The second and third fines was just a fine letter saying $292 for driving a unroadworthy vehicle. That's the problem. Nothing listed. Why do you think I lost it?

It's because I still have a valid roadworthy and just cleared it a few weeks before and then they fine me again.

Rubbish - every canary i've had lists the items that are unroadworthy.

How can you just say a car is "unroadworthy" without specifiying what needs to be fixed?

it sounds like he got the fine they like handing out not actually a defect my mate got one a couple weeks ago for too low but no defect just infringement notice.. which is stupid cos he doesnt have to show anyone that the car has been raised etc.

can someone clarify does the defect notice need 5 items for a major? someone told me this and i find it hard to believe i got 2 things listed and "inspection incomplete" which vicroads had never heard of inspection incomplete..

one big enough flaw will give you a major if the Office sees it as a safety issue, IE; tyres on belts. it is up to the officers discretion.

If that's the case, keep the RWC and the fine.. don't pay it and take the matter to court. How can you be fined for driving an unroadworthy car without being told what is unroadworthy on it?

You cannot defect a car and say it is Unroadworthy - without actually stating what the problem is.

That is just retarded.

in the last week, i've only seen 2cop cars. whats the big deal with everyone ? your car is a magnet, leave it at home,

if its legal to the eye, no problems.

I would definitely contest all of these fines. If they don't NOU the car I don't see how it's possible to issue fine for Unroadworthy vehicle. Any decent solicitor should be able to get you off that if you ask me. Roadworthiness is a safety issue so fines irrelevant IMO as NOU is to force person to make car safe. I fyou give out fine without NOU then your defeiting the purpose. Doesn't make any sense to me and I would think court would agree.

Please read my posts again. I got a canary initially - yes, of course I got all the yellow sticker and the list of things to fix - yes. However, the subsequent fines did not involve a canary. You may recall that I wrote, I can't believe they can fine me again for having an unroadworthy vehicle and $292 only days after I got a full RWC and had cleared it with Vicroads.

This is why I am upset. So to recap, canaried - cleared it, then fined again after that without canary.

Thank you...now you feel my anger...the pointed to various things as I had mentioned before and then just said it's unroadworthy even after I showed them my RWC I got a few days before that.

    • That's probably OK. That's a face to face compression joint between two surfaces with the clamping load provided by those bolts. So.... it's unlikely that the bolts will end up feeling that load in shear, unless the clamping surfaces are not large enough, bolts not got enough tension on them, etc etc to prevent the two faces from moving wrt each other. Which... I would hope the designers have considered, seeing as it's probably one of the most important things the upright has to do apart from resist collapsing in its own right. But yes, it would definitely be worth asking them what their safety factor on that part of the design was. I tend to think that the casting, being a casting, is not necessarily the strongest bit of material in the world. It's about an inch square, and when you think about the loads that are being put into it, you have to wonder what safety factor the Nissan boys (and every other OEM engineer who has designed all the millions of other uprights that look essentially the same) used to account for defective casting, aging, severe impacts on the wheel, etc etc. 
    • Those bolts would be orders of magnitude stronger that cast aluminium though.  And its mainly clamping force, not shear they are dealing with?
    • Except all that twisting force that is breaking a cast piece, appears to be going through 4 bolts in the picture Johnny posted of the BryPar one...
    • The smart approach is to use the gearbox loom from the manual car. Makes it a lot easier - just plugs into the switches on the box and plugs into the main loom up near the fusebox. Then you only need to deal with bypassing the inhibit switch. The other approach requires you to use the wiring diagram to identify those wires by colour and location, perhaps even indulging in a little multimeter action to trace them end to end to make sure, and then.... you will have the answers you need. The R34 wiring diagram is available on-line (no, I do not have a link to it myself - I would have to do a search if I wasn't able to go to the copy I have at home).
