You can take it to court.

However lets be honest, how many people really are "legal". Very very few.

Please tell me how to take EPA to court i was told i could not

as when my evo i got a EPA at one location and then a police statement of me being involved in a car accident in the same car at the same diff location about 40min drive away and i could still not fight this

Freedom of Information laws.

They allow you to find out where/who it was that reported you. I would imagine then - with a good lawyer, something could be done or some sorta action taken with that information against the individual for making false allegations or along that line.

So like i said, fair amount of effort.

YES you can get a '3rd strike fine'. My mate copped 3 EPAs (none for noise) and yes on the 3rd one he was going to have to pay a ~$600 fine if he was to clear it.

From what I remember the fine was not actually for not complying with emissions; it was a fine for putting stock stuff back on and trying to 'trick' the EPA upon inspection, despite the fact they had photo evidence of the highmount GT30 and External Gate not plumbed in :)

The car is no longer street registered.

And that person would be me lol, the second and third time i got done i recieved a $584 fine, almost $1200 down the drain. Offence: VEHICLE NOT MAINTAINED IN SUCH A WAY THAT EMISSION CONTROL DEVICES OR EQUIPMENT CONTINUE TO OPERATE IN ACCORDANCE WITH THE MANUFACTURER'S DESIGN. I got to know the boys down at EPA after a while lol, nice guys, they actually told me that i should attempt to hide all my mods from the 5-0 and/or throw an RB26 in it!!

Unfortunately if you recieve one of these fines there's no way out of it, even if you de-reg. The police officer that pulled me over last time told me rules are changing and it's going to become harder and harder for us guys to drive around with modded cars, he also stated that these days they have to take pics which they then send off to EPA. So even though i changed everything back to stock they still had photo evidence...

As Mat stated above these were not noise specific tests, they were notices to present vehicle at an EPA station at which they carry out an emissions test and exhaust noise test. If you just get a noise test then your in the clear. If anyone needs any more EPA info I got it all, hahaha, have had some very large discussions with both EPA and the Police.

As Ash said "how many people really are "legal". Very very few." No point fighting if you were in the wrong. Last thing, i was informed by the EPA that if i was to get done one more time they would take me to court, something i really need to avoid.

Did Lou tell you to do a 26? lol... its what i did for the 31 back when... he was shocked i actually went and did it.

As you said, they are good guys at the EPA and if you go down there and leave your attitude at home they can be very insightful ;)

EPA = nice sympathetic people, all but those who write the regulations. Police who go out of their way to enforce EPA regulations = ****s. EPA staffer agreed with me over the phone that my situation was bullshit and the bureaucratic process is silly.

Also, the workshop I cleared mine at said Skylines were the most popular EPA victim. Their books were full of them.

He sure did, nice guy Lou, could of chatted with him all day lol

if you were 100 percent should have argued the point til he showed you i had to bout my injector as he reckoned the were after market and i knew the stock one's were in,where'd ya go werribee or moorabbin?

Werribee as that was local to GF

yeah i called guy today and he said to bring it in again so Saturday it is going back in so i can be shown these so called things

it nothing new though when i had the evo 6 number plate on the side i got fined for that by police ended up removed with a nice note from Mitsubishi saying it was a stock location and a FMIC is stock on a evo

Some people are silly

Yep, I got pulled over by the EPA three weekends ago. They got me for electronic boost controller, exhaust and pod / cooler combo. Took photos of the lot.

Got the official warning in the mail the other day, but the guy said he could have just as easily fined me.

I've learnt my lesson!

    • After my last update, I went ahead with cleaning and restoring the entire fuel system. This included removing the tank and cleaning it with the Beyond Balistics solution, power washing it multiple times, drying it thoroughly, rinsing with IPA, drying again with heat gun and compressed air. Also, cleaning out the lines, fuel rail, and replacing the fuel pump with an OEM-style one. During the cleaning process, I replaced several hoses - including the breather hose on the fuel tank, which turned out to be the cause of the earlier fuel leak. This is what the old fuel filter looked like: Fuel tank before cleaning: Dirty Fuel Tank.mp4   Fuel tank after cleaning (some staining remains): Clean Fuel Tank.mp4 Both the OEM 270cc and new DeatschWerks 550cc injectors were cleaned professionally by a shop. Before reassembling everything, I tested the fuel flow by running the pump output into a container at the fuel filter location - flow looked good. I then fitted the new fuel filter and reassembled the rest of the system. Fuel Flow Test.mp4 Test 1 - 550cc injectors Ran the new fuel pump with its supplied diagonal strainer (different from OEM’s flat strainer) and my 550cc injectors using the same resized-injector map I had successfully used before. At first, it idled roughly and stalled when I applied throttle. Checked the spark plugs and found that they were fouled with carbon (likely from the earlier overly rich running when the injectors were clogged). After cleaning the plugs, the car started fine. However, it would only idle for 30–60 seconds before stalling, and while driving it would feel like a “fuel cut” after a few seconds - though it wouldn’t fully stall. Test 2 – Strainer swap Suspecting the diagonal strainer might not be reaching the tank bottom, I swapped it for the original flat strainer and filled the tank with ~45L of fuel. The issue persisted exactly the same. Test 3 – OEM injectors To eliminate tuning variables, I reinstalled the OEM 270cc injectors and reverted to the original map. Cleaned the spark plugs again just in-case. The stalling and “fuel cut” still remained.   At this stage, I suspect an intermittent power or connection fault at the fuel pump hanger, caused during the cleaning process. This has led me to look into getting Frenchy’s fuel hanger and replacing the unit entirely. TL;DR: Cleaned and restored the fuel system (tank, lines, rail, pump). Tested 550cc injectors with the same resized-injector map as before, but the car stalls at idle and experiences what feels like “fuel cut” after a few seconds of driving. Swapped back to OEM injectors with original map to rule out tuning, but the issue persists. Now suspecting an intermittent power or connection fault at the fuel pump hanger, possibly cause by the cleaning process.
    • For race cars, this is one part where I find having the roll cage bar having gone through a hole in the floor better than the build it up on a ledge inside... The Merc I help on, the main hoop ends are marked on the car, and the jack is marked... Jack goes under a few inches and lifts one whole side of the car up... Removes that fight for long slim jacks for race car duties!   My biggest issue for the daily drivers I work on, is my jacks don't go high enough. The jacks start out on a few blocks, jack it up, then start a second jack under it on more blocks, and then I can get an axle stand under it. My axle stands are presently in use, and are nearly fully extended. The car is sitting with barely more than a cm of clearance to get the wheel off the studs! Sarah's Kluger is the same, as it has an ungodly amount of droop available in the suspension and a distinct lack of good jacking points!
    • Happy? Yep, my to do list is getting shorter and shorter. Either this light approaching is the end of the tunnel, or I'm about to be hit by a train... Ha ha ha   Also, Duncan isn't that far out of town that you need to make a multi day drive out of it. 😛
