I know this topic has been discussed before but this time i would like to know some of the legal aspects. Some questions that come to mind are - Can the vehicle be crushed if.

The vehicle was purchased with a secure car loan so technically the bank owns the vehicle.?

The driver of the vehicle had borrowed it with/without permission from the owner?

Company car?

Vehicle not in the same condition as date of offences? eg. tuning parts removed?

Now im not being a smart arse. and i dont intend to ever be in the position myself as i expect to have learned my lesson long before the 3 warnings.

if a law passes that says they can crush your car then they can crush it, but the car would have to be in the name of the offending driver, if it was in say your parents or wife/girlfriend name then they cant crush as the car dose not belong to you. Thats the best i can come up with

Yeah I agree with the above, if it's law it's law, nothing you can do about it

It's going to happen here apparently(NZ) we have the whole, car confiscation and selling thing, which I think is a good idea, because we have so many morons on the roads over here. THe downside to the car crushing thing is, how do they pay the fines/damages to other people without a car to sell?

THey do it already in california, i saw it on our news last night, basically there were about 3 honda civics caught street racing being put in a crusher :) it was pretty funny, I would be sad if I saw a GTR in it though...

They are already planning on doing it in other countries including Canada, although in that case it seems a lot more stupid:

Judging from the news coming out of Canada, it appears that the province of Ontario is prepared to go one step further. Ontario Attorney General Michael Bryant has stated that the authorities in his province will confiscate and crush vehicles built for street racing before they even put rubber to pavement on city streets. - I agree with the street racing part, but what if you just want a nice looking car with power or for track work/daily driver?

why should the offender have to be the driver?

if you lend a car to someone you are responsible for what they do with it.

eg, you lend dumb mate your car, they get a parking ticket, they ignore the warnings, your car get deregistered.

you can be sure it would be the same if they did pass these laws

if it does come into play and it only applies if the offender owns the car. i dont think anyone will have "their" car/s registered in "their" name. just as simple as saying ill put your car in my name a vice versa. i've course there would have to be alot of trust between the 2 parties... my 2 cents..

I dont agree with the car crushing bit even if it becomes a law.

I seriously think the cars in question should be confiscated and then auctioned off with the money going to charity.

I truly believe the original owner shoud have the chance to buy his own car back at auction if he wants and if he wants to be an idiot again, back to auction it goes.

I understand that there are some complete morons out there and certainly some people dont deserve to be on the roads, but crushing cars might be a little severe.

The only thing I am peed off about is the targeting of cars of responsible drivers due to the stupidity of others.

Are there any other sorts of schemes that other countries have tried with success? Id be interested to know what other ideas are out there.

well it isn't that different to the permanent confiscation laws we already have, except that the offenders car get crushed rather than sold. and as it is the court decides if the car gets permanently confiscated or not. they take into account whether money is owed on the car, etc, cause otherwise the banks would lose a shit load of money cause people who lost their cars permanently would just stop making payments and then the bank can't reposess the car, so they lose out.

Thats actually an interesting thought. I suspect that the banks wouldn't be overly pleased with their security being crushed. I presume that the banks would try to avoid securing finance against 'high risk' vehicles, however the recent vehicles in the news that have been caught for street racing have included commodores, charade, camry etc showing that the partictular make of car has little bearing on wether it will be used in such an activity.

Crushing the cars gives people more incentive to run from the police. Which, 9/10 ends in a much more serious accident then what usually happens in a street race.

Most street races involve a straight stretch of road. High speed police chases involve every piece of road possible.

I don't htink crushing the cars is gonna be a good move.

Some of these people put everything into their cars. You crush it infront of them and they are gonna snap!

that is because the people who are stupid enough to get their cars crushed are stupid enough to think they did nothing wrong and it isn't their fault and not fair.

No laws will be passed about crushing cars...

at the end of the day, if they want to pass a law, they will do it

they own the car after its confiscated, if they want to sell it they will, if they want to crush it and drop it in your driveway, they'll do that too

Hmmm i totally agree with this statement. I've witnessed a couple of cop chases on streets and they are a hell of a lot more dangerous than a drag race which as said, is usually a straight road. Not saying that this justifies anything, but you have to think about it. If some one knew that if they pull over their car that they may have spent 10s of thousands of dollars on, is going to be 100% confiscated and crushed but have a small chance of getting away if they simply put their foot down, most people will try to run.

    • Are you thinking of Bens R32? I don't remember if his went through the bonnet itself, but it went through the chassis rail. Brad (RISKIN) bought it, and turned it into a track car. It's funny how anti people are of Jim Berry now. I remember when I pulled mine out (during an engine change) and inspected it and found it cracking badly. At that point in time so many people were even on SAU, were so pro Jim Berry, and that was after Bens GTR exploded his quite publically.
    • That's one of the reasons I got that breed, they look weird, the other reasons are they small, they are very vocal, and run around like they are on crack, I didn't want a breed that just sits around, these two are like kids on red cordial  My daughter has one, and it's a laugh riot, constantly doing Parkour around the house, sits on her shoulder, plays catch, and constantly runs around the house taking turns chasing the dog around, her Bermese though, just lays around with constant bitch face, and just looks on in utter disgust at the cat and dog playing together
