i got my car 22nd of june, impounded on 3rd of july for 'street racing' just because i droped it from 5th to 3rd dosnt meen i was raceing ffs, 48 hour impound 408$ to bail + i go to court in like 5 months.. they did not get a speed reading because they didnt have a radar gun (i think thats a 1st) so i think thats a good thing for me. hmmm any1 gimi some info on my rights like when i go to court? like because they cant prove i was speeding or dont know how fast i was going, i wont loose my licence true? and plz hold back the flaming coped it hard enough :D

Just down changing is not cause for street racing, and im quietly confident there will be information withheld in your post.

If you think you were in the right, get a lawyer to be honest.

The Police are recognised as estimators of speed. So they dont have to have a radar on them. So its not a first, been around for a long time.

well they were trying to get me to say that i was going 100, they asked me how fast i was going and i said i wasnt sure , i was concerntrating upfront and not my speed, n she was like make a estimate, i said i couldnt say because i realy didnt know, n shes like oh would it be possible that you were doing 100? n i said its possible i was doing 70 80 90 i dont know i dont know i just droped gears for a bit, :$ it was in a 60 zone so yer f**ked... i droped from 4tgh to 3rd not 5th - 3rd soz

So you admitted to the Police you were over but you were unsure?

You need a lawyer, because admitting you were over, and 90 was possible, its fair game for them.

You cooked your own goose in this instance.

they wernt even trafic police either, ahh well your right i got to cop it, made a mistake.... i should of said f**k you show me the radar n burnt his eyelids out with a cigie and booted of, i meen they were in werribee like there isnt drug dealers around there is there (being sarcastic) but hey lets do something fun and guess the speed that p platers going and then we can take his car.

Its etiquette not the law that they will show you the radar.

As R31Nismoid said, you have already admitted to do something wrong, so its going to be hard now :D

but they dont know how much to dick me for lets say i was going 70kms?? how are they to decide what speed i was going? and they need to know dont they? i got 5 points baby, but i dont want 30km + cus yer i hate trains lol..

You said upto 90, so they have gone with 100. If you dont know how fast (already admitted to possibly 90), and they estimate 100, its as simple as tough titties.

Nothing wrong with that as a bit of bargaining will go on before the appearance possible and it might be moved to 90 in a 60 rather than 100.

Either way, by your posts you still havent accepted you've done something wrong.

I hope they pin you for 40 over. Might teach you a lesson.

Unless I'm wrong (which is a possibility) the R33 GTS-t is banned for P platers, the R32 is OK, but the R33 violates the power to weight ratio regulations.

You're ID says you drive an R33, and later on you mention P Plates.

If this is the case, you could get a further fine, and they'll probably try to force you to sell the car, or at least suspend registration.

Look, I know a lot of us on this forum probably sound like old farts, and well some of us are, but for f**ks sake, keep it on the track.

When guys like you drive 30+ over the limit in skylines, it means they target ALL skylines. This means that when I drive through a breatho, or late at night, the cops are more likely to pull over people doing nothing wrong because in their experiance, Skyline drivers are more prone to speeding and other shit.

So:

1) Get a CAMS license. It's cheaper than a speeding fine, and a lot more fun.

2) Pull your head in. Seriously. I love to push the go fast pedal too, but keep it off the public roads. There is so much that can happen that it's stupid to assume you'll be OK. Yes, speed limits are sometimes un-necessarily low, but that's just the way it is. ignoring them is simply stupid, especially in a 60 zone. If you were doing 130 in a 100 zone on the sydney - dubbo highway (i.e. dead straight, no wildlife or bushes, etc.) then that's careless. Doing it in front of homes is just stupid.

3) Do some advanced training. SAU has some great driver training courses that they can recommend and organise a few times a year. Learn to drift, corner and i think there's even one for driving on two wheels. Have crack, and bring friends.

4) stop driving my premiums up. I gotta save up for a high flow.

5) Wear the fine. You seem like you already know that you cocked up, and you've accepted it. This is a good attitude. It's always a temptation to give it a squirt, but you gotta keep in mind that it really is easy to hit something (say a cat) running across the road, which can then put you into a telepole, and into hospital.

I'm sure you know all this already, but just read over it a second time, then see what you want to do.

I had a similiar type situation a few years ago when I had my R33 where the cops 'estimated' my speed by following behind me and matching my speed, and I was to loose my license for 1 year.

