Why would naming a company expose SAU to liability ? Is SAU a registered business entity or company ? As far as I can tell, the domain name was registered by Christian Biggins (i.e. just an individual, not a company). How can he possibly be held accountable for anything that is posted on a *public* forum ? There are zillions of boards around, heck I'm even the admin for one I set up for a highschool reunion. Are you saying that I am now responsible for the content that is posted by my old highschool friends ?

If someone here has had problems/got ripped off by some company, shouldn't they have the same right to name that company as, say, the Current Affair TV programme ? All they are saying is that "hey, I went to company XXX and they did this to me". It's not libel, slander or defamatory remarks - just the facts.

Now, I'm NOT a lawyer and I do not claim to know all the legal ins and outs of liability issues etc., so my post here is just my opinion on the matter. I'd welcome input from other board members with a legal background or who know FOR A FACT that one cannot name a company on a public board in a negative context.

We should really clear this up and have the legal know-how/backing because I think it would be useful to be able to post the names of companies that have ripped off fellow members to protect others.

Companies who are offended or disagree with a post made by someone can post a rebuttal/defense on this board. It is, after all, public...

Not really.... i have been through this matter before and if people make fair comment on their experiances of a certain company it is fine... only thing ppl can try and get you for is defamation and that is where you have to actively seek to tarnish a companies reputation, but if your comment was of an experiance and it shows the company in a negative way it is fair comment... Also there has been reomendations handed down recently where companies should not really be able to claim defmation....

trust me i have been through this shit before and you have nothing to worry about.. so let the guy tell everyone of the experiane he had..

I reckon that polishstorm is looking out for his fellow skyline enthusiasts, he got ripped off, and doesn't want to see anyone else blindly doing the same! The way I see it its all about looking after your mates, but these days everyone is so worried about saving their own arses......

My humble opinon is that if a guy gets ripped off, then he has the right, no the Obligation to tell everyone else who could be ripped off in the same manner, in this case SAU members. I think it is alright to name names.

But my opinon doesn't count for a bucket of horse shit! When I joined up I agreed to the conditions, and one of them say you can't name names, so we dont here. It is a shame, but I agreed not to it.

I have also been screwed over by someone in the import industy -I did the right things and I went to Fair Trading with my compliant, and the trader accused me of all sorts of things and then he lied about what he had done etc. Basically I got NOWHERE . Fair Trading can still not enforce people to pay you back or relieve you of payment etc I am now about to take court action against this trader.

Nothing spreads faster than word of mouth ...

There are other ways to "f*uck over" a trader who did the wrong thing without holding other people liable for you libel actions

Regardless of the rules on this forum, the website can 100% be sued for anything posted on here. The owner of the webiste (in this case Christian) can be held personally responsible for everything said here.

Papers, current affairs etc get sued all the time for defamation. They can affort shit-hot lawyers to protect them - who will pay SAUs legals?

As an example, Joseph Gutnick is suing the Washington Times, in Victorian court for defamation at the moment. A contributor to the paper wrote the article in Washtingon, US, and they are in court in Vic, Aus. IT HAPPENS ALL THE TIME.

I'm always interested to hear about dodgy operators, and please share your experience so others can watch out. Just don't name them.

Well, if you cant metion the companies name..fair enough but at least an around about location of them so as it can heed fair warning to any one wishing to have any work done on their pride and joy, cause lets face it..thats really what we are dealy with here. If it were not such a big deal to every body no body would give 2 shits.

Ah yes, they get sued for DEFAMATION: In other words, they get sued for writing something that is falsified/incorrect and injures the reputation of the other party.

For example, Tom Cruise sued a newspaper (I think) for writing an article about him being homosexual. He's not gay, he won the case, and rightly so.

Now if he WAS gay then he would have no legal grounds to stand on because the newspaper was merely reporting a fact.

Similarly, if I write an article saying company XYZ in Sydney is shit and imply something which is not true, they could sue me for slander/defamation (if they could prove that they lost business as a direct result of my actions) .

If what I was saying was TRUE however, they could not. It is not slander/libel or defamatory in any way. I am merely reporting a FACT. This is an imprtant distinction.

Hence I still stand by my opinion that if someone was ripped off by some company, they have the legal right to post their name to a public forum.

If someone knows of ANY case where a website has been sued for reporting a FACT, please post it and correct me if I am wrong. (In that case, michaelmoore.com should long have gone out of business!!!)

yes but whats to prove that this company does it all the time?? he may have rung the guy up at a bad time and he was pissed at an employee or soemthing. whats to prove that this company is doing it to everyone?? in my opinion he has no right to post the name without proof the company has done this to other people. im sorry for this persons misfortunes but its life, not everyone is perfect. just like one other post about an import company (not meationing names) people had different views about it. someone was unhappy with the service whereas someone else was happy with the service. some people just expect to be treated like they own the buisness or they are extremly important. do you expect to walk into hungry jacks and have people bring you napkins and pull your seat out as your about to sit down??? no, different companies have different service policies, unless if its a place like hungry jacks or a chain of restaraunts.

He doesn't have to show or prove that this company does it all the time - he's merely relaying what happened to him on a particular occasion.

If I went to Hungry Jack's, got lousy service and a hamburger that looked like a dog's breakfast as opposed to the one depicted on their menu display, why shouldn't I be able to write and complain about that ??? HJ's cannot sue anyone for that.

