help!! car impounded !!

What a ****ing bullshit law... i mean honestly, sydney would have to be the only place where they have a stupid law like that.

It seems so open to interpretation. Its only to scare those who don't have the $ for a decent lawyer. With one you should be able to get a reduced penalty.

How can they actually take your ~$20k car off you? Isn't that theft in anybody's book? What happens anyway? do they sell your car and give you the money, sell your car and the government takes that money, do you get your car back eventually or what actually happens?

I'm 100% sure that every single person who has has posted on this forum has disobeyed some road rule in some way or another and if anyone got booked for any of those offences they would be pissed of and calling them cops and arsehols.

I got defected a while ago on my way to work, by a chick cop, for having a boost guage. That cop ended up costing me over $2000 to get the whole thing fixed up, as u can imagine, im pretty pissed off with her, i just think that occasionally there needs to be a bit more slack in the legal system, if you guys wern't directly threatening other people's lives, who cares??? If you guys both kill each other when your racing thats your problem...

I really don't like cops, and the best way to aviod dramas is to try and stay the hell away from them...

Maby you should have offered to pay the fine on the spot :P

Can we all just drop the bullsh!t about

1. badmouthing cops (they do good sometimes) - i have had my share of ill feeling from police, but build a ferking bridge!

2. saying we are unfairly targeted - don't like it, buy a commonwhore

3. saying we are targeted racially - i'm sorry this is not an excuse anymore. This underdog rubbish and general feeling of disadvantage - again build a ferking bridge! I am not white btw.

4. I have a defectable car. I like it. It is a risk i run, if i get defected i deal with it and move on.

5. Sorry mate, but if you were speeding and were caught, again, you have to grow up and be responsible about it. You were breaking the law. Unfortunately it appeared that you were 'street racing'. This is justification for your vehicle impoundment.

Whatever happens with it, i hope it is not too harsh - but like i said earlier, it is all about being responsible for your actions

Guys firstly let me clear things up:

1. I was driving my Skyline at the time, not my BMW. This looked bad when the other guys was soarer had a body kit etc...but mine is stock looking except exhaust.

2. The fact of the matter is i dont know the guy. we just happened to be at the lights. no intention to "organise" a street race.

3. My offences were street racing and 30km over.

4. Lastly i did back off to let him through cause we we running out of lane on his side.

5. i have nothing against cops, they just doing there job, but impounding is a bit far no? book me for speeding but not racing!

6. I guess i will have to get a lawyer. any suggestions?

thanks all again. Remember, its the BS that im against, not the cops.

My car was impounded in May.

I recently got it back in mind August.

Be prepared to pay approx $500 towing fee.

And 3 dollars a day if your car is to be held at the Enfield car impound. All up my fines were $740.

The just left my car out in the open by the way so no shelter was provided,

Remove all anything valuable from your car. (My car perfume was stolen).

You were caught red handed so its highly unlikely you will get your car back until the 3 month impounding is over.

You can take it to court but the first thing you should try to do is send a letter to the Local Area Commander appealing for the release of your car. Best reason is to say that "The loss of your car has effected......work.....travel.....and so on"

You have a very good chance in getting your car back if the car is not registered under your name, say if it is under your fathers or brothers name, you can get them to write a letter to the LAC saying that you took their car with out their consent or knowledge and lost it in the procedure and for that reason their work commitments and means of transportation has been effected "SEVERELY".

I believe it would be about 2 weeks till your court appearance from the day your car got impounded right?

Well just do what i suggested, write an appeal letter first. If that fails you can take it to court but i believe you will be wasting your money on a lost cause.

Heres what will happen to you and your car.

1. At court depeding on the Magistrate. You will be suspended from driving for 5 months and be fined $500 + $59 in court fees. Keep in mind this penalty is only if the judge is being generous. it could be much worse.

2. Fines of impound will be inbetween $750-800. Depeding on where you car is due to be held. MIne was helt at $3 a day some are $4 a day.

3. Prey that they checked your car that night for any damages with you being there whilst they checked it. Because i fyou get your car back and its damaged you can appeal for it to be repaired at their expenses. ( I hope you wrote your KMs down).

4. Be prepared for the agonising 3 month wait.

5. Cops and the law hate street racers. They envy our cars.

Funny note: One of the cops that night asked me if i could import them a skyline. True irony.

It was organised street racing at the runs.

Also i wasnt driving. I let my friend burrow my car.

And still it was taken away from me.

But try to get a lawyer.

I know that for sure if i had of asked for legal services i would of got my car back since i wasnt drivivng.

So the cops won this time.

They are doing their jobs though.

Ahhhh the shoock.

I will never forget the shock.

I was in denial for awhile.

My friendship with my friend who was driving that night has since goine down the drain. It affects you in many ways.

But you have another car so it should be fine.

All you have to worry about now is that if your car does remain for 3 months, is the health of your car. Though it should only be the battery.

here's the bad news.

Cousin got done in a similar fashion here in Sydney. Copper in an undercover car BA falcon pulled them both over for doing the same thing, the traffic light grand prix. Went to court and represented himself pleaded guilty and copped a 3 year suspended license plus some huge fine. He didn't lub himself so he was quite shocked when the sentence was handed down.

So get yourself a lawyer.

As for what you did, no matter what way you look at it, it's pretty stupid.

Damm thats harsh! I will be getting a lawyer! 3 years! man somethings got to wrong there! Anyone else got similar stories to share. The anxiety of waiting for the outcome is killing me. not a moment goes by where i dont think about it. But 3 years? man....was he like 18 or something? what speed did they record him as? i hope it was a lot more than 30 over....(for my sake!)
