I got a bad experience today.

the story started last tuesday.

On tuesday(4/4/06), i rang up EDITED in springvale and ask for a C-west style grille for subaru wrx GC8 99.

Firsly, the officer said yes and it is in stock for au$85. then i replied to pick it up within this week(that's mean last week). On last Friday when i was in the city, i rand up EDITED again and check if there is any stock in the EDITED shop. they told me that it is in stock and welcome to have a look. (actually, i live in SE melbourne)

when i reached the EDITED shop and ask for the grille, they showed me the different one and the price is au$95. since this is a gift for my friend, i don't mind paying $10 more.what i am worried is i don't want to buy somethings that he doesn't like. so i ask them if my friend doesn't want it, can u give me a refund on that? then the staff rang the EDITED shop and he was told to approve. so i ask for a tax invoice for the grill. I asked if i can get the refund in the EDITED shop if i wish to, then the staff said it is only available here. than i said ok. For me, it doesn't matter to drive far away if they can give the refund.

On saturday(8/4/06), i showed the my firend the grill and he doesn't like it, then i rang up the EDITED shop and asked them to get back the refund on monday(today). they told me to come and promised giving me back the money.

today at about 4:30pm, i reached the EDITED shop.i was supposed to get the refund. however, the staff in they shop said that the grill has already been damaged and that's why i can get back the refund. However, the grill is still in the bag and unopened. i don't know where is the damaged as well as it is very unreasonable to say that..please see the attachment.

also the staff destroyed the receipt that he gave me. i was very angry. because i realised that customer has their owned rights to get their tax invoice. then i tried to rand up EDITED shops and see if they can help me out. However, I was punished with very rude language in the phone conversation. Finally he written down something(see attachment) and get me out of the shop. Of couse i am not agree with, and then try to fright for my rights. 2 minutes later, the staff push me down onto the floor and said something chinese XXX language like(XXX your mother).....

that's the end of my story.

anyone can advise me on what i can do????

did you pay with cash or eftpos/credit card?

A bank statement is the legal equivalent of a receipt, so if you paid by card then ripping up a tax invoice isn't going to help them much.

Legally they don't even have to give you a refund if you 'change your mind'.. however if the product is faulty or is 'not fit for its intended purpose' or breaks far sooner than it should, they are legally bound to refund you or replace it if you agree.

However with the verbal and physical assault, I would be inclined to make a report to the police, press charges and make a complaint to consumer affairs.

Something sounds dodgy to me....

Of couse i am not agree with, and then try to fright for my rights. 2 minutes later, the staff push me down onto the floor

....So what you're telling me is that you were standing behind the counter asking, "Please, may i have a refund?" when the staff member came around the counter and pushed you to the ground for no reason?

It sounds to me like you got very aggrevated; tried to "fight" the staff member and THEN he pushed you to the floor....

the staff in they shop said that the grill has already been damaged and that's why i can get back the refund. However, the grill is still in the bag and unopened. i don't know where is the damaged

...Strange.

Why didnt you ask him to show you where the damage was exactly?

i tried to rand up EDITED shops and see if they can help me out. However, I was punished with very rude language

Again, are you really telling me that you rang them up and then all of a sudden without warning they started swearing at you for the simple fact that they wanted to "punish" you?

WHAT I THINK HAPPENED

You bought this grill for yourself.(I'll explain at the end 'why') ...You tried to fit it to your car and it either didnt look good or you couldnt fit it on. You then tried to return it but there were markings/scratchings/fingerprints all over the item which ment that it was not fit for resale. YOU then became very abusive as you could see that you weren't going to get your way and yes the staff member felt threatened by your actions. You rang up the 'other' place for help in a very abusive manner which in turn you received the same treatment.

Now, the reason why i beleive you bought this grill for yourself is because you had specifically signed up to this forum to make that post(Evident by the JOINED DATE and POST DATE)....meaning that you didnt want ppl to know who exactly it was we're dealing with. As you are a regular member of this forum ppl may have noted that YOU drive a WRX and put two and two together.

*Waits for excuses in naka's reply.

Stealth, u do have a very good point there, but if he did not throw in the first punch and got assaulted, its very wrong what happened. Cuz no one has the right to assault another person over a verbal argument, abusive or not.

Naka, if u have a witness who was present at the time, who can confirm you didan throw in a punch first n got assaulted, then go to the cops n file a report.

peace :O

Stealthr33: if this had been my experience, the last thing I would want is someone arguing with me about what had happened. There IS always two sides to the story and this is only one side of it, however, it's not a very constructive post either way. Perhaps you have some affiliation with the shop in question?

My apologies if I have come accross as argumentative. It was not my intention. I was simply elaborating on my initial statement of how the whole post sounds dodgy as analyising "statements" is part of my job.

I do not understand why you have pointed out that you feel my post is "not constructive" as i can point out a million posts in a million threads that are alot worse yet no-one has pulled them up on those. It was simply my opinion. What i find more distressing is that a person has started a thread on this forum (and others) name bashing a company which I feel is not constructive yet nothing was mentioned there, apart from the EDITING of course. And the fact that he has posted up on many other forums not only proves that he is name bashing but that if he genuinly felt ripped off and put the amount of effort into getting his issue resolved (Through consumer affairs) then he would have his answers and a much brighter outcome for all.

No i dont have any affiliation with the company....i dont even know which one it was.