It was BS on the part of the cops of the speed they 'estimated' and 'matched' so i contested it and took it to court. Before the court date I got all the details from where to where they followed and matched my speed etc. A simply calculation of acceleration and velocity from the intersections they said they matched my speed proved that only way they could accelerate and match my apparent speed in the distance between the intersections was if they were in a something like a formula 1 car, where they were driving a VY executive.

So me and my lawyer met with the cops at the court before the start of the hearing and showed them the evidence. They realised I wasent Joe Bloggs who was gonna accept their BS so they dropped my apparent speed down to where I got away with alot less license loss and fine.

Its quite easy to prove wrong the cops 'estimate' of speeds if you know what your doing. :(

man don't they have enough cameras and other crap to catch you... you have the right NOT to incriminate yourself so if they can't get you fair and square and have to ask you how fast you were going you say 60km/h or whatever the limit is... if you are unsure of what the limit is just say 50km/h... even if the limit in that area is 70 or 100 when you say 50 they will get the message that your not going to incriminate yourself... they will then need to provide evidence or let you go...

ps. this may just annoy them to the point of trying to get you for other stuff like defects etc... just don't do their work for them!

I'm curious to know why you dropped it form 5th to 3rd and why they'd class that as "street racing". Was there other cars around with you? Was there drags nearby? I don't think police just pull over drivers and claim they were street racing for no reason. Don't get me wrong, the Police to victimize but generally thats just defects and "standard checks" as they call them.

Mate couldn't agree more. Last time I was pulled over totally minding my own business, 70 in a 80 zone they said to me "these cars are well known due to P platers, most drivers are younger and a lot more stupid that you." Thanks huh!

yes i have learnt my lesson, wich is dont be a dickhead on roads, sum guy in a beemer who was behind me booted past me, cops chased me not him? i didnt race him? ah well well c when i go to court. the cars under dads company too, iv been pulled over like 3 times in the skyline iv had it for like uhhhh a week? they havnt said anything about power to weight, one cop just pulled me over to warn me to take it easy on takeing off in the wet, (it was a random chek up) he said that he was at a accident sceen like the day before where a skyline took of kicked it out into second and smacked into a pole (dont know how the hell that happend unless he was trying to go sideys?) but none of the times they said power to weight or nething bout my turbo.. well they probably will now, ah well ill keep it for another 6 months then when court comes and i get my licence loss then ill sell it, and pay of like a 5,000 fine lol, then maby get a vs or somthign after i get my licence back idk :thumbsup:

So why did you drop it down to 3rd again?

What pedal did you press after the gear down; the accelerator or brake?

Sorry to say mate, cops are not stupid (and neither are we), and you were clearly way over 60, so their actions are 100% justified.

Also if they decide to throw everything at you; you'll get fined for power to weight and loose another 3 demerit points. These 3 points, attached to the 3 for speeding, will give you an additional 3 months suspension, on top of what you'll get for speeding/racing offense.

