Ok well heres the story,

Late april i had to deliever my car to the preston impound lot under the hoon laws, when i was there an inspector came out, noted all the dints, scratches etc...then i sign it off saying "yes they are all there" just to cover there ass incase somthing else appears once i pick it up and they also took photos which so did i. anyway, come along monday, i go to blackburn to pick it up (nation wide towing hq) and i notice a few scratches on the drivers side door that wernt there...so i rang up preston impound and told them and they said to me to write a claim..so straight away i wrote it and took it there the same day..and they said il hear back from them within 2 weeks...2 weeks comes along no call..3 weeks..no call so i decided to call them up..i call the preston impound and asked to speak to the person incharge of claims "sorry his not here at the moment, il get him to give you a call later today" 2 days later..no call, so i called back again, i managed to get in contact and he tells me you have to ring up this person his in charge of the insurance claims, i call this other person and he tells me victoria police has not approved of the damage and theres nothing i can do till it is, try calling the inspector manager in collingwood..so i call this person, mind you it took about 6-7 call backs to get through to him.. once i got a hold of him i told him that im disappointed in the actions taken, and that i would like my door repaird and he simply said vic police are not taking any responsibility and niether are nationwide..and i said to him what are you talking about the damage wasnt even on the paper i signed..i have voice recording of yous admiting the damage wasnt there before i delieverd the car but was after i picked it up and now your telling me i wont get it fixed. so then i asked what is the go from there? and he replies not sure buddy not my problem.

now i want to know wtf can i do. they also wont give me a copy of that paper i signed at the start which has all the dints etc that i signed

Obviously they are at fault according to you, but is it really worth it? All the chasing around etc etc I know they need a good lesson and i hope you do take them to court and win, but all im saying is its a big effort, over small damage (small damage in courts eyes).

Something to be considered before you make up your mind on what to further do, if anything.

Do you really have recordings? If so take it further

first thing I would do would be to call nationwide head office and try to get it sorted out of court

yes i do have recordings on my mobile phone, cant hear it that good but im sure if i uploaded it to my pc youd hear it better.

only thing im wondering is what would the costs be with a lawyer for somthing like this..and would it be a bad idea to represent myself insted, i mean im a good talker and all and its pretty straight forward in what has to be said to the judge. i might go in person to nationwide towing tomorow and confront the manager

really f**k these low lifes up which refuse to take responsibility for scratching / damaging your car.

they are damn quick to point the finger yet when its the other way around they refuse to help

laywer / legal advice - possible get them to make a call - people get very worried when they find out someone has taken it a step further, especially when they are in the wrong.

good on ya for keeping your own form of verification against these prics.

Sucks you didn't take your own photos too... you would definitely have everything you need then.

If i was you I would do the following for now:

1. work out (possibly go to some paint/car care places) and work out how much it is going to cost to fix it.

2. decide whether it is worth perusing, if it is, continue down, otherwise wear the cost.

3. go to see the manager and play your recording to prove your not making it up and say you have already done some research to work out how much they are going to need to pay to fix your car.... show initiative that you are proactive and are really concerned about your car. Also, show that you are willing to go to court as you strongly believe you are not being treated fairly in this situation.

4. they accept and everything goes well...

5. otherwise legal stuff i have no idea on....

gl man.

^ i do have photos of when i droped it off from every side of the car. and my uncles a panel beater he gave me a rough qoute of about $450 (obviously not family price but normal price)

Damn.... I admire you how you took pics of every side of the car. If it was me, I wouldn't even think of that lol

Shittttttt!! I just droped off my r34 their wednesday and im going to pick it up on friday at tullamarine... I didnt sign shittt either as he didnt say so, and the guy didnt even say anything about seeing scratches on the car, just went around and didnt sign anything on the paper... only asked for odometer reading and thats it... arghhhh

Hopefully when i pick it up tomorrow it wont have any scratches nor my stuff inside stolen... =/

well then I certainly think you have enough proof to show them, you just gotta hope the manager is reasonable.....

A mate of mine got his seriously kitted GSR impounded a few years back for about a month...he didn't bother picking it up...ever...the reputation of the impound yards back then was so bad that you were luck to get your steering wheel back. It's the equivalent of jail for cars...if you make it out with an intact exhaust pipe...you've done well :P

did he have to pay extra because it was there for a month? i asked them what would happen if i dont pick it up the following monday..and they said they start charging extra by the day..cant remember exactly how much but it was some ridiculous amount like $150 a day

Check with a solicitor. If you and they signed a contract they you are both bound by it. If what you say is enough evidence to prove that they broke that contract, take them to court. It might not even get that far if you write them a letter from your solicitor. Only a lawyer will know exactly what to do and how far to go. Just don't go with Slater and Gordon or 'Kenyons'... I swear those people have forged degrees, they were useless.

If you do take them to court and win it's a possibility that you can demand that they cover your expenses. This though will also have to be verified. If a lawyer doesn't think you have a chance (check with a few). I wouldn't bother... you will be far past the cost of repair if you try to take them and lose.

Good luck :)

    • Thanks Mate, I did know you could do that but i know there is a pump out there that you can bolt on and it all lines up. I was told about it and then forgot the model, I figure if i am pulling it apart i will just put a new one on
    • You can also remove the veins from the HICAS portion of your existing pump.
    • Trying to swap the rear subframe on my R34 and can't remove the L-shaped stay brackets between the front subframe mounts and the sill/chassis. I'm in the UK so rust is a problem. I've used loads of WD40 and then Tunap 103 for days beforehand. I backed off the bolts forward a bit, backward a bit repeatedly for ages to try and avoid snapping. They have all moved a few full turns. The one I've spent most time on has come loose and I can turn with fingers, and it will pull down and push up 2-3mm. But it won't come out. I can tighten it back up and loosen it off again repeatedly but it still won't come out. I assumed there's a captive nut inside but if that's broken loose then I can't understand why I can always tighten the bolt back up - I'd expect it to just spin both ways. Any ideas what's happening here? I can't visualise what's inside there to cause this.