If I phoned Tel$tra to enquire about why I cannot get ADSL and then got a very rude response and unhelpful back from them, why shouldn't I be able to write about that ? In fact, I have done so and nothing ever came of it. As a matter of fact, there are a number of Australian IT forums around where people regularly complain about Telstra, Optus, iiNet and other companies and no-one has ever been sued. Nor will they.

    • Update 3: Hi all It's been a while. Quite a lot of things happened in the meantime, among other things the car is (almost) back together and ready to be started again. Things that I fixed or changed: Full turbo removal, fitting back the OEM turbo oil hardlines. Had to do quite a bit of research and parts shopping to get every last piece that I need and make it work with the GT2860 turbos, but it does work and is not hard to do. Proves that the previous owner(s) just did not want to. While I was there I set the preload for the wastegates to 0,9bar to hopefully make it easier for the tuner to hit the 370hp I need for the legal inspections that will follow later on. Boost can always go up if necessary. Fitted a AN10 line from the catch can to the intake hose to make the catchcan and hopefully the cam covers a slight vacuum to have less restrictive oil returns from the head and not have mud build up as harshly in the lines and catch can. Removed the entire front interior just shy of the dashboard itself to clean up some of the absolutely horrendous wiring, (hopefully) fix the bumpy tacho and put in LED bulbs while I was there. Also put in bulbs where there was none before, like the airbag one. I also used that chance to remove the LED rpm gauge on the steering column, which was also wired in absolute horror show fashion. Moved the 4in1 Prosport gauge from sitting in front of the OEM oil pressure gauge to the center console vents, I used a 3D printed vent piece to hold that gauge there. The HKB steering wheel boss was likely on incorrectly as I sometimes noticed the indicator reset being uneven for left vs. right. In the meantime also installed an airbag delete resistor, as one should. Installed Cube Speed premium short shifter. Feels pretty nice, hope it'll work great too when I actually get to drive. Also put on a fancy Dragon Ball shift knob, cause why not. My buddy was kind enough to weld the rust hole in the back, it was basically rusted through in the lowermost corner of the passenger side trunk area where the wheel arch, trunk panel and rear quarter all meet. Obviously there is still a lot of crustiness in various areas but as long as it's not rusted out I'll just treat and isolate the corrosion and pretend it's not there. Also had to put down a new ground wire for the rear subframe as the original one was BARELY there. Probably a bit controversial depending on who you ask about this... but I ended up just covering the crack in the side of the engine block, the one above the oil feed, with JB Weld. I used a generous amount and roughed up the whole area with a Dremel before, so I hope this will hold the coolant where it should be for the foreseeable future. Did a cam cover gasket job as the half moons were a bit leaky, and there too one could see the people who worked on this car before me were absolute tools. The same half moons were probably used like 3 times without even cleaning the old RTV off. Dremeled out the inside of the flange where the turbine housing mates onto the exhaust manifolds so the diameter matches, as the OEM exhaust manifolds are even narrower than the turbine housings as we all know. Even if this doesn't do much, I had them out anyways, so can't harm. Ideally one would port-match both the turbo and the manifold to the gasket size but I really didn't feel up to disassembling the turbine housings. Wrapped turbo outlet dumps in heat wrap band. Will do the frontpipe again as well as now the oil leak which promted me to tear apart half the engine in the first place is hopefully fixed. Fitted an ATI super damper to get rid of the worn old harmonic balancer. Surely one of the easiest and most worth to do mods. But torquing that ARP bolt to spec was a bitch without being able to lock the flywheel. Did some minor adjustments in the ECU tables to change some things I didn't like, like the launch control that was ALWAYS active. Treated rusty spots and surface corrosion on places I could get to and on many spots under the car, not pretty or ideal but good enough for now. Removed the N1 rear spats and the carbon surrounding for the tailpipe to put them back on with new adhesive as the old one was lifting in many spots, not pretty. Took out the passenger rear lamp housing... what do you know. Amateur work screwed me again here as they were glued in hard and removing it took a lot of force, so I broke one of the housing bolts off. And when removing the adhesive from the chassis the paint came right off too. Thankfully all the damaged area won't be visible later, but whoever did the very limited bodywork on this car needs to have their limbs chopped off piece by piece.   Quite a list if I do say so myself, but a lot of time was spent just discovering new shit that is wrong with the car and finding a solution or parts to fix it. My last problem that I now have the headache of dealing with is that the exhaust studs on the turbo outlets are M10x1.25 threaded, but the previous owner already put on regular M10 nuts so the threads are... weird. I only found this out the hard way. So now I will just try if I can in any way fit the front pipe regardless, if not I'll have to redo the studs with the turbos installed. Lesson learned for the future: Redo ALL studs you put your hands on, especially if they are old and the previous owners were inept maniacs. Thanks for reading if you did, will update when the engine runs again. Hope nothing breaks or leaks and I can do a test drive.

    • Yea - I mean I've seen my fuel pump which is decades old and uh, while I'm not saying this with real knowledge... but I sure get the ick at using anything in the fuel system that produced the state of that pump. Many years ago I went through multiple pumps (and strainers) before I dropped the tank to clean it out with extreme violence. I'm talking the car would do maybe 50km before coming to a halt, which resulted in me cleaning out the filter with some brake cleaner and going on my way. None of my stuff ever looked like what came out of your fuel tank. I don't think I'd be happy with it unless every single component was replaced (or at least checked/cleaned/confirmed to be clean here).
