You get along with all your neighbors? Just wondering if one of them might have dobbed your brother in for his car being loud / noise complaint.

Yeah never had any issues, he has a varex on it as well so not that loud.

Hell my CBR600 was way louder

POLICE
Police are allowed onto your land if they have a warrant, which they should show you when seeking entry to your land. If they don't have a warrant, they may only enter your land if you invite them, or if particular circumstances arise, such as making an arrest, stopping a breach of the peace or ensuring that the SOA is being complied with (see: "Power to search without warrant", in Chapter 3*2 Arrest and Interrogation).
POWER TO SEARCH WITHOUT WARRANT
Victorian offences

Section 459A of the Crimes Act (Vic) gives a member of the police force power to enter and search any place without warrant for the purpose of arrest where it is believed, on reasonable grounds, that a person may be found, who:

  1. has committed a serious indictable offence in Victoria;
  2. has committed an offence elsewhere which, if committed in Victoria, would be a serious indictable offence;
  3. has escaped from legal custody; or
  4. is committing a serious indictable offence.

A serious indictable offence in this context means any offence for which the law provides for imprisonment for life or for five years or more (s.325). This includes offences such as theft (including shoplifting) as well as the most serious offences, such as armed robbery, rape or murder.

Still trying to find if your driveway is public/private though....

I'm clearly not needed, Toby used Google lol

Criminal law isn't my forté, but I dare say vic pol will use 'stopping a breach of the peace' to suit them, such as by claiming someone reported the car doing skids etc. It's tenuous though, might be worth calling the cops and asking for a please explain.

What did the notice say about the location of the car?

My dads car was broken into last night or the night before, so much for me thinking that my street was one of the safe ones...

Center console stuff all over the seats, they somehow missed the bag of coins that was in there :/

Not sure if it was actually locked, it often isn't after he goes and brings in the shopping on a sat arvo...

No damage to anything as far as we can tell, so i guess thats a plus.

I gave my baby a wash, polish, wax on Saturday so it was in the garage all weekend... Normally it would be sitting in the middle of the front lawn. Hopefully my alarm and big flashing blue light would be enough of a deterrent to kid street punks looking for money...

lol... update... My dad parked my mums car in the driveway on Sunday after moving it off the lawn so he could mow it... Left that unlocked as well, tard... Coins n stuff also pinched from hers last night

Might get my arse into gear and fix/replace the sensor flood lights

Does someone have legal reference if your driveway is private/public?

And also can you be defected on private property?

I only found this thread on google:

Ric? Your the resident lawyer here

same as ay ay ron said, if its not behind a locked gate/garage door OR on another vehicle/trailer then its fair game.

if its being towed on a car trailer/flat bed (or even parked stationary), they can defect the flat bed or the trailer but not the car on it, thats how the rules work here #summernatsdefectavoidancetactics

It doesn't really matter what you do to avoid it, if they really want to get you for something, they can. They have the discretionary power for it. Let's not forget their greatest one - writing down a number plate, sending a report to the EPA and having a test notice rock up in your mail.

It's for this reason that I'd never argue with a cop about a defect or the shit he issues you, you'll only make it worse; fight it in court instead, when he can't see your car, or he'll get you on something "legitimate" like an EPA notice.

Ishan, your's just a GT yeah?

Yessir. Both eyes, like 33GTST. From memory, the 34GTT has eyes at the front, but forks at the rear. So if Alvin's busted set is for the front, can borrow the fronts I suppose if needed lolz.

Yeah, I'll see how I go with Alvins - just need to sit tight until he send me a SMS.

    • Nah that is not actually a lot. Just painting my GTR frontend and the little bits to make sideskirts/nismo flare pieces work correctly/fit on the sedan/mount up correctly came to about $7000. Is it a lot? Sure. None of this is economical. Economy would be shelling the car and buying a 2010 Corolla to commute in. The perspective of all of this is different.
    • I have the re003s’ on my 06 XT Forester Turbo and I highly rate them for street wet and dry
    • I don't see any issues here. I've been saying all along this is a big job, the price reflects that.  When the car comes back perfect I'm sure it will feel like money well spent.
    • Remember, take original quote. Double it. Then add a bit more. It's how any project goes.
    • So, I started this repair and got as far as "fixing" the holes with some fibreglass. God all those years working on boats came back quickly. I decided I'd reach out to some rust guys just to see what they would say about it. I came across a guy about 40 mins away and went to see him. He said the windscreen needs to come out, that there might be some more bits around the windscreen and he'd quote them at the time. But his quote was $300 to remove and replace windscreen and $3k for the damage he can see. He said he could respray the roof for $1200 and the bonnet for another $800 (somebody has previously rattle canned it, its horrendous). This is $5300 + any small additional bits. It's a lot, I get that and the name of one of my fave youtube channels 'Not Economically Viable' comes to mind.  I'm not being financially rational, but I've taken him up on the quote. He's opening a new shop in November with more room, so we're waiting for that. I'll leave the currently missing headliner out until then. I'm looking forward to it being fixed and having the paint looking nice again (lots of clear coat issues on the roof too). / flame suit on.
