Hi guys,

I got pulled over on Stud Rd, and they tested my car for noise on the 14th of Nov

I got a notice from the EPA for my car being too noisy, and they sent a notice to get it fixed before 27th of Jan

I then received a fine for noisy car from EPA a week later

Has this happened to anyone else? I thought I got a chance to clear myself before I was issued a fine.

My mate in his WRX just got done around the same time on a sat night is some big EPA sting at Knox, he wasn't even near it, the cops pulled him up about 3km away and told him to follow to the parking complex where they proceeded to test his car (stock as a rock except for exhaust).

It was his second offense, EPA fined him $564 for his car being to noisy gave him a big green sticker and sent him to get retested in Mcloud.

If they did the full test then and there... its not the same as the EPA Letter where it says "we suspect you to be over, come in for a check"... where by people change exhausts etc to try and get around the fact they are driving around illegally

So techically you were busted red handed breaking the law... Look into it, but i dont see why you should be given a chance to fix it. You dont for a defect notice (you get fined), so same applies here far as i see it.

This is mainly a question for Ash, as I know he has gone through engineers before.

Basically when I get my car back (It's nearly ready!), I basically want to have it engineered and re-registered as a 2-seater (due to the cage). Basically what I need to know is to get those such things passed, do I need to have the whole car inspected? Or just the modifications in question?

I have 2 intake mods, but will be changing that back to a standard airbox shortly, plus I believe I'd have to hide my boost controller or remove it?

Just the mods pertaining to the 2-seater... Ie the back seats removed, mounting/ancor points for belts removed etc etc and that the cage is VicRoads approved or is constructed in that manner which i assume you've done already as thats pretty common knowledge.

They wont look for general RWC items like a EBC mate.

I dont even think the whole pod/EPA crap will come into question. Even if it does you're not asking them to sign off on that part as they will only be listing the seater conversion points in the report so thats all that matters

The guys in Braeside i went with were very professional and one of the cheapest for a VASS. Some places wanted an extra $200 to do the same job as they are not required to operate to a specific pricing scheme

I'm just in the very early stages of thinking about it.

Basically just want to drive the car a little more on the street, so want to try and make things as legal as possible, this also includes scrapping my pod for an airbox (which will flow better anyway). I have piping that comes through the battery tray too, so I will get that reinforced and get the engineer to sign off on that aswell.

The cage was built by Brown Davis, so there won't be any issues in it getting passed. I may also go to the length of having my 2-inch harness passed so I can use it on the street, as I don't really like the lap-sash seatbelt with my seat.

Ive i get done for POD and FMIC whats the best way to clear it? I cant fit the airbox because of the way my cooler piping is made, and i cant remove my front bar to make adjustments to the FMIC or anything because its like bolted to the car (dont ask)

I was just wandering if i did get defected for it what would be the best way to clear it up to get a RWC?

I really need some help here guys, I got pulled over and informed that I dont have a Catlytic converter and that I would recieve a $1500 fine in the mail and that I would need to fix this up and take the car in to an EPA testing station to have this cleared withing 14 days.

Now the thing is that its not my fault since when I purchased the car it came with a roadworthy certificate and I havent removed it since then.

1. Can I try and contest this, even though I purchased the car 5 months ago? I still have the original roadworthy forms etc.

2. Do I need to remove my Apexi Pod filters and place the stock airbox?

3. Currently my 02 Sensors are disconnected do I need to fix this in order to allow it to pass emissions testing?

4. I have leaking injectors in the engine bay, would I need to fix this as part of compliance with emmisions?

I am really stressed about this, since the guy sold me the car without a cat convertor and with a roady, therefore and any help would be appreciated thanks.

- Not sure it would work but it won't be hurt to try to contest this.

- If you have standard Intercooler in place, you don't have to providing the apexi filter is paper element not oil, if you're not sure, put stock airbox in place.

3. Currently my 02 Sensors are disconnected do I need to fix this in order to allow it to pass emissions testing?

- Yes they have to be connected, EPA requires all factory emission gears in place.

