Nah from an insurance POV the Mazda would be at fault due to the bike already being in the lane. The driver of the Mazda should be aware of his surroundings at all times when merging and not just in the prior head check.

Bike hasn't done anything wrong by going in the next lane and speeding up.

and is giving a left change of direction signal.

technically the car was doing this as he got level with it. so in the eyes of the law he is undertaking and therefor in the wrong....

Do you not understand "And"? The car is not turning left -and- giving a left change of direction signal, he's changing lanes.

And most developed countries have the same rule, except it's for passing on the right for the LHD countries.

The first thing I got taught in the HART rider training course was to never sit in a drivers blind spot, and to never travel in the left lane. Car drivers have issues seeing a bus let alone a motorbike in their left mirror.
