love our cars and hate to see them damaged after all the care and maintenance.

its good to hear you didnt do anything stupid. some idiot cut me off in his 4wd and his trailer nearly swiped me. i got infront of them later gave them the finger and was off. at the lights they pulled up next to me and started yelling. i grabbed my big scissors i have in the car and jumped out ready to stab the flamin mongrels, luckily my little sister was there and she grabbed me before i swung at him. after that i keep my cool coz of my family and i dont want a criminal record coz of someone else. Just dont forget the its just a car and can be fixed but doing something to hurt others will always stay with you. good luck with this and i hope everything comes out good for you.

You have a much better control of your temper than me mate. It certainly makes sense to go about it the legal way, but the guy is pushing his luck.

If you do end up in court you might find there are expenses you can claim in your complaint above the cost of the repairs alone. Hire cars, towing fees, storage fees etc etc. Make sure you claim all that is owed to you. The legal process is long and drawn out, so you need to get every penny that you can considering the amount of time you'll spend chasing him.

those stories are very common it seems, generally the cars we drive bring out the worst in people and some are just plain arses - ie. jacked up 4wd's with fog lights

Im glad u didnt do anything but shows your a man for being able to defend yourself but still have the conscious mind to weigh the outcome and make the right decision, its what separates us from the animals to an intelligent bloke like u.

not worth a simple cut-off road rage, but maybe if he tried to attack your sis it would have been different.

I did loose my mind after the second vandalism and nails in the driveway, my mother blocked the driveway with her car and stole my keys; god works in these ways to protect us ey?

Thats just wrong and if i were in your position i would not be able to keep calm... but its good that you can control that so you dont have to go through more pain!

You can definitely take him to court. However, it might be hard to press charges against him for writing those words and dropping the pins though. That will require photographic evidence of some kind as proof that he is the culprit.

Happened to one of my friends before when his C63 amg got scratched from the front to the rear in his apartment's car park. He has no proof hence the cops can't do anything. The car park security camera failed to capture anyone either.

Your calmer than some, your doing the right thing thou... if someone damaged my property then came back and wrote that on my car and throw nails on my driveway i would F*** the law go visit him(regret it later hehe).

Hopefully its settled and you get some satisfaction and paymnt for damages, and he doesnt come back to haunt u later.... some ppl can be phycho and hold a grudge.......which in this case sounds like he is the type.

sorry to hear mate,

however, i dont mean to sound pessimistic here. but you have little to no chance on pressing charges for vandalism. You have no concrete evidence watsoever (or any other evidence for that matter) that he is the culprit, and a judge isnt gonna merely take your word on who you "THINK" did it.

as for the damage done by the lawn mower, again its gonna be pretty hard for you to prove that it was his mower that did it. he can argue your simply trying to scam money for repairs for what could be previous damage to ur vehicles. As for the grass in the garage, he can argue the wind merely blew it in seeing how the garage door was open while he was working. So make sure u get enough solid evidence together.

P.S, Good man for not taking this matter into your own hands, legal aspect aside, most the people replying tend to forget he actually knows where you and yur family live. Why risk things blowing out of control over a few grand. do the right thing, get enough credible evidence and stick to him in court :down:

    • The other problem was one of those "oh shit we are going to die moments". Basically the high spec Q50s have a full electric steering rack, and the povo ones had a regular hydraulic rack with an electric pump.  So couple of laps into session 5 as I came into turn 2 (big run off now, happily), the dash turned into a christmas tree and the steering became super heavy and I went well off. I assumed it was a tyre failure so limped to the pits, but everything was OK. But....the master warning light was still on so I checked the DTCs and saw – C13E6 “Heat Protection”. Yes, that bloody steering rack computer sitting where the oil cooler should be has its own sensors and error logic, and decided I was using the steering wheel too much. I really appreciated the helpful information in the manual (my bold) POSSIBLE CAUSE • Continuing the overloading steering (Sports driving in the circuit etc,) “DATA MONITOR” >> “C/M TEMPERATURE”. The rise of steering force motor internal temperature caused the protection function to operate. This is not a system malfunction. INSPECTION END So, basically the electric motor in the steering rack got to 150c, and it decided to shut down without warning for my safety. Didn't feel safe. Short term I'll see if I can duct some air to that motor (the engine bay is sealed pretty tight). Long term, depending on how often this happens, I'll look into swapping the povo spec electric/hydraulic rack in. While the rack should be fine the power supply to the pump will be a pain and might be best to deal with it when I add a PDM.
    • And finally, 2 problems I really need to sort.  Firstly as Matt said the auto trans is not happy as it gets hot - I couldn't log the temps but the gauge showed 90o. On the first day I took it out back in Feb, because the coolant was getting hot I never got to any auto trans issues; but on this day by late session 3 and then really clearly in 4 and 5 as it got hotter it just would not shift up. You can hear the issue really clearly at 12:55 and 16:20 on the vid. So the good news is, literally this week Ecutek finally released tuning for the jatco 7 speed. I'll have a chat to Racebox and see what they can do electrically to keep it cooler and to get the gears, if anything. That will likely take some R&D and can only really happen on track as it never gets even warm with road use. I've also picked up some eye wateringly expensive Redline D6 ATF to try, it had the highest viscosity I could find at 100o so we will see if that helps (just waiting for some oil pan gaskets so I can change it properly). If neither of those work I need to remove the coolant/trans interwarmer and the radiator cooler and go to an external cooler....somewhere.....(goodbye washer reservoir?), and if that fails give up on this mad idea and wait for Nissan to release the manual 400R
    • So, what else.... Power. I don't know what it is making because I haven't done a post tune dyno run yet; I will when I get a chance. It was 240rwkw dead stock. Conclusion from the day....it does not need a single kw more until I sort some other stuff. It comes on so hard that I could hear the twin N1 turbos on the R32 crying, and I just can't use what it has around a tight track with the current setup. Brakes. They are perfect. Hit them hard all day and they never felt like having an issue; you can see in the video we were making ground on much lighter cars on better tyres under brakes. They are standard (red sport) calipers, standard size discs in DBA5000 2 piece, Winmax pads and Motul RBF600 fluid, all from Matty at Racebrakes Sydney. Keeping in mind the car is more powerful than my R32 and weighs 1680, he clearly knows his shit. Suspension. This is one of the first areas I need to change. It has electronically controlled dampers from factory, but everything is just way too soft for track work even on the hardest setting (it is nice when hustling on country roads though). In particular it rolls into oversteer mid corner and pitches too much under hard braking so it becomes unstable eg in the turn 1 kink I need to brake early, turn through the kink then brake again so I don't pirouette like an AE86. I need to get some decent shocks with matched springs and sway bars ASAP, even if it is just a v1 setup until I work out a proper race/rally setup later. Tyres. I am running Yoko A052 in 235/45/18 all round, because that was what I could get in approximately the right height on wheels I had in the shed (Rays/Nismo 18x8 off the old Leaf actually!). As track tyres they are pretty poor; I note GTSBoy recently posted a porker comparo video including them where they were about the same as AD09.....that is nothing like a top line track tyre. I'll start getting that sorted but realistically I should get proper sized wheels first (likely 9.5 +38 front and 11 +55 at the rear, so a custom order, and I can't rotate them like the R32), then work out what the best tyre option is. BTW on that, Targa Tas had gone to road tyres instead of semi slicks now so that is a whole other world of choices to sort. Diff. This is the other thing that urgently needs to be addressed. It left massive 1s out of the fish hook all day, even when I was trying not too (you can also hear it reving on the video, and see the RPM rising too fast compared to speed in the data). It has an open diff that Infiniti optimistically called a B-LSD for "Brake Limited Slip Diff". It does good straight line standing start 11s but it is woeful on the track. Nismo seem to make a 2 way for it.
    • Also, I logged some data from the ECU for each session (mostly oil pressures and various temps, but also speed, revs etc, can't believe I forgot accelerator position). As the test sessions are mostly about the car, not me, I basically start by checking the oil pressure (good, or at least consistent all day). These have an electrically controlled oil pump which targets 25psi(!) at low load and 50 at high. I'm running a much thicker oil than recommended by nissan (they said 0w20, I'm running 10w40) so its a little higher. The main thing is that it doesn't drop too far, eg in the long left hand fish hook, or under brakes so I know I'm not getting oil surge. Good start. Then Oil and Coolant temp, plus intercooler and intake temps, like this: Keeping in mind ambient was about 5o at session 2, I'd say the oil temp is good. The coolant temp as OK but a big worry for hot days (it was getting to 110 back in Feb when it was 35o) so I need to keep addressing that. The water to air intercooler is working totally backwards where we get 5o air in the intake, squish/warm it in the turbos (unknown temp) then run it through the intercoolers which are say 65o max in this case, then the result is 20o air into the engine......the day was too atypical to draw a conclusion on that I think, in the united states of freedom they do a lot of upsizing the intercooler and heat exchanger cores to get those temps down but they were OK this time. The other interesting (but not concerning) part for me was the turbo speed vs boost graph: I circled an example from the main straight. With the tune boost peaks at around 18psi but it deliberately drops to about 14psi at redline because the turbos are tiny - they choke at high revs and just create more heat than power if you run them hard all the way. But you can also see the turbo speed at the same time; it raises from about 180,000rpm to 210,000rpm which the boost falls....imagine the turbine speed if they held 18psi to redline. The wastegates are electrically controlled so there is a heap of logic about boost target, actual boost, delta etc etc but it all seems to work well

Yes some vid from the day is up, here:  Note that as with all track day videos it is boring watching after the bloopers at the start.  The off was a genuine surprise to me, I've literally done a thousand laps around the place and I've never had instability there; basically it rolled into oversteer, slipped, gripped and spat me out. On the way off I mowed down one of the instructor's cones and it sat there all day looking at me with accusing cone eyes as I drove past. 1:13:20 was my fastest lap, and it was in the second session, 3rd lap.  It (or me!) got slower throughout the day as it got hotter.