4. I have leaking injectors in the engine bay, would I need to fix this as part of compliance with emmisions?

- I'd fix the leaking injectors, you wouldn't want your car to be burnt, better safe than sorry.

Has anyone ever tried to contest these catalytic converter fines before and won?

I have am telling the truth when I say that is how I was sold the car, but how can I prove it? Doesnt it basically come down to his word vs. mine?

Also, thanks grantregarding the questions, yeah I thought I may need to fix the 02 Sensors.

I think I am going to need to hire a lawyer to settle this matter as I am not paying $1500 for something I didnt do!!!!

I don't know anyone who has contest the fine regarding catalyic converter (others might), for this, sorry I can't be more help to you. Might try to contact the mechanic who did roadworthy or previous owner and see how they feel about it (doubt if they care but at your situation, it is never hurt to look at all options).

After quick read on VSI26 (Roadworthy requirments) states that all exhaust and emission controls that the said car are equipped are to be there when the inspection is being taken place, I suspect the previous owner chucked the standard exhaust system to pass RWC then swap back (pretty common).

You could use this to agure your case if you were to 'lawyered up' (talk to solictor/lawyer/legal aid about this and see what they say), Write a well written letter explaining your situation or call/go there and discuss first before the next step further (this is what I would do).

Again, hope it helps. 'R31Nismoid' could help you as he know about EPA and such better than me.

I am currently thinking there are two possible avenues to dispute this.

1. Since the car was purchased without a Cat & Roadworthy was supplied by his dad's workshop, I can try to contact the previous owner and tell him the situation and request that he pays the $1500 fine, or I will summons him to court. Hopefully he will do the honerable thing and pay the fine otherwise it will be difficult to prove this in court.

2. I can contest the fine through EPA and write a very well written letter explaining that I purchased the car in the current state and that I should not be held liable. Also, how do they know its not a high flow cat? The police officer took a photo of it underneath the car at night for proof but never actually opened the pipe to check inside. For all we know it could just be a high flow cat? The outside of a de-cat and high flow look very similar dont they? Wouldn't it then be up to them to prove that its not a high flow?

I should not be held liable for this and its just so unfair!! I might go and consult lawyer, does anyone know any lawyers in melb that would specialise in traffic law?

Yeah obviously, but how would be the best way to fix it? Take out pod and somehow get the airbox in?

Thats a question only you can answer as i have NFI what your setup is and how much work is involved fabrication wise

I'm not a lawyer but I'd assume that since you signed the purchase papers and had ownership of the vehicle transferred to you, legally you'd be responsible for the condition of the vehicle at the time you got nabbed. EPA peeps can't go and wrastle with previous owners, they can only go after the current owner.

IF the RWC was dodgy, you could try going down that path. But I'd imagine that the onus would be on you to prove that it WAS dodgy, not on the tester to prove it wasn't.

You could still take action against the previous owner, but it would have to be a separate process to any EPA action you're embroiled in. Also, I'm not sure how much recourse the buyer has for disputing private purchases (Caveat Emptor - Buyer Beware).

How can they prove that it wasn't a high flow from a picture? Couldn't I contest this? Then it would be up to them to prove it?