Again, my apologies if i've come accross as argumentative but people who set out with the intention to crush someone else really bugs me....

I with you on that one mate.

I reckon the thread should be CLOSED.

anyone want to shed some light on who "naka" is? (for those of us out of the loop)

Well without being presumptuous and some forum/google searches...

- posted as 'naka' here

- posted same thread on nissansilvia as 'nakawa'

- there's a 'nakawa' registered on SAU (well there used to be now banned)

- nakawa on SAU used a 'motorkitz.com' email address

and the images are hosted on "http://www.ezybanner.com.au/mark/cb/10042006057.jpg"

- ezybanner.com.au has the page title 'welcome to motorkitz.com'

- motorkitz is a former trader on SAU of bodykits  and also on NS.com

- there is a SAU thread from motorkitz in which ppl point out that there is a link somewhere with vivagarage

    • Well, all the best with the new camry It was interesting to hear about the UK process, it is generally a lot more streamlined here with a shipping agent looking after all the import side (noting the exact final price can still be a surprise.....) and I've used a few different brokers on the japan (or US) side, and never had any trouble with any of them....luck of the draw I guess. You mentioned you didn't get the auction sheet (understandable since you bought it from a dealer, not auction), but I always try and get hold of that because they are pretty thorough. I've imported 2x R grade vehicles over the years and both were fine, repairs in Japan are pretty thorough compared to here in Oz.
    • BTW I measured the jack I have, it is 70mm at the saddle but you only have about 700 until it returns to 150mm high at the cylinder so it is good but no magic bullet.
    • My experience with Rising Sun Exports Before agreeing to the sale I tried to do as much research as I could (obviously), his Facebook reviews are 98% and he goes Live at least once or twice a week. I contacted 2 people in the UK who had used him for their imports, both had positive feedback. His explanation and talk through of the import process was thorough, answering any query no matter how stupid it was. It felt as soon as the money was sent, communication dropped off. I asked for shipping updates every 2 weeks or so, not wanting to pester him, he never had any updates. I wasn't informed the car had been dropped off at the port, I only found out by his Facebook story. I asked for the photos taken at the port, knowing he would need some for insurance purposes. I received a few 5 second clips and that's it. When asked again, he said his staff had them. Weeks later I asked again, he tells me he doesn't have any, but does have 50 photos from the original advert. I never received them. I eventually got the documents sent via WhatsApp after I mentioned the port was requesting them. I purchased a CarVX report, to find out the vehicle is a Grade R with recorded accident damage, first recorded in 2017 when it was first auctioned. He never told me the grade, then again I didn't ask. His response was "Grade R means nothing, it wasn't chassis damage". Still, I would have liked to have been informed about it. Jon prides himself on being open and honest when it comes to inspecting cars, it's his main job doing so at the auctions for customers. When the vehicle arrived in the UK I noticed a few little cosmetic issues. It's a 21 year old car so it wasn't going to be mint condition. The side skirts are cracked on each corner and the sealant is failing. The front grill on the bonnet/hood isn't secured very well, mounting studs are missing. Both minor things, but again, it would have been nice to be told. During a Facebook Live walk around video of the vehicle, he mentioned it has a front Whiteline anti roll bar/sway bar. While on the inspection ramp, I noticed the stock item has been installed. When first questioned, his response was "the ARB? Switched? Since when, it never had them". Since sending video and photo evidence I've not received a response. I'm probably being over critical of the overall condition of an old car, but all I wanted was honesty (which he claims to have). I'm aware I wasn't his only customer, he's busy doing XYZ but other reviews praise him for great communication with regular updates and photos, I felt I didn't receive the same treatment.
    • I was able to get some underside photos while the car was on the ramp The suspension is all Altezza/IS200/IS300 so getting part's will hopefully be less of a headache
    • Welcome to my 2004 Toyota Mark ii IR-V Fortuna (series 2) With a 1JZ-GTE powerplant under the bonnet (hood) it'll give me plenty of scope for power upgrades. For those who aren't familiar with imports, the 1JZ-GTE is a 2.5L 6 cylinder VVTi engine with a single turbocharger. This has the factory R154 5 speed gearbox, along with a aftermarket 2 way LSD differential (brand unknown). Under the arches are a set of CST Zero 1 alloys, 18x9 +30 225/40 up front and 18x9.5 +15 265/35 on the rear. The car was quite low in Japan and there's evidence of the wheels catching the rolled arches/fenders. The tyre's aren't great so I'm in two minds whether to replace both or just the tyres and put up with the wider wheels on the rear. The car still uses stock brakes with the addition of some braided hoses. The exterior is stock with the exception of a BN Sports front bumper and a replacement Fortuna grill  Moving to the interior, the steering wheel has been replaced with a dished MOMO steering wheel (which will get swapped for my Momo Tuner for the time being) Defi Link Gauges are mounted above the climate controls and on the A pillar, the Oil Temp,Oil Pressure,Water Temp and Boost gauges should help with spirited and track driving  The stock seats have been replaced with some retrimmed Recaro bucket seats. Being a larger build these are a little snug, unfortunately the orange isn't for me so I'll look into replacing these down the line. Other modifications include a twin plate clutch, Blitz intercooler, Evolve alloy radiator, a stainless exhaust with decat, HKS EVC-S boost controller and coil overs