    • So, I started this repair and got as far as "fixing" the holes with some fibreglass. God all those years working on boats came back quickly. I decided I'd reach out to some rust guys just to see what they would say about it. I came across a guy about 40 mins away and went to see him. He said the windscreen needs to come out, that there might be some more bits around the windscreen and he'd quote them at the time. But his quote was $300 to remove and replace windscreen and $3k for the damage he can see. He said he could respray the roof for $1200 and the bonnet for another $800 (somebody has previously rattle canned it, its horrendous). This is $5300 + any small additional bits. It's a lot, I get that and the name of one of my fave youtube channels 'Not Economically Viable' comes to mind.  I'm not being financially rational, but I've taken him up on the quote. He's opening a new shop in November with more room, so we're waiting for that. I'll leave the currently missing headliner out until then. I'm looking forward to it being fixed and having the paint looking nice again (lots of clear coat issues on the roof too). / flame suit on.
    • Oh and some up-and-comings; New rear drivers wheel bearing. I'll do that this weekend while the diff is out. The car is already up and the d/c axles and missing exhaust will help with space. This is the last bearing for me to do and I've been dragging my feet on it. I also have some new EBC blue stuff pads for the car and some new brake fluid. I haven't ever flushed the fluid in this car and looking forward to it. I have 600 degree fluid to put in. Not exactly "race fluid" but better than the typical stuff I have been using.
    • A proper clutch/plate type mechanical diff with quite a lot of pre-load and high locking % is better for drifting. Much more consistent in its behaviour. A helical can be annoyingly vague and inconsistent in how it responds under the sorts of abuse found in drifting.
    • Some updates here. I pulled the entire interior out, minus some trim to respray the seats with Colourlock dye. It turned out really nice though I accidentally let the dog in the car after and she scratched up the front seat.  This is what it looked like before, the colour was just washing out everywhere but thankfully the leather was in good nic. Then after the respray   And after the bloody dog jumped in The headliner is out waiting to be retrimmed, but it will stay out now until Nov - see why below. I replaced the stereo/headunit with a period-styled Android headunit. I have no after pics, but I'll get some. This is because of the missing pixels. I tried to fix this twice with replacement ribbon cables but couldn't. Also the bluetooth interface I'd bought for this was crap. Then there's the rusty roof. Pics and info in this other thread. I have decided to get this repaired professionally, but I'll update that thread. This is why the headliner will stay out for now. I'll be getting the roof and bonnet resprayed at the same time the rust is fixed. I also had an interesting issue with my drivers door lock.  For a small period I was having issues getting any 12v power to the car - I mean *any*. It would have no dash lights, nothing. It happened while I was at the shops and I couldn't get in the car. So, we had 2 problems. The most pressing here is that I was locked out. I have only a single physical key hole on the car, the drivers door and no amount of turning would unlock the car. Surely it doesn't need power for this? The second issue is why am I losing all power periodically, The battery isn't dead, its almost like the battery isn't even there. Two issues that were surprisingly easy to fix. You fellow BMW over-engineering lovers will appreciate this. The lock in the door has 5 states; mechanical lock, electric lock, neutral, electric unlock, mechanical unlock achieved at -90 degrees, -45 degrees, 0 degrees, 45 degrees and 90 degrees. Although, the unlock is towards the front of the car, so opposite for LHD countries. Sticking the key in and turning 45 left or right is what is used 99% of the time. It activates the central locking etc. 90 degrees is for dead battery access and, obvs, only un/locks the one door. But because the mechanical lock is never used and is 27 years old, it seizes up. I was totally unable to turn the key far enough to get to the mechanical unlock (At the time of locking myself out, I didn't even know this was a thing). I eventually did it with some vicegrips and teflon spray.  I made a quick vid for other E39 peeps.   The battery issue is totally new to me also - It wasn't making sufficient contact between the post and the terminal. The terminal was bolted on tight, but the car wouldn't have power. After checking the battery with my multimeter I accidentally contacted the terminal and the battery post and the car got power. The battery was only a few years old and in good condition. I cleaned the post and the terminal with a wire brush, bolted it back on tight and never had the issue again. I'm still surprised that despite having solid contact it didn't work. Also, the car was getting Warragamba sized pools of water in the back when it rained. My initial concern was another rust problem. But when I went out on Weds while it was raining and while I had no headliner in I could see a steady stream of water coming through the roof mounted aerial. As this aerial is for the (now removed) car phone I pulled it out and whacked a blanking grommet in the hole. It seems fine now. I'm thinking I might get the hole permanently filled when the rust is fixed. Moving forward and things in progress; The tailgate needs some attention. I have taken all the trim off to clean it all and address some small rust spots. I have partially done all of this but I'll finish it up hopefully this weekend. As all the trim are now entirely devoid of trim clips I have bought a heap of strong velcro and I'm hoping it does a good enough job as any of this trim in good condition is super expensive and usually in Europe as we dont have many of the wagons here. Suspension and brakes!!! This is exciting. In the front; New control arms New sway bar links New lower Eibach springs (the only modification I'm planning on this car) M Sport shocks (these came with the car and will replace the longer shocks in the car) New top mounts Used 540i calipers (stock brakes suck!) New 540i disks and pads (22x296 mm for 528 and 30x334 mm for 540i) New front wheel bearings (thank all that is holy for bolt on bearings!) Annnnd in the back; New control arms New sway bar links Adjustable air suspension arms (fool the car into what the current height is so the self levelling suspension can match the new front ride height) New ball joints I'll also be doing a brake fluid flush while I'm in there. I'm planning on switching the car over to the 16's that came with it so I can clean up and respray the M Sport 17's. They've lost a lot of colour over the years and have some gutter rash. None of this will start until the E90 is back.