    • From there, it is really just test and assemble. Plug the adapter cables from the unit into the back of the screen, then the other side to the car harness. Don't forget all the other plugs too! Run the cables behind the unit and screw it back into place (4 screws) and you should now have 3 cables to run from the top screen to the android unit. I ran them along the DS of the other AV units in the gap between their backets and the console, and used some corrugated tubing on the sharp edges of the bracket so the wires were safe. Plug the centre console and lower screen in temporarily and turn the car to ACC, the AV should fire up as normal. Hold the back button for 3 sec and Android should appear on the top screen. You need to set the input to Aux for audio (more on that later). I put the unit under the AC duct in the centre console, with the wifi antenna on top of the AC duct near the shifter, the bluetooth antenna on the AC duct under the centre console The GPS unit on top of the DS to AC duct; they all seem to work OK there are are out of the way. Neat cable routing is a pain. For the drive recorder I mounted it near the rear view mirror and run the cable in the headlining, across the a pillar and then down the inside of the a pillar seal to the DS lower dash. From there it goes across and to one USB input for the unit. The second USB input is attached to the ECUtec OBD dongle and the 3rd goes to the USB bulkhead connected I added in the centre console. This is how the centre console looks "tidied" up Note I didn't install the provided speaker, didn't use the 2.5mm IPod in line or the piggyback loom for the Ipod or change any DIP switches; they seem to only be required if you need to use the Ipod input rather than the AUX input. That's it, install done, I'll follow up with a separate post on how the unit works, but in summary it retains all factory functions and inputs (so I still use my phone to the car for calls), reverse still works like factory etc.
    • Place the new daughterboard in the case and mount it using the 3 small black rivets provided, and reconnect the 3 factory ribbon cables to the new board Then, use the 3 piggyback cables from the daughterboard into the factory board on top (there are stand offs in the case to keep them apart. and remember to reconnect the antenna and rear cover fan wires. 1 screw to hold the motherboard in place. Before closing the case, make a hole in the sticker covering a hole in the case and run the cable for the android unit into the plug there. The video forgot this step, so did I, so will you probably. Then redo the 4 screws on back, 2 each top and bottom, 3 each side and put the 2 brackets back on.....all ready to go and not that tricky really.      
    • Onto the android unit. You need to remove the top screen because there is a daughterboard to put inside the case. Each side vent pops out from clips; start at the bottom and carefully remove upwards (use a trim remover tool to avoid breaking anything). Then the lower screen and controls come out, 4 screws, a couple of clips (including 3 flimsy ones at the top) and 3 plugs on the rear. Then the upper screen, 4 screws and a bunch of plugs and she is out. From there, remove the mounting brackets (2 screws each), 4 screws on the rear, 2 screws top and bottom and 3 screws holding in the small plates on each side. When you remove the back cover (tight fit), watch out for the power cable for the fan, I removed it so I could put the back aside. The mainboard is held in by 1 screw in the middle, 1 aerial at the top and 3 ribbon cables. If you've ever done any laptop stuff the ribbon cables are OK to work with, just pop up the retainer and they slide out. If you are not familiar just grab a 12 year old from an iphone factory, they will know how it works The case should now look like this:
    • Switching the console was tricky. First there were 6 screws to remove, and also the little adapter loom and its screws had to come out. Also don't forget to remove the 2 screws holding the central locking receiver. Then there are 4 clips on either side....these were very tight in this case and needed careful persuading with a long flat screw driver....some force required but not enough to break them...this was probably the fiddliest part of the whole job. In my case I needed both the wiring loom and the central locking receiver module to swap across to the new one. That was it for the console, so "assembly is the reverse of disassembly"
    • But first....while I was there, I also swapped across the centre console box for the other style where the AV inputs don't intrude into the (very limited !) space.  Part# was 96926-4GA0A, 284H3-4GA0B, 284H3-4GA0A. (I've already swapped the top 12v socket for a USB bulkhead in this pic, it fit the hole without modification:) Comparison of the 2: Basically to do the console you need to remove the DS and PS side console trim (they slide up and back, held in by clips only) Then remove the back half of the console top trim with the cupholders, pops up, all clips again but be careful at the front as it is pretty flimsy. Then slide the shifter boot down, remove the spring clip, loose it forever somewhere in the car the pull the shift knob off. Remove the tiny plastic piece on DS near "P" and use something thin and long (most screwdrivers won't fit) to push down the interlock and put the shifter down in D for space. There is one screw at the front, then the shifter surround and ashtray lift up. There are 3 or 4 plugs underneath and it is off. Next is the rear cover of the centre console; you need to open the console lid, pop off the trim covering the lid hinge and undo the 2rd screw from the driver's side (the rest all need to come out later so you can do them all now and remove the lid) Then the rear cover unclips (6 clips), start at the top with a trim tool pulling backwards. Once it is off there are 2 screws facing rearwards to remove (need a short phillips for these) and you are done with the rear of the console. There are 4 plugs at the A/V box to unclip Then there are 2 screws at the front of the console, and 2 clips (pull up and back) and the console will come out.
