hey guys just wanted your input/opinions and experiance in this.

was driving on the monash freeway heading city bound and a piece, well a chunk of tyre that was on the road was flung up by another car and hit the car i was driving. damage cause was a smashed bonnet guard, a fairly large dint on the bonnet and scratch marks up the bonnet and on the edge where the roof meets the windscreen.

question is can this be "claimed" through vic roads for damage? or is it more of a suck it up and go through insurance company?

reading the vic roads web site its states that "A person who has suffered personal injury or property damage due to the condition of a road or road infrastructure may be entitled to compensation from the responsible road authority"

road contidion was fine as in no pot holes or lose stones/rubbles on the road but there was shreaded tyres on a road where cars are travelling at high speed. so it would be their duty to make sure its clean of everything wouldnt it be?

so is it worth me putting in a claim or just go through insurance for it?

Put in a claim mate, worst case scenario they tell you where to go and you wind up going through private insurance anyway. Will help if you can give them the time and exact location of where it happened.

It's shit when that happens. I've had sizeable rocks come off trucks before and there's no recourse for some of it.

hmmm ye. just reading though search results that popped up in Google, most ppl have been waiting 6 months + to hear back only to get their claim rejected.

it’s pretty much a brand new car with just over 10000ks on it. don’t want it sitting there or driving it around with damage while i hear from vic roads.

it happened just after warrigal road exit. I’m pretty sure there is a "safety cam" monitoring the freeway. I’m sure they should have some footage. but i have all the details written down except for the rego of the car that drove over the piece of rubber/tire

could you possibly have it fixed by your insurance, then a claim to VIC roads to reimburse the cost and a formal government letter to your insurance company asking to adjust the claim incase your rating changes?

its much better to have stat dec's and receipts with this.. and lodging it with insurance would be a statement as you explain the situation to them.

imho go through your insurance and get it fixed then see if vicroads respond but i doubt it

if there was a massive hole in the road and they didnt fix it or they were vicroads contractors onsite and they left placards or something on the road then i would say so for sure

is there any chance a bump on the road will make the accelerator pedal/cable getting stuck ??

on the way to work i have to go over atleast 12 speedhumps and obviously the same on the way home, and it's doing a good job HUMPING my suspension... soooo what i was thinking was that i ream my car into one of the poles on the that street wiping out the car and the pole and blame it on the speedhumps with an excuse like 'it caused my accel. cable/pedal to be stuck....will i have a case?

called vic roads. they were in the usual "pole up the ass" mood. told the dude what happened and all he said was "well thats unfortunate isnt it?"

called insuarance company and put through a claim. lady at insurance company did say to put a claim through vic roads anyways and see how that goes.

if ppl are interested i will update this thread.

I tried to claim damages from VicRoads when their contractors instructed me to drive over wet asphalt, which ruined my tyres. I provided all the details precisely, time and date etc. I heard back a few months later - VicRoads said there were no works going on at that time in that place. So either I made the whole thing up (including photo evidence), or they are conniving pricks.

TL; DR - I don't rate your chances of getting a cent from VicRoads

Ash u remember the shit I went thru for 4 months after a pothole on a freeway did a 10k job on all my steering, suspension components and wheels. And that WAS their responsibility. It's like squeezing blood from a stone. U will have to call insurance. U will have to accept fault as u didn't get the other cars details. U will have to pay the excess. And take the car to their choice of repairer like a common criminal...

Only person that I know who managed to get money out was my brother. But that was vicroads shifting blame on the company that was doing roadworks that left a massie hole on the rd that wrecked his front bar. We managed to get $3500 out of them

I ran into an unprotected pothole that was 4" deep and bent two rims and damaged suspension.

Initially they told me to get lost but then said I can claim if the damage is a minimum of around $1,280 or thereabouts.

The $1280 is an excess which I would have to pay and they would possible think about the rest If I'm lucky.

Fairly massive, similar to the guy above. Broke my steering rack, buckled a rim, damaged control arms, ball joints, bent one of my ohlins branded coilovers...and so on. Remembering it was also a freeway with a speed limit of 110 kmh. It was night and raining heavily so i couldnt see until i hit it. Vicroads fixed the pothole and claimed they'd fulfilled their responsibility and that they were 'not liable for any proprty damage in part or wholly caused by road conditions' citing a document which I read cover to cover which said that they were. I wrote a letter of complaint with a copy of all my documentation and evidence...all I got back was 'but we did send you a road condition reprot, it's not our fault if u didn't get it but call us if u want it sent again'. In response to a THREE PAGE letter of complaint with about 10 seperate points of complaint they addressed only one point and told me to bugger off. In the end I ran out of time and patience. I needed my car back. So I paid my 2k excess and lost a rating. But at least the cars fixed now...

    • That was the first session so not a lot to take from the day. It was low 20s ambient and the coolant had got to 110 (and obviously had some pressure!) so that still needs to be addressed. I haven't downloaded the data yet but will. I had refilled the auto trans with Redline DT6 because it claimed the best viscosity I could find at 100o. It wasn't really long enough to get a good feel for that; while the trans got to 100o in the session it still wasn't shifting crisply as I hoped. I think I'll try a few more sessions before judging. No steering motor overheat but I'd hope not in only 1 session! But finally the suspension; it was night and day over the standard stuff and the car was a couple of seconds quicker on the same crappy tyres, which is a huge difference. I'll stick with that and get some sway bars and a mechanical diff sorted too and see how that all goes together
    • I guess it’s partially a compromise of how my car is used, wanting to be able to switch from drift to grip with track side on-car adjustment. Also partially with the way the knuckles are set there is more static camber but less dynamic camber gain. 
    • OK, so update from the track day on Friday It was a classic "an unfortunate series of events'. There were a few cars around and when i checked my mirror coming out of the fish hook I notice some smoke from the rear of mine. Looked again and it was getting much worse, I figured I'd blown a turbo or something to got off it and pulled off the racing line. However.... since it is a left hairpin into a right kink, I was on the inside of the next corner. There was a car passing me on the left and a big drop off over the ripple strip on the right......and someone had knocked the witch's hat that was on the apex about 1m onto the track. So, between those 3, I decided to mow down the cone and not damage my car/the other car. Right choice, but surprising result.  The car decided the cone was a small pedestrian so it blew the rear bonnet hinges up to protect their head in the upcoming person to car impact....I didn't see that coming and like an airbag deployment it happened super fast. Straight into the pits from there, everything was driving fine but it became clear it was a coolant leak not smoke, it was billowing up onto the windscreen. Onto the trailer and home. I'll do a separate thread about the repair (once I work out what it is ), but the immediate problem was the bonnet wouldn't open because the front was pinched onto the front bar and would not release. Ultimately we unbolted the hinge from the bonnet, pulled it back a little and it released from the front OK. "There's your problem", the top radiator hose had popped off at the radiator.
    • Yeah that looks like great caster, but I'd suggest trying less front camber some time and seeing if it helps with braking without reducing mid corner speed too much
    • I ended up setting the rear 5mm higher than normal to give some clearance.  My plan is to run the least camber I can in the rear which I think with the extra width is going to need to be -1.75 to -2.00° just to get clearance.  Guards have been rolled and pulled as much as they can/I would be wanting to.  front has the Acostal knuckle with the KPI change and the drop etc. So should be okay with the existing settings I have run with AR1s etc Front: Toe total -2mm(1mm out each side) Caster +7.5° Camber -3.8° Ackerman +15°
